In British law, slander and libel are both forms of defamation, but they differ in their medium of communication.
Slander refers to the act of making defamatory statements that are spoken or transitory in nature, such as through spoken words, gestures, or even non-permanent forms of media.
On the other hand, libel pertains to the publication or dissemination of defamatory statements in a permanent or fixed form, typically in writing or through other permanent means like broadcasting or social media.
The key distinction lies in the potential for lasting harm caused by libel due to its permanent nature, whereas slander tends to have more fleeting effects.

There is nothing depressing about blue. :-) Who was it that first defamed blue's name? I want to know. The way I see it, if anyone claims to have the blues, they should be feeling awfully good. A great color that should not be associated with any form of depression. :-) If you need a color to associate with depression, how about gray or black? That makes much more sense. Here's hoping your day is filled with blues.

Moneybagg Yo - Defamation of Character
For various reasons, just haven't been able to get out and get any decent photos. So, like with the media, on a slow news day, one just dredges up more of the same old. At least I'm not defaming anyone or instilling fear into the masses.....I'd need to post a photo of myself in the Spandex Jumpsuit to sink that low.

Political ads on TV aren’t required to be factual. The First Amendment protects political speech on television, but the people who make the ads may be liable for defamation depending on what the ad claims.
A sand sculpture that I found defaced.
This cold I have is making me sneeze all the time, runny nose that won't stop and a cough that really hurts my throat. Iheard of many people who have had it and hope it doesn't last too long as I need the energy to work.
Came across this incoherent yard signage and collection of old military vehicles while cycling Minnesota. Looked up “2000 Mules” and learned the film was so widely debunked that they had to apologize to those it defamed, and pull it from distribution. But this guy’s yard signs stayed up.

Most cemeteries have no modern amenities. Those that do hold special places in hearts. Some might have outhouses or pit toilets, such as the one pictured here.
People are much more apt to use a pit toilet as opposed to an outhouse, though functionally and rationally, they're the same thing. Honestly, I think most folks might feel a little odd using the bathroom at all in a cemetery. Something about not wishing to defame the dead.
But that was not the care here. In this cemetery, the bathrooms are seen as wonderfully utilitarian, complete with a tool shed between the mens and womans outhouses.

"For those who have gotten wind of current defamation and untruthful claims against *ES* and our pose store in copying poses from a rival pose store we filed a DMCA giving us the right to show all evidence of our creations upload dates etc etc filing a DMCA (which is a proper legal channel for any content theft..not just copyright =p covered under the act of the DMCA) in showing just the opposite..that the accusers have copied poses from *ES*.
The reason Linden Lab has this process is to hold providers liable for creations unique to individuals and items they create in SL. Just like skins or clothes which are not copyrighted in most cases.

Yesterday I was accused on the facebook page of another photographer, someone who is not a friend of mine, of "copying and pasting" one of her photos and passing it off as my original work. She gave out my Instagram account to her friends, who then proceeded to bully me with nasty comments. Luckily someone told me what was happening. I had no idea. And so I deleted the photo I had posted from all social media sites, and posted another photo and a text in response to these false accusations.
This other photographer has used mirrors propped against the wall, which I also used in my photo. I am not familiar enough with her compositions to even know if she made a photo like mine, where I showed a diptych of photos of my legs and my new pair of shoes being reflected in the mirror, which was leaning against the wall. The mood was similar to her photos, but was my photo an exact copy of something she did? No way. Was my intention to make a photo that could have been mistaken for one of hers? Again, no.
Can one person own a photographic mood? Can one person own the exclusive rights to using a mirror in photos?
My original photos in this diptych were made on color film, but I converted it to black and white because the tones were a bit orangey, which I didn't like.
And so now, after being defamed, after having my reputation and my integrity called into question, I am posting and/or re-posting images I have made over the years, long before I used polaroid cameras, that show some type of reflection. This is the beginning of that series of posts. Thank you for bearing with me. I need to do this to help me move past what happened yesterday.
And thanks to those who also follow me on Instagram who were sweet and kind and supportive. You don't know how much that means to me. And to those who have always been loyal to me here, a big thank you to you as well. <3
She covers her shame begging on the path to Taragadh, and mind you it is insanely dry and hot ..and she will sit there for hours as devotees going upwards to the Chilla of Ghaus Pak or the Dargah at Taragadh will throw her a few coins.
This is the sad part of existence , he children cluster around her and without throwing doubts on her poverty , where is her husband.I dd not ask her most of the beggars I shot in Mumbai at Bandra where I stay are forced into beggary by their husbands in most cases.
And so you know how the hijab saves her from ignominy and degradation.
And I am really upset by a news in Times of India , Hands chopped off for Prophet insult by Muslim fanatics in Kerala of a college lecturer accusing him of defaming the Holy Prophet.
And Kerala the most literate and Gods own country.. Shame.
The other sad news was the fall of a six year old boy from a luxury hotel in Juhu.. Saddening.
Well this is the last segment of this memory card I have place about 99 pictures for uploading , another card remains before my Ajmer travelogue in Sufi hinterland comes to an end.
Taragadh was introspection of street pain..though it is a hilly trail, I shot it as a street photographer .
Street photography is an impulsive piece of madness you shoot with your inner eye and let the camera do the rest.
Using a digital camera makes it much easier and as much as I liked shoting film and slide I could never do it again my world is larger than 35 frames of Film.
I post everything I shoot only the dark black duds I remove.
I dont mess my pictures with cropping nor do I re-size them..they come hot and burning like loaves from the furnace of life.
And I am cooped up at home ., earlier Bandhs I took my camera to shoot the shut shops and the lonely streets , but my world is a world of people I shoot humanity and would not be able to shoot a blank canvas..
Of course for the beggar there is no Bandh at all.
Without any political overviews or influence I am apolitical by nature but yes..
I support the Bandh as the poor Mans suffering the rock spiraling prices is a silent way of eliminating him completely..driving him away from Mumbai..making it only the rich mans paradise.
I left this post incomplete and ran down as I saw BJP protesters running beneath my house to shoot the events..arrest of Advocate Ashish Shelar BJP leader and I walked towards the Sea Link to shoot protesters burning tyres and shouting slogans.

Democracy in Venezuela is about to die, It has slowly been eroded for 9 years by a government that was elected by popular vote. But has systematically concentrated power on the president and discriminated opposers.
In Venezuela you can no longer think differently from the official view.
Those of us who oppose the regime are criminalized, many journalists have had to go on exile, there are political prisoners that have been for years in trails or processes that don’t go anywhere, some opposition political figures are in liberty but under constant harassment by the executive and judicial. Anyone who opposes can expect insults and defamation by the highest government officials and violence from its followers.
But the Venezuelan democracy will die on December 2, if a proposed constitutional reform is approved.
President Hugo Chavez, has design a constitutional reform that will modify 69 articles of the current constitution. A reform that is unconstitutional itself, because it changes the basic principles of the constitution and the definition of the Venezuelan State, which is in direct violation of itself, according to it modification of basic principles can’t be modified with a reform (Art 342), a Constitutional Assembly has to be convoked instead, to make a new constitution via vote.
The illegitimacy of the reform, if approved, is far from the only concern. The state will be defined as Socialist, and the exercise of the means of democratic participation like vote and participation on public office will have to be for the construction of socialism, making illegitimate any action by people of different political views, destroying political pluralism. In violation of the Human Rights (proposed art. 16, 70) (Violation of the art. 21 and 32 of the Universal Declaration of Human Rights), and Chavez could reelect himself indefinitely.

This is the western side of the ridgeline I mentioned in my last post. It’s easier to hike but you don’t get the beautiful views of the other side. My next couple of post will give you a couple of samples of the eastern view. Also in my last post I mentioned that my daughter gifted me a pair of cargo pants. She also bought me a Coolmax T Shirt, both from Duluth Trading Co, the pants are Dry on the Fly Cargo Pants. I have to hand to Duluth; they make quality clothing and I highly recommend them.
Now for the title; as with all my post I tell the truth and with many it’s hard to except. My attempt is not to offend the general public and I know I can be; well lest say, more than just a bit cynical. In my defense and that of every Targeted Individual; you see the worst in people every day. The lowest forms of humanity will crawl out from Under Rocks; to harass, torment, psychologically mess with your head, discredit and defame you. And, with each post I receive retaliation as I did today, but I will not let it detour me from exposing the truth.

The phenomenal world, the world inhabited by common people.
Borobudur’s hidden Kamadhatu level consists of 160 reliefs depicting scenes of Karmawibhangga Sutra, the law of cause and effect. Illustrating the human behavior of desire, the reliefs depict robbing, killing, rape, torture and defamation.
A corner of the covering base has been permanently removed to allow visitors to see the hidden foot, and some of the reliefs. Photography of the entire collection of 160 reliefs is displayed at the Borobudur Museum which is within the Borobudur Archaeological Park.
Here's another time when my rights as a photographer has come to mind. Is it legal for me to photograph people on a public beach?
I saw this lovely woman on the beach doing yoga poses and wondered if I was allowed to photograph her without asking.
In this pose she is just about to get soaked!!!! :)
Here's a breakdown...
You can photograph someone on the street, and sell the photograph in a studio or gallery, or anywhere else without a release. Editorial use, publishing as part of a written work, is also permitted without a release, as in magazines, and on the internet.
What are your rights as a Photographer?
If confronted, know that you may not be detained, harassed, be forced to delete images, or have your equipment taken from you without it being a violation of your civil liberties. Anyone doing so may be subject to criminal and civil prosecution.
Law enforcement is not allowed to force you to delete your images, or confiscate your equipment without a court order or warrant, (unless you are being arrested).
Private citizens may not harass you, or touch you or your equipment without the risk of being charged with assault.
When is it not Legal?
When you are trespassing on private property. You may however, stand in a public place, and photograph a private one.
In a public restroom or dressing room.
Of a person through the windows of their own home.
Where there are "No Photography" signs, taking photos is not illegal, but may be considered 'tresspassing'.
Where National Security may be at stake, and photography is forbidden by law.
Where your images are used to libel, defame, or slander another.
Where your image is of a copyrighted image, design, or logo, and used for monetary gain.
And according to the American Law Institute:
"One who gives publicity to a matter concerning the private life of another is subject to liability to the other for invasion of his privacy, if the matter publicized is of a kind that
A) would be highly offensive to a reasonable person.
B) is not of legitimate concern to the public.

I have posted a picture of this Church before but not from this distance, I was trying landscapes with an interest in the distance.
The origins of Preston are not known. In 1086 the village was recorded in the Domesday Book as Prestetune. At this time it was a possession of St Augustine’s Abbey in Canterbury. Preston means priest’s farmstead or Manor. Preston’s original church was probably Saxon. The present Church was built in the 13th Century. Some of the stained glass in the North Chapel dates from the 14th Century. The Church is dedicated to St. Mildred, Patron saint of the Isle of Thanet, who was Abbess of Minster in the 8th Century.
The Parish records for 1560-1615 contain instances of drunkenness, verbal abuse and working on the Sabbath. This was partly due to neglect on the part of the Church. Vicars were sometimes absent; services were performed improperly or not at all; the church and vicarage were in a state of disrepair. By 1604 the churchyard fence had collapsed, allowing horses, cattle and pigs to “defame the graves of the Christians there buried”.
Later the religious aspect of village life was better served. A will of 1711 left a fine new house as a vicarage on the condition that 2 services were preached every Sunday. A congregational Chapel was founded in 1825 following prayer meetings at Preston Court the Squires house.
St. Mildred’s Church was renovated in 1856, and the dormer windows which are a novel feature date from this time.

Not many living organisms around to photograph this time a year for macro so the 75-300 comes out to play when I need to escape.
Things are not great for me atm. Ive been hurt too many times I think. I grabbed milk in woolworths shopping centre the other day and the expiry date had my child CJ's Birth day as the expiry. I lost it. I had to get out of there in a big hurry as i could not hold my emotions or tears back. Police corruption and corruption in other areas needs to stop. And laws seriously need to be changed. It is too easy for a nasty Mother to alienate and defame a Loving Dad.

Because of the harassment, and defamation that I'm being subjected these days, and the doubts that have arisen in "friends" ( I believed so), and now many of them have believed the lies and atrocities that have poured on me this miserable stalker, fails to enjoy your photos and compositions until my complaint that I did to the abuse department of Flickr (www.flickr.com/abuse/) can give me a solution to my problem.

Kapparot is a ritual that is performed towards the feast YOM KIPUR (Day of Atonement) by some Ultra-Orthodox Jews. During the ritual, a hen is swung over the head of the person, while (s)he is blessing: “This is my exchange, this is my substitute, this is my atonement. This hen will go to its death, while I will enter and proceed to a good long life and to peace”.
Then the hen is slaughtered.
Many object the ritual as ‘non-human’.
Personally, I think it is the easy way out:
I am afraid that the fortune of all the hens in the agricultural industry (in IL) is very bad, and non-human.
However, in IL there is almost only one consensus: to defame the Ultra-Orthodox Jews (when it is justified, and when it is hypocritical)
