Is it legal to take photos of people without asking?
In public places where there is no right to privacy, yes you can. The same applies in private places where you have the permission of the landowner or the landowner has stated no restrictions on photography. However photographing someone without asking their permission can cause a lot of trouble if not handled sensitively. If someone does not want to be photographed it is best to respect their wishes unless there is an overriding reason not to. Most people in most circumstances respond well to friendly explanation, especially if you show them the photo. Nevertheless some will object that you have violated their rights in some interesting way, and it's best to have the explanations ready.
'You can't take my photo without permission'. Oh yes you can, usually. Point to the CCTV cameras and wave, they never asked either. Of course it is perfectly understandable that individuals may feel singled out and perhaps intimidated, frightened or angry not to be in control, but it's not a legal point.
'You have violated my copyright'. This is in no sense true. There is no copyright in the human face or form, and copying would anyway mean cloning them, not creating an image. An image of a person is copyright of the photographer.
'You have violated my privacy'. Legally this is unlikely to be true. There is no right to privacy in public places as a rule. There is a right to privacy in private places and in public places where there is a reasonable expectation of privacy (eg public toilets), but how extensive this is depends on circumstances.
In private places that are open to the public, permission of the landowner is usually sufficient to be able to photograph visitors and staff. However a recent court case upheld a right to eat a meal in a restaurant in privacy even though the restaurant owner had consented to the photography, because in the court's view it was a customer's normal expectation not to be photographed there. If in doubt, this is probably the question to ask yourself.
'You have violated my human rights'. Police seem to sometimes object to being photographed on the grounds that their 'Human Rights' are being violated. This really means the same thing as 'privacy' and there is none in the street as the presence of CCTV and police photographers shows.
The Human Rights Act 1998 recognises a human right to expect privacy wherever privacy is normal, eg in the home. So photographs taken where privacy may be expected require permission of the subject. EG photographs taken from public places that depict someone within their home in a situation where they expect privacy, for instance through a window using a telephoto lens, will be actionable.
'You are harassing me'. Photography can indeed constitute harassment, but for an act to constitute harassment requires deliberate acts of harassment on at least 2 separate occasions. The complainant may then seek a restraining order from the court.
Harassment is potentially an issue for paparazzi in their pursuit of celebrities, but equally a restraining order has been used to suppress inconvenient photography by npower at Radley lakes.
'You need a model release'. Model releases are not necessary for anything except photographs to be used for commercial purposes. For editorial or artistic purposes they have no relevance unless you intend defaming the subject and need them to make a contractual agreement not to sue you for libel. If you intend selling the image for marketing or advertising use that implies endorsement by the subject, then yes, you need a model release (or rather, the advertiser does).
'You have violated data protection law'. Superficially this seems correct as the Data Protection Act does indeed prohibit the recording of data that identifies an individual. A photograph certainly qualifies and the DPA certainly applies to CCTV monitoring, ID photos etc. However the DPA Part 1 Section 3 specifically exempts as a 'special purpose' photographs or other data recorded for journalism, or for artistic or literary purposes.

GLAAD, the world's lesbian, gay, bisexual, and transgender (LGBT) media advocacy organization, honored Robert De Niro, Mariah Carey, and the best in film, television, and journalism at the 27th Annual GLAAD Media Awards at the Waldorf Astoria New York on Saturday May 14th 2016. Jennifer Lawrence, Aziz Ansari, Connie Britton, Diane Sawyer, Caitlyn Jenner, Tamron Hall, Noah Galvin, Andrew Rannells, Andreja Pejić, and Jason Biggs were among the special guests. Recording artists Alex Newell and Bebe Rexha, as well as the Tony Award-winning Broadway musical Fun Home performed at the event hosted by Emmy Award-winning actress Laverne Cox. The 27th Annual GLAAD Media Awards were presented by Delta Air Lines, Hilton, Ketel One Vodka, and Wells Fargo.

A vigil to mourn for the victims, pray for the injured, and express our outrage at the shooting at the GLBT Center in Tel Aviv. Nir Katz, 26, and Liz Trubeshi, 16, were murdered when a masked gunman opened fire in a basement room where teenagers were holding a weekly support group. At least 10 others were also wounded, mostly teenagers.

You all know I've shot Conor a LOT over the years but tonight was super special because Desaparecidos reunited & played their first show in LA in about 10 years. Two years ago I flew to Omaha to shoot their reunion show & it was amazing having them do a mini tour (& they're releasing new material, too!). My first Dirt Track shoot.as a PRESS member…Yippeees!
Few things I need to learn. Shutter Speeds.If u need to catch that defame of Dirt jumping up from the Rear Wheel …or if you need to Pan a Shot…u need to change vary slight shutterspeeds as per your taste.
Yes it sounds easy now to talk about it…but if u do not do these little estimations in shutterspeeds and aperture THERE, at THAT moment…u might get a lil disappointed to see the result in the 17” screen at home!
No had feelings with this particular snap though…but a few others could’ve come better.

Rudy Giuliani lost a defamation suit filed by two Georgia election workers, Ruby Freeman and her daughter Shaye Moss after he didn’t provide information requested in subpoenas. The former New York City mayor had falsely claimed Freeman and Moss were “ballot-stuffing criminal conspirators.”
Judge Beryl Howell ordered Donald Trump’s former attorney to pay $133,000 in damages after he failed to provide discovery documents in the case. The judge called Giuliani’s failure “willful discovery misconduct.” “Giuliani conceded in a court filing earlier this year that he had made false statements against the pair, which he said were ‘defamatory per se.’ Still, he argued his statements were constitutionally protected.” According to The Hill, “Howell’s ruling finds Giuliani civilly liable by default for defamation, intentional infliction of emotional distress, and civil conspiracy.” A trial will take place to determine damages.
Giuliani finds himself in financial jeopardy as he faces additional defamation suits brought by voting equipment companies and disbarment actions.
Americans have lost confidence in their government. We no longer trust our legislators and the Supreme Court to solve our country’s problems: income inequality, affordable health care, a woman’s right to decide what’s best for her health, the economy, and climate change. Governance has become a series of battles. It’s no longer just political ideology. We are at war over cultural issues while our politicians ignore our basic needs. And we’ve lost faith in our country’s institutions when ersatz news organizations like Fox knew Donald Trump lost the election but promoted voter fraud to get ratings.
The morals of our GOP legislators and their sycophants are just as important as their economic policy. How can we trust a party that Alex Patton, a Florida-based Republican consultant and pollster, has characterized as a party that “has become mean and driven by emotion on whom we dislike.”? “But,” he says, “that is the driving force in American politics right now.” That is the driving force of the GOP, not the Democrats. This is not an example of the equality of “bothsidesism.”
In my essay, “ It’s Time to Release Our Own Kraken!" I outlined the history of the Republican Party’s “below the belt” tactics. They continue to be underhanded to this day. But with the low level of civility in our present polarized country, many Republican legislators now in office have hit new ethical lows.
As a visual artist who has spent over a decade creating posters about the sorry state of American political discourse, this year I began a new series of portraits, "Faces of the Republican Party." The men and women in this series deserve to be taken to task for their unwillingness to compromise, belief in conspiracy theories, and disdain for the LGBTQ+ community, women’s rights, and our children’s education. The purpose of our government is to solve our nation’s problems. It’s not a place for personal vendettas or manufactured cultural issues.
“Faces of the Republican Party” is not a partisan series of portraits. Merriam-Webster defines the word as “a firm adherent to a party, faction, cause, or person, especially one exhibiting blind, prejudiced, and unreasoning allegiance.” The people depicted in these images are the partisans. Instead, my series is a documentary and op-ed showcasing the facts in 2022. All of them had a hand in trying to overthrow the government. These images are MAGA Republicans who put their blind allegiance to Donald Trump and their careers ahead of the needs of the American people.
Republicans are perfect examples of Patton’s “driving force.” This force is dirty, mean, misogynistic, selfish, and wastes our tax dollars. These people are just a small sampling of individuals responsible for the loss of credibility and faith in America’s institutions. And worse, they couldn’t care less.
