number of students from oppressed and backward communities. The admission process in DU invariably spills over into the teaching period. Introduction of the semester system means that students will have to face exams within a few weeks of admissions. The result will be that students from weaker backgrounds will be eliminated even before they have a chance to learn the ropes. .

Teachers have observed that the course content in the Science courses has in fact been truncated to fit the semester format, sacrificing inter-disciplinarity and compromising on core areas. This will mean that such courses, pruned of quality and content to fit the semester system, will leave students ill-equipped and under-qualified. .

World Bank Pulling the Strings... .

The worst aspect of the official response to the teachers struggle against semester system has been the crackdown on democracy and the elimination of teachers role in decision-making. Teachers have expressed legitimate concerns and questions about the fate of students from deprived backgrounds; about ill-thought out revisions of course content to fit semesters; and about unviable evaluation systems and the resulting impact on the University system. Why are these legitimate concerns and questions being bulldozed? Why are teachers being branded as truants who have no concern for students welfare and academic standards? Why has every decision-making structure of the University been bypassed so as to deny teachers any democratic space for dissent or questioning? Finally, why has the High Court been approached to settle a debate over the functioning of the University, and why has the HC set a dangerous precedent by outlawing teachers right to protest? .

It would be wrong to see this concerted crackdown on democratic decision-making and teachers voices as unconnected to the larger political project of privatisation of which the semester system in DU is part and parcel. A closer look reveals that this crackdown, this contempt for teachers elected representation and collective opinion, is not the whim of a particular VCs regime it is scripted by the World Bank with the blessings of the current Prime Minister himself! .

A Report of a World Bank Task Force on Higher Education in Developing Countries, February 2000, of which the present PM Manmohan Singh was a member, expressed its discomfort with elected leaders in academic decision-making, recommending instead that appointed leaders would be more open to neoliberal reforms in the following words: .

Election of academic leaders is common in many universities across the world, although it often results in weak leadership and a consequent prejudice in favor of the status quo. Appointed leaders, meanwhile, are less likely to allow their programs to be stalled by lack of consensus and are better placed to make unpopular decisions when required.... On the whole, it is in favour of strengthening appointing powers within university administrations, in order to allow strong leaders to emerge. .

The attitude of the political rulers towards the role of teachers unions can be gauged from these words of Planning Commission Vice Chairman Montek Singh Ahluwalia (who along with Manmohan Singh are architects of liberalisation-privatisation-globalisation in India): Unionisation in higher education personnel is a major impediment... -(Planning Commission Vice Chairman Montek Singh Ahluwalia, Walk the Talk, Indian Express, December 4, 2006) .

Nor are Congress-led Governments alone in toeing the World Bank line. In April 2000, a few months after the World Bank Task Force Report on higher education was released, the Birla-Ambani Committee appointed by then Prime Minister from the BJP, Atal Bihari Vajpayee, submitted their Report on Policy Framework for Reforms in Higher Education. The Birla Ambani report echoed the World Banks .

were invited to speak. Deans and Chairpersons from various schools/centres were also invited to participate in.

the discussion. For the first time in JNU, such an effort to democratize academics has been taken up..

.

Expanding the scope of financial assistance: At the AC meeting held on 19th March 2012, JNUSU forcefully.

argued for increasing the MCM scholarship amount, which is currently Rs 1500 per month. The administration.

has in principle agreed to do so as soon as JNU receives funds under the 12th plan. The administration was.

also forced to agree in principle to enhance the time period of the UGC non-net scholarship, to cover the entire.

period of research and has incorporated the same in the 12th plan proposals sent to the UGC..

.

Speeding up and Democratization of hostel allotment criteria: After JNUSU's repeated interventions, OBC.

students and general category students are now allotted hostels simultaneously. Also, SC/ST/PH students are.

now allotted hostel accommodation within a day of applying..

.

Updating of quartile lists and expansion of scope of recognition of madarsa certificates: After the JNUSU-.

led movement in March 2012, the JNU administration has agreed to set up a committee to update quartile lists,.

and include more backward districts to ensure more social inclusion. Moreover, the administration also agreed to.

reactivate the equivalence committee for recognizing more madarsas..

.

Barrier-free JNU, and more facilities for PH/VH students: In JNU, we have for long been fighting for more.

rights and facilities for PH/VH students. This issue was also raised by JNUSU during the 19th March 2012 AC.

meeting. JNU has now received huge funds towards making JNU a barrier free campus, by improving.

infrastructure, constructing appropriate facilities in hostels and in the academic premises. A committee, with.

representation from the visually handicapped and physically handicapped students' forum, as well as JNUSU,.

has been constituted to oversee the implementation of this project. Regarding the problem posed by dogs in the.

campus, when the VH students launched a struggle, JNUSU extended full support. Together with the VH.

students' forum, JNUSU pressurized the administration to take holistic steps to handle the situation. Moreover,.

following a JNUSU-led movement, the existing readers' and escorts' allowance for PH/VH students has.

been increased to Rs 2000 per month..

.

Strengthening GSCASH: For the first time in the history of JNU, an institutionalized mechanism to introduce.

new students to GSCASH and JNU's gender-sensitive ethos has been put in place. Following JNUSU's.

interventions, mandatory gender sensitization and orientation classes were introduced from this year, where.

various issues related to sexual harassment and gender were discussed..

.

Steps for Academic Rejuvenation: JNUSU organised school-level brainstorming sessions with students and.

faculty, towards a broad academic rejuvenation in JNU. Before the BoS meetings, these brainstorming sessions.

created a platform where common students (not just elected representatives) and faculty members could.

discuss serious academic issues in a transparent, non-hierarchical, democratic manner. A broad consensus was.

built on various issues like the need to introduce new courses, reasons for high drop-out rates, and the need to.

democratise the classroom atmosphere. As a result, when JNUSU Councillors brought up these issues in the.

BoS meetings, they were supported by large number of faculty members, who saw merit in the students'.

arguments and demands. As a consequence, several new courses are in the process of being introduced..

.

Vigilance in the Admission process: As a result of JNUSU's timely interventions, the JNU administration.

released second lists this year, in order to fulfill reservations and the intake mandated by JNU's Academic.

Council..

.

Fighting Administrative High-handedness: JNUSU also repeatedly intervened and protested against the.

authoritarian behavior of various hostel wardens in Yamuna, Koyna and Shipra and in a united struggle with the.

residents of Yamuna forced the removal of the Yamuna hostel warden..

.

Ensuring workers' rights: From 2006 onwards, the JNUSU has been consistently fighting for workers' rights in.

the campus. During this tenure too, time and again JNUSU had to intervene to ensure a variety of demands. 16.

safai karamcharis working with Garima were terminated by the administration; JNUSU immediately intervened.

and ensured that all of them were taken back. Moreover, JNUSU had to repeatedly intervene to ensure that.

arrears due to workers (from salary increments announced in April 2011 and November 2011) were paid to.

them. Contractors had been dilly-dallying these payments for months together, and JNUSU finally managed to.

ensure workers' arrears only a couple of months back. JNUSU has also raised the issue of legally mandated.

ESI/PF payments for all workers employed in JNU..

Today is the 3ro day of the indefinite hunger strike which JNUSU has launched since Saturday night against several .

anomalies in JNU's admission process, particularly non-fulfilment of OBC. PH, SC/ST quota and the increased seat intake. .

From the very beginning of the admission process, JNUSU and the student community have engaged in a prolonged battle .

.

with the JNU administration to ensure that correct norms are observed and OBC reservation and seat increase is duly done. .

JNUSU congratulates the student community for their spirited participation in yesterday's protest demonstration during the .

meeting of the Standing committee on udmissions and for ensuring a successful nash strike today against continuing .

.

administrative anomalies. .

During the meeting, JNUSU strongly demanded thZit the mandated increased seat intake at the various centres be fully .

But on the critical issue of filling the OBC quota. t11e administration showed its casteist colour once again in sp'te of .

being completely :xposed both in terms of law and logic by JNUSU JNUSU argued that the signific~nt shortfall in the .

.

OBC intake this year is because of the completely erroneous and legally untenable methodology that the JNU .

administration has adopted in fixing the stipulated relaxation in cut-off for the OBC students. JNUSU maintains .

that the central question today in resolving the non-fulfilment of the OBC quota lies in correcting the dubious and casteist urgent for the students and teachers on this campus to speak up with firm clarity on this, and not let the administration have.

yardstick of the administration, which if unaddressed, will never let the OBC quota be filled in this campus. It is JNUSU has already submitted a detailed note both to the administration as well as the UGC for .

its casteist ways. .

immediate course correction. .

Let us summarise the basic points below: .

.

The Office Memorandum of MHRD dated 20 April, 2008 on the modalities of Implementation of the OBC Reservation Act.

.. offers the following guidelines ( para (X) and (XI) with respect to the relaxation and application of Cut-off Rules for OBC .

.

reservation:.

.. .

"Each CEJ is also authorized to fix cut off marks for admission/selection through admission test, etc. for the OBC candidates with .

such differential from the cut off marks for the unreserved category as each institution may deem appropriate for maintaining the standards of education and at the same time ensuring that sufficient number of OBC candidates are available in keeping wilh the directions/observations of the Hon'ble Supreme Court of India 10 this regard. This authorization by the centra! .

1.

Government to the CEis to fix the cut off marks in the compliance w1th the Apex Courts direction asking The Central Government to .

' .

examine the feasibility of determining such cut-off marks. The Central Government believes that each CEI would ensure that the directions/ .

.

observations of the Hon'ble Court are followed.' .

·eEls which are in process of conducting admission tests may decide on the cut-off marks for the OBC category well in time, so .

.

that consistent with the standards of the education of the CEis, sufficient number of eligible OBC candidates are .

.

available for selection on the basis of jnter-se merit against the reserve seats. Such institutions may also obtain information .

pertaining to the background of students who may have indicated as belonging to the OBC category in the application form, so as to identify .

.

those belonging to the 'creamy layer' from among them for exclusion from the counseling/ interview/ group discussions/ offer of admis-.

.

sions." In light of this. a correct admission and reservation process in JNU should be along the following line: According to the Act and the Directive, the university must fix "cut-off marks" for both unreserved and OBC candidates .

well in time. The stated cut-off marks is supposed to "maintain the standards of education" in a particular institution and is .

a pre-decided policy parameter on which it evaluates whether students fit the standards of the Institute or not. The cut-off is not based on the performance of a particular batch of entrance-seekers. In JNU, for the unreserved candidates the .

existing bench-mark, the cut off is 40. a maximum relaxation of 10 points can be given to an Secondly, as per the directions of Honourable Supreme Court -.

OBC candidate with regard to the un-reserved candidates as a differential. This means that the OBC candidate can get at the most 10 marks less than an unreserved candidate. Accordingly, in JNU, the "cut-off mark" for OBC candidates .

follow. .

An even more explicit articulation of where to apply the cut-off can be seen in the statement of Justices Pasayat and Thakkar. Para 139 (3] of their statement reads: .

"The Central Government shall examine as to the desirability of fixing. a cut ~ff ~arks in ~es~ect of the candidates belonging to the Other Backward Classes [OBCs]. By way of l.ll~stratlo~· It·~~-~ b~~~~~c~~=~dt~~~.

This would ensure that quality an~ merit would not suffer. ~~ a~y seats remain vacant after adopting such norms they shall be filled up by candidates from general categones. h t th · 'ty's position .

I.

JNUSU holds that these evidence leave no scope for ambiguity, and demonstrate clear Y t a e un1vers1 on defining the cut-off as fluctuating from year to year and based on the performance of general category students of a particular batch, is not only illogical but legally untenable in every way. .

n spite of the fact that JNUSU has repeatedly pointed out and argued this matter in numerous representations, JNU administration has provided no explanation for this willful violation of MHRD guidelines. Non-fulfillment of OBC seats last year was a direct outcome of this willful anomaly that led to non-availability of "eligible" OBC candidates in many courses. Such deliberate subversion of reservation process is not acceptable and must be corrected without delay. .

On the Prospectus Fee-Hike and Moves of commercialization of services: .

The administration has increased the cost of JNU admission prospectus claiming that it does not have funds for conducting the JNU Entrance Exam. However, according to the administration's own records, the money it collected through selling of the prospectus even last year was far above the amount it required for conducting the Entrance Exam . Therefore, this argument of "shortage of funds" does not hold any water. The BPL waiver is simply tokenism for it amounted to 100% subsidy for 0% applicants; it cannot compensate or counterbalance the damage that the increased prospectus fees have inflicted. Firstly, the fees hike has damaged the basic ethical premise that universities or admission processes cannot be run like commercial and profiteering ventures. Secondly, through higher prices, it has discouraged and actually squeezed out those in the social ladder who are struggling against odds to begin to equip themselves with an education, and aspire to come for higher education. Therefore, we would like to .

submit: that our concerns should not be reduced to a "struggle for Rs 80/-". What we are struggling to retain is the basic ethics on which a higher education institution like JNU will function: will JNU continue to be socially-inclusive and accessible, or will JNU be run like a commercial enterprise based on crude considerations of amassing profit? .

Similarly all attempts at commercialisation of services as reflected through installation of electric meters in new Koyena hostel must be done away with. .

'!Ve believe that a fees hike and commercialisation moves will go against JNU's long established traditions of opening 1ts doors to students from all sections of society, including poor students and students from deprived backgrounds. .

Closing down of all forms of dialogue: .

The committees headed by Rupamanjari Gh h d Ad 't M · .

It is matter of great concern and in fact shame that in a University like JNU which is known primarily for its commit-ment to social justice, OBC reservations are being scuttled in a systematic manner by the JNU administration. For the past one year, JNUSU has been pointing out that the criteria that the JNU administration is adopting for setting cut-off marks for OBC candidates is casteist, faulty and structurally designed to ensure that mandated OBC seats will never be filled. Moreover, the administrations craftily designed criteria are violative of various Supreme Court verdicts and MHRDs explicit directives on the mode of implementation of the OBC Reservation Act. .

In a clearly illegal manner, the JNU administration sets the cut-off mark for OBC candidates by giving them a 10-mark relaxation from the mark of last general category student. In other words, the administration expects the entire OBC quota of 27% to be filled in this narrow band of 10 marks. By thus reducing the pool of eligible OBC candidates available for admission through this criteria, the JNU administration is claiming that there are no eligible candidates. JNU is ready in principle to admit students from the General Category even at 40 marks if seats are available. How come then that an OBC candidate with marks way above 40 is considered ineligible in the OBC category seats even if seats are going vacant? Isnt this an example of blatant double standards? If this is not casteism and discrimination, then what is? .

What JNU administration is essentially doing is killing the very idea of reservations. Through setting the cut-off marks for OBC candidates in this manner by unfairly tying their selection to the performance of the general category students, the administration has converted reservation into open competition between the OBC candidates to achieve marks within a small range decided by the performance of general category candidates. Unless this serious anomaly is cor-rected, OBC reservations will never be fulfilled in this University, making a complete and shameful mockery of JNUs concern for social justice. .

Last year, after 13 days Indefinite Hunger Strike by JNUSU on this issue, JNU administration formed a Committee under Prof. Aditya Mukherjee to examine the issue. However, all that the committee did was to put a seal of approval on JNU administrations devious tactics, not only by denying JNUSU any representation under the pretext of stay on JNUSU elections but also stonewalling all our reasoned arguments innumerable times. The present JNU administration has indeed created new records of making mockery of any logical dialogue, written agreements-now it is hell bent on trivialising and violating even the law of the land on implementing reservation, to serve its brazen reactionary agenda. .

Given the nature of challenges and anomalies in the proper implementation of OBC reservation in JNU, a concerted intervention from various corners of the JNU community is the need of the hour. Those committed to social justice will have to build a wide-ranging consensus in JNU to recognize this central stumbling block to the implementation of OBC reservations. Only well concerted efforts can rectify the discrepancies in implementation of the reservation, caused by the deliberate misinterpretation of MHRD directives by the JNU administration. .

In this regard, JNUSU is organising a symposium on Examining JNUs Admission Process With Regard to Implemen-tation of OBC Reservation: WHY do OBC Seats Remain Unfulfilled? WHAT Must Be Done? with Centre Chairpersons and Faculty Members and JNUTA at the SSS II Committee Room at 2.30 p.m. on 3rd August. We appeal to the student community to participate in this symposium along with faculty members to ensure that immediate steps are taken for .

course correction. .

1. The CHS far;ulty had several rounds of discussions around the proposed modificaticr s in JNU admission policy. Fresh discussions on matters relating to policy always imply a review of experiences of the past. Some members of the faculty were of the opinion that the data provided to the Centres related only to the intake of students and not to the nature of their academic perfonnanc'! over the semesters, at all levels of academic programmes of the university. Since any meaningful discussion on policy matters should consider the question of optimum $ .

utilization of scarce resources, dala on academic performance must form a part of an exercise of this kind. ' .

2. From the data provided to the Centres, it appears that by and large, JNU has been able to fulfil satisfactorily its commitment to the statutory provisions regarding reservation. Discussions on the question threw up several opinions: (a) It was generally fel t that reservation beyond statutory requirements is a contentious issue and creates space of a dubious nature in which lobbyists of different interest groups are likely to fight perpetually for pushing through their OW ll agenda. (b) It was also felt that enlargement of scope for reservation is an iss ue, which cannot be discussed wiil10ut ref-;rencc to Ji lT~t eni kvds of eUu.;ation. Whereas positive re~tll1s will accrue by enlarging the bases of primary and .

secondary c Jucation, blanket reservation at an institution like JNU may be counter},roduc,iw and actually detrimental to tbc achievement of desired results. (c) In any case, the policy of reservation could not be discussed without data regardin g the academic performance of students admitted under JNU's special provisions. (d) It was also felt that the .o .

question of caste reservation should be separated, from the issue of support to the economically deprived students. While space may be made available fdr · students from economically backward sections cutting across castes and communities, in view of the widespread misuse of the criterion of ·economic deprivation in the past, JNU should learn from .

experience and strive towards identi fy ing deserving students from genuinely poor families. (e) It was suggested 1hat there should be many more scholarships and freeships f·x poor and deservin g students .
