The Murphy Report is the brief name of the report of an investigation conducted by government of Ireland into the Sexual abuse scandal in the Catholic archdiocese of Dublin. It was released in 2009, a few months after the report of the Commission to Inquire into Child Abuse (Ryan Report) chaired by Seán Ryan, a similar inquiry which dealt with abuses in industrial schools controlled by Roman Catholic religious institutes.

 

In October 2002, the television programme Prime Time broadcast a special report entitled Cardinal Secrets containing accounts of children abused by Catholic priests serving in the Archdiocese of Dublin, where complaints had been made at higher levels and effectively ignored, both by the church and by the national police force, the Garda Síochána (colloquially referred to as the "Garda" or the "gardaí", the latter word meaning "policemen"). This publicity led to the passage of the "Commission of Investigation Act 2004" mandating the establishment of a "Commission of Investigation, Dublin Archdiocese" to examine the manner in which allegations of sexual abuse of children by priests over the period 1975 to 2004 were dealt with by Church and State authorities. This act was implemented in March 2006. The Commission of Investigation has been headed by Judge Yvonne Murphy, a Circuit Court judge. The original brief was to report in 18 months, but such was the volume of evidence and allegations concerning the abusive behaviour of a sample batch of just 46 priests that time extensions had to be allowed.

Today was a busy day for Mingle Media TV’s Red Carpet Report Team. While at Hollywood and Highland to pick up their official media credentials for the Oscars, they stopped by the Hollywood Chamber of Commerce Awards Information Media Center who were hosting the 10th Annual Awards Media Center with Co-host L’Oreal Paris.

 

At this special event, the media attending were treated to the "hot dog to the stars” from Pink’s Hot Dogs, Hansen’s Water and Coconut Water, Village Pizzeria had bite size goodies and L’Oréal Paris had a great gift bag and a professional make-up artist on hand offering ttips on creating a glamorous red-carpet look.

 

While the RCR team were at the TCL Chinese Theatre they got to see first hand, the unveiling of the Anne Hathaway wax figure which was the second of twelve figures that the world famous Madame Tussauds Hollywood plans to unveil this year. You’ll be surprised to learn it too took 20 artists three months to create and only cost $300,000. Look closely at the figure - it captures Anne’s smile… or so we’re told. Tell us what you think.

This is not a story about terrorism or war (although the title was crafted for readers to infer that). This is about the everyday things that happen at the Israel-Gaza border that don’t make world headlines.

 

Just because activity at the border does not make world headlines, doesn’t mean it is not important. In fact, what happens there is very important. Some of it is eye-opening. Read on to learn what really happens every day at the Israel-Gaza border. To help envision what happens we will be using information from last month’s (December 2012) report issued by Israel’s official Coordination of Government Activities in the Territories (COGA).

 

Let’s get the big picture first. During the month of December, 6,298 truckloads of merchandise passed through the Kerem Shalom Crossing and into Gaza. If the crossing was open every day during December, which is probably was not, that’s an average of 203 trucks entering Gaza every day. Anyone familiar with logistics will understand that the majority of those trucks are trying to get through at the same time, which creates massive traffic jams. Border crossing are a lot like airports – jam packed when the flights are arriving and passengers are making connections; as quite as a church on Monday morning after the fights have taken off.

 

Here is what comprised those truckloads:

 

- 58 truckloads of agricultural inputs, e.g., seeds and fertilizer

- 132 truckloads of clothing and shoes

- 186 truckloads of electrical products

- 406 truckloads of ceramics and plumbing products

- 1,392 truckloads of food

- 2,511 truckloads of construction materials

 

If you are particularly astute, you may have already noticed that those numbers don’t add up to 6,298. That is partially due to some items, like cooking gas, not being measured in truckloads, but in tons. 3,131 tons of cooking oil were delivered across the border during the month. Almost 88% of all the goods being transferred into Gaza were from the private sector. The balance was humanitarian aid from international organizations.

 

In addition to the truck traffic, Israel issued over 3,600 permits for persons wishing to exit the Strip. Over 2,000 of those permits were for businessmen, plus more than 1,600 for persons and their companions seeking medical treatment, 85 permits to attend weddings, funerals, or other family events, and 67 permits for employees of international organizations.

 

You can see that the Israel-Gaza border is a busy place in times of peace as well as in times of conflict. Somehow the world at large seems to believe that the Israeli government has held the people in Gaza hostage. The reality is quite to the contrary. In light of the recurring hostilities directed from Gaza towards Israel, the government had no choice but to secure the border to help protect people living on either side. Even during the eight days of conflict in November 2012 one of Israel’s priorities was to keep the crossing secure so that food and other supplies could reach their intended destination.

 

Israel continually demonstrates a firm resolve to protect its citizens and its territory while trying to live in peace. They are not out to get anybody, but they reserve the right to protect what is theirs. It is not only legal to do so, it is a moral obligation. Peace is a hard thing to protect, so we are committed to praying for the peace of Jerusalem (Psalm 122:6). Will you join with us?

In 2010, the Centers for Disease Control and Prevention (CDC) reported that nationwide about 123,600 nursing home residents were sent to an emergency room within a 90-day period for injuries they sustained while residing in nursing homes. This staggering statistic reveals a serious problem with American nursing homes. According to the CDC report, an incredible 40 percent of those ER visits were completely preventable.

 

So, who pays for these nursing home mistakes? Well, in most cases, taxpayers end up footing the bill through Medicare payments. The New York Times did a report on this issue back in 2015, which revealed just how serious this problem is. Experienced nursing home injury lawyers know this problem all too well, because it is a common subject that comes up during lawsuits against southern Illinois nursing homes that try to avoid liability for injuries to residents.

 

Medicare Payments for Nursing Home Injuries

 

Remarkably, about 22 percent of nursing home residents who stayed in a facility for 35 days or less suffered an injury due to medical malpractice at the nursing home. An additional 11 percent of these Medicare beneficiary nursing home residents experienced temporary injuries at nursing homes.

 

The cost to Medicare is enormous. In a 2014 report by the U.S. Department of Health and Human Services, the Inspector General discovered that Medicare paid approximately $2.8 billion (with a capital “B”) paying for injuries caused by nursing homes in 2011 alone. While more recent numbers are not available, given the increased cost of care, one can only assume that this number is skyrocketing.

 

Why is Medicare Paying for Nursing Homes’ Mistakes?

 

It’s all about greed – plain and simple. The majority of Illinois nursing homes today are owned and operated by private corporations. Unlike most southern Illinois hospitals, they are not non-profits. Nursing homes have four ways to get paid for care:

 

Long-term care insurance. Residents with long-term care insurance are rare. But these insurance policies are limited to about 1 or 2 years of payments. They also do not pay the full cost in most instances.

 

Private Pay. This is pretty straightforward. Some patients with the means to pay cash simply pay the full “rack rate” for nursing home care. These are a dream for nursing homes, but these types of residents are a tiny fraction of all patients in rural communities. Most cannot afford the nearly $8,000 average cost per month.

 

Medicaid. Illinois Medicaid is the primary payor for the vast majority of nursing home residents. When people age and require skilled nursing services, they usually spend their money until they qualify for Medicaid. Then the state takes over paying the bill, but at a much lower rate. In most cases, Medicaid pays about 15-20 percent of the total cost, if that. As one might imagine, this is not ideal for nursing home corporations.

 

Medicare. As DHHS revealed in the 2014 report, Medicare pays about 84 percent more than Medicaid. That’s a huge difference in revenue. But Medicare is not designed to pay for long-term stays. In fact, Medicare only pays for the first 100 days (with gradually declining rates), but it only pays if all the following conditions apply.

 

Conditions Required for Medicare to Pay

 

Medicare Part A is available to all Americans who have reached 65 without charge. But Part A coverage has strict limitations and requirements:

 

It only covers up to 100 days of nursing home care per event

 

The Medicare beneficiary must go to the nursing home within 30 days of hospitalization

 

The hospitalization must have lasted at least 3 days (not counting the date of discharge), so outpatient does not count

 

The nursing home care must be directly related to the reason for hospitalization

 

The care received in the nursing home must not be available in-home, and it must be delivered per the orders of a physician (MD), physician’s assistant (PA), or nurse practitioner, and the care must be provided on a daily basis

 

Once the nursing home or a licensed physician determines that the resident is unlikely to recover or will need longer admission, Medicare stops

 

If at any point it becomes clear the resident will not be able to return home within 30 days, Medicare will stop

 

Where Things Typically Go Wrong

 

The Center for Medicare Advocacy reported that from 2003 to 2008, staffing problems remained one of the biggest reasons for nursing home injuries. Here’s how this plays out in many cases.

 

A resident is admitted to a nursing home for a chronic medical condition, following a lengthy hospitalization or surgery. Upon admission, the nursing home begins receiving Medicare dollars at first, then upon Medicare stopping payments, Medicaid kicks in. At some point during the nursing home admission, the resident suffers a serious injury. They are transferred to a hospital for treatment, where Medicare then begins paying for this “new event or illness.” The resident receives treatment that is paid for by Medicare, and then returns to the nursing home for long-term care, again temporarily being paid for by Medicare until Medicaid kicks in again. As you can see, each time the resident is injured, the nursing home actually profits!

 

Disproportionate Impact on Rural Illinois Communities

 

In rural parts of central and southern Illinois, the effects of this systemic problem can be felt in a very real way. The majority of small community hospitals in Illinois are nonprofits that operate on lean budgets. Further, Medicaid patients make up the lion’s share of revenue for these hospitals. When low-income patients are repeatedly treated for nursing home injuries, these hospitals bill Medicare for treatment. However, Medicare also has a policy of not paying for healthcare-acquired conditions, also known as “never events.”

 

If a resident suffers one of these never events, there’s a good chance Medicare will deny payments. Even if Medicare does pay, it’s often at a significant reduction in typical charges. To put this in perspective, Johns Hopkins University reports that U.S. hospitals spend upwards of $34 billion on fall-related treatment alone in any given year.

 

Common Injuries for Southern Illinois Nursing Home Residents

 

Among the many ways nursing homes can mess up care, there are about 5 primary injuries that cost the most to treat:

 

Falls & Fractures. At Jerome, Lindsay & Salmi, LLP, we regularly fight to hold nursing home companies accountable for their neglect and abuse of southern Illinois seniors. In one rural nursing home, we learned that out of a random selection of 10 patient charts, the State of Illinois discovered 6 of them had experienced a fracture at the facility within the last 30 days. That strongly suggests that in just one small rural nursing home, upwards of 60 percent of residents were suffering from preventable injuries at any given time. The typical hip fracture costs more than $100,000 to treat, and some reports suggest that as many as 20 percent of all seniors with a fractured hip die within a year of suffering their injuries.

 

Bedsores & Wounds. Medicare considers preventable wounds and pressure ulcers (aka bedsores) to be a “never event,” meaning they should never occur in a healthcare environment. But many nursing home residents throughout our region suffer from painful, disfiguring and life-threatening skin ulcers, most of which are due to poor hygiene, lack of staffing, and a general disregard for proper patient care.

 

Infections. Some infections are due to known medical conditions, while many others are acquired in the facility because of poor hygiene and bad infection control procedures. Nurses who are not trained or properly supervised may cross-contaminate wounds, not use sterile instruments, or fail to notify physicians of signs and symptoms until it’s too late.

 

Medication Errors. Sadly, medication errors are extremely common. Many family members never even find out that their loved one died from a medication error until years later. Nursing homes have failed to give medications, given the wrong ones to the wrong patients, or overdosed patients. When dealing with already vulnerable and weakened immune systems, it only takes one error to be fatal.

 

Deaths. Ultimately, all humans die. But they should not die prematurely due to failed nursing home care. Likewise, taxpayers and local community hospitals should not bear the burden of paying for the mistakes of wealthy private corporations that are not even located in our region.

 

Who Are Nursing Home Companies?

 

This is perhaps the most startling aspect of the problem. Many people in southern Illinois assume that the local nursing home down the street is owned and operated locally. This is almost never the case. Instead, hundreds of Illinois nursing homes are owned and managed by large corporations outside of the state altogether.

 

One large New York nursing home conglomerate operates dozens of rural facilities throughout our state. In fact, chances are good that if you are reading this from southern Illinois, one of their nursing homes is within an hour of you. Another large corporate nursing home company is located in Bloomington, from where they remotely manage facilities all over downstate. Likewise, a major California corporation runs a lot of facilities in the metro-east St. Louis area.

13 coach loads of police to evict 250 students occupying the Senate Building in 1975

"Nobody could believe it. That in the most obvious comment concerning reaction inside Senate House as the 12 police coaches rolled up along the ring-road.

 

For the previous hour the atmosphere had been decidedly tense. It was, I imagine, like the atmosphere inside a Wembley dressing-room on Cup Final Day. The forced jokes and sick humour were well in evidence

 

A member of the Executive told us to remain cool and calm, and a budding comedian remarked "but don't get collected."

 

Rumour had got round that 30 to 40 police were turning up. The rumour in an ironic way helped the situation inside the building.

 

Various "scouting-parties" had gone out to Fletchamstead Highway Police Station to see how the forces were massing. The last car returned very rapidly, and the driver reported that a small number of coaches, vans and cars were waiting by the rugby ground opposite Canley College.

 

From that point onwards,the occupiers were prepared. Sleeping bags were collected and any doubts about whether this was yet another false alarm were dispelled.

 

The occupiers kept up a constant telephone link with the other occupied building,the telephone exchange. This link proved unnecessary.

 

At 7.30 exactly, a simultaneously eviction of the two buildings took place. As an observer inside the occupation, the general participant feeling was one of incredulity.

 

12 police coaches pulled ceremoniously along the ring road in front of WhitefieIds. Some people laughed, but it was the laughter of people who felt sick in the stomach. We counted the coaches as if we were boxing-match referees, and by 10 we had decided "out".

 

None of the people named in the writ were in occupation when the police came; this was fortunate, as the senior police office who came to the door of the Senate House were looking searchingly into the interior of the building. All they could see were worried students looking out at them!

 

A member of the Executive went out to inform the police of our request for them to wait for five minutes whilst all our possessions were gathered together. In effect, these five minutes were only a token shew of bravado, as everybody had their sleeping bags very ready anyway.

 

So we trooped out, orderly, quietly and with our sense of humour restored. When people realized no arrests were being made, the tension relaxed and the ludicrous ness of the situation began to dawn on the occupiers.

 

This feeling was increased when it was evident that the police were powerless to stop us marching 20 yards into the Arts Centre. The television cameras gave us a further sense of our role as passive participants in a Keystone Kops - style farce.

 

Temporarily we were heroes -and this contrasted to the fears of martyrdom that had been rampant earlier. Even the "hotheads" of earlier in the morning had realized that such a massive show of police "strength" was in our favour, and any retaliation could be suicidal, and not only counter-productive.

 

As the last people left the building, accompanied by police jeers, the police moved in, to presumably check that nobody was laying in hiding for them (they must have been joking).

 

The riot shields were put away, the police remounted their coaches and rode gallantly into the rising sun.

 

The Telephone Exchangers arrived in the Arts Centre with their story. Two coaches turned up and didn't even need to empty as the occupiers, outnumbered 10 to 1 raised the white flag (as opposed to the red and black which had previously been on show) and again left peacefully.

 

And so ended the occupation Pt 1."

Reducing health inequalities is about services working more effectively together. With making every contact count, partners check individuals’ general wellbeing, and alert other partners when additional needs are identified. An example is the fire service conducting safe and well checks during home visits, alerting partners to people’s additional needs.
