Given this situation where the powers-that-be seem hell-bent on selling out our education system, and on denying the basic right to employment, it is high time the students and youth of the country come out on the streets to strengthen the struggle for their rights to education and employment and for an end to corruption. All India Students Association (AISA) and Revolutionary Youth Association (RYA) have drawn up a Charter of Student-Youth Campaign for Employment-Education and Democracy to mobilise students and youths for a country-wide struggle. .

Scrap the current Right to Education law which denies the principle of right to basic education and encourages the privatization and commercialization of education. Bring a new Right to Education bill based on common school system! .

Immediately repeal the Private Universities Bill, Foreign Universities Bill along with all the bills proposed in Parliament by the MHRD, which clear the way for privatization of education and corporate loot. Repeal the recommendations of the Lyngdoh Commission, which are against the principles of democracy and conduct Students Union elections according to democratic procedures on all campuses. .

Make laws at Centre and State levels to regulate and monitor the exorbitant fees structures, admission processes, evaluation processes and administration of all primary to higher educational private and semi-government institutions. In line with the directive of the UGC the University has decided to roll back the FYUP. Consequently the admission process shall be conducted under the scheme of courses that were in force in the academic session 2012-13 in all the colleges of the University of Delhi. .

JNUSU Note : Why Viva marks Must be Reduced .

JNU prides itself on a progressive admissions policy and social justice. but on the ground it is being subverted in many ways. OBC reservations were scuttled for 3 years costing 400 students their futures! Now it has become increasingly evident how across centres and categories, viva-voce marks are being used to exclude and discriminate. .

Open Violation of the Order Of A Constitutional Bench .

Admission to JNU based in two components: a written exam and then a viva. JNU allots a weightage of 30% for viva-voce. But way back in November 1980, a 5-Judge Constitution Bench of the Supreme Court comprising legal luminaries like P.N. Bhagwati, Y.V. Chandrachud (CJI), V.R. Krishnaiyer, Syed Murtaza Fazal Ali, A.D. Koshal) had clearly said, .

We are of the view that, under the existing circumstances, allocation of more than 15% of the total marks for the oral interview would be arbitrary and unreasonable and would be liable to be struck down as constitutionally invalid .

Why then is the JNU Administration continuing with its blatant illegality? .

When Written Is Reduced to a MERE "Qualifier", Viva Becomes the REAL 'Judge'! .

The idea of having two components to the admission process is that BOTH SHOULD HAVE a complementary role in final selection. The problem comes when some people decide that the written is ONLY a qualifying mark and that admission will be determined SOLELY based on performance in the viva. Consequently, we see two kinds of situations in the admissions data, where students (cutting across categories): .

(A) .

Have an average and high performance in the written, but very low marks in the viva. (This pattern is particularly visible for reserved category students.) .

(B) .

Show average or less performance in the written, but very high marks in the viva. .

.

Clearly, the interview is being used to distribute subjective biases and select or reject candidates based on viva-voce alone. .

The Strange Clustering of Marks in Viva .

A careful study of viva marks shows a strange distribution with marks clustered either between 0-5 or in the 25-30 range. In the normal course, it is expected that the majority of the students would get average marks between 10-20 .

first filled. Subsequently, the marks scored in the entrance examination by the last general category student selected is declared as the "cut-off" for the general category. OBC students are then given a relaxation of 10 marks from the mark of the last general category student. For example, if in a particular stream, if there are 10 general category seats and the 10th student gets 67 marks in the entrance test, OBC students scoring below 57 marks will not be admitted by JNU. The entire OBC quota of 27% thus has to be filled within this 10 marks margin (i.e. 57-67). .

This is a clear violation of the MHRD directives on at least three counts: .

In JNU, cut-off marks are not decided "well in advance". .

.

2. .

It is fluctuating from discipline to discipline and year to year based on the empirical performance of different batches of general category students rather than on the university's own standards of education. .

.

3. .

It is unfairly tying the fate of OBC candidates to the fluctuating performance of general category students rather than the university's own standards of education. .

.

.

As a result of these violations of the MHRD directives, the pool of eligible OBC candidates available for admission is drastically reduced. The result is that OBC quota in JNU is going unfulfilled on a large scale on the plea that there are "no eligible candidates". .

This faulty interpretation of the term "cut-off" and the consequent pretext of "non-availability" of "eligible" OBC candidates demands an immediate course correction. Or else, this very important provision of social justice will remain a mockery even in an institution like JNU which is known for its social commitments. .

The Correct Method .

The Supreme Court specifies that a maximum relaxation upto 10 marks from the general category cut-off be given to the OBC candidates so as to fulfill 27% reservation. In JNU, there already exists the rule that 40 (out of 100) is the last mark below which no general category student will be admitted. That is, 40 is the general category qualifying mark for admission in JNU. Also, the existing qualifying mark for SC/ST candidates is 30. .

We are of the opinion that: relaxation of maximum of 10 marks for OBC students, as stipulated by Hon'ble Supreme Court, must start from 40-the qualifying marks for the General Category-and relaxation should go down to maximum of 10 marks till 27% OBC seats are filled. It is possible that all the seats may get filled even before the 10 marks limit is reached. This method will satisfy both the concerns of the Supreme Court and the MHRD directives. There is no question of compromise with quality, as JNU is already ready in principle to admit students from General Category even at 40 marks if seats are available. .

So, it is imperative that JNU stops the misinterpretation of the concept of general category cut-off and implements the correct procedure. It is only with such a procedure can 27% OBC seats can be filled and that should be the objective of the admission process which is sensitive to take care of the concerns of social justice. Clarificatory instructions should be issued to all concerned institutions including JNU to correct their admissions process and ensure 27% OBC reservation. .

Tol Education .

Tols or Chatuspathis, which impart traditional Sanskritic learning, is an important part of our heritage and once upon a time Bengal used to be famous for its Tols and the learning imparted there. Now, suffering from systematic neglect especially for the three and a half decades of Left rule in the state, they are dwindling and need urgent revival. There are still about 700 plus Tols in the state, but unfortunately, the state government pays only the DA to the Tol teachers and not their salary. For the last three decades, there has been no new recruitment to the sanctioned posts of pundits in the Tols. Most of them are at present being run only by government-nominated ad hoc committees and not by full-fledged committees. The annual examinations for the Tols supposed to be conducted by the state government at three levels, has been stopped for the past five years. The last examination was conducted only in 2007. The Convocation which is supposed to be held regularly is also not being held. There is provision for scholarships for meritorious students of the Tols from the state government but these scholarships are not being given and there is no accountability of the money involved either. There is no provision for adequate recognition of the degrees awarded by the Tols after the state-level exams and no vision for employment or higher education facilities for the pass-outs of these traditional and historic institutions. Their degrees are not being recognized as equivalent to the general degrees and are not recognized even in the Employment Exchanges. There are 4 government run Tols in the state out of the 4, the Tol at Sanskrit College, Kolkata has at present only 3 teachers out of a sanctioned strength of 21, the Tol at Cooch Behar Sanskrit College and Nabadwip Sanskrit College has been stopped and their campuses taken over by anti-social elements. The campus of the historic Nabadwip Sanskrit College is alleged to be sold to promoters. Only the Tol at Kanthi Sanskrit College is is a somewhat running condition. We demand that this state of affairs be rectified immediately. Adequate recruitment be conducted in all the 700 plus Tols of the state and the 4 historical government Tols be revived as institutions of excellence. Degrees of Tols be recognized as equivalent to the general degrees and the government take immediate steps to revive the Sanskrit learning, which was the fame of Bengal once upon a time. .

The Left Front had an aversion to Sanskrit and they had stopped the earlier system whereby Sanskrit was compulsory till class X. We feel that this is the reason why Sanskrit studies declined in importance. We demand that the present government reverse this anti-Sanskrit measure of the Left government and make Sanskrit compulsory till the Madhyamik stage. Especially many CBSE/ICSE board schools are charging not only exorbitant fees, but many other hidden charges and are forcing parents to buy merchandise through the school. We feel that the government should exercise control over the fee structure and other hidden charges. A government authorized fee structure for private schools should be promulgated and no institute should be allowed to charge more than that. Many of these problems would be solved if the Right to Education Act, 2009, was implemented in full. The progressive provisions of the Act like transparent admission process, reservation of seats for economically deprived children should be immediately implemented in order to act as a check of rampant commercialization and other arbitrary terms and conditions imposed by some so-called elite private schools. .

Higher Education .

The main problem facing the general higher education sector is again lack of infrastructure and restoration of the academic atmosphere after decades of politicization. At present there are 13 general state universities and 456 general degree colleges, according to the last published report on higher education, 2012-13. Foundation stones have been laid for a few more, though without the adequate infrastructure. Out of the 456 colleges, there are 20 government colleges though again a few more have been announced. The total undergraduate student strength of the state including all streams, according to 2010-11 and 2012-13 figures are 1066148 and 1225751 and the postgraduate student strength are 95097 and 94930 respectively. This indicates that the enrollment in PG courses has declined. This shows that due to poor quality including infrastructure the students are preferring to go to other states or pursue some other career options. As per the 2012-13 annual report of the department of higher education there are 81 post graduate colleges in the state and out of this only 22 are government postgraduate colleges and among this there is not a single college in rural areas. It is thus obvious that in a highly populous state like West Bengal, this physical infrastructure is hardly enough and we need a rapid expansion of colleges and universities. The present government has taken some steps in this regard. But, what is lacking is a similar concern with quality of education imparted. New colleges and universities are being announced and even started, without regard to proper physical infrastructure, recruitment of teachers, laboratory facilities, etc. Adequate amounts are not being sanctioned to meet these needs. Existing institutions are also allowed to open new courses without reference to the infrastructure necessary. Intake capacity of the colleges and courses are being violated with impunity. No inspections by university expert committees are taking place for increasing seats in lab-based subjects which is a must under the norms. Colleges are being allowed to open PG courses even without the requisite infrastructure. In many colleges, all of the students given admission cannot be housed in the classrooms and so non-attendance is condoned and actively encouraged by the college authorities. Due to huge admission of students, in many colleges classes are not held specially in the general pass courses thus reducing the system actually to a farce. Recently, new universities have been started namely Gaur Banga, WBSU in Barasat, Sidho-Kanho in Purulia,etc. without ensuring all .

So, it is imperative that JNU stops the misinterpretation of the concept of general category "cut-off" and implements the correct procedure. It is only with such a procedure can 27% OBC seats can be filled and that should be the objective of the admission process which is sensitive to take care of the concerns of social justice. .

We urge you to issue clarificatory instructions to all concerned institutions including JNU to correct their admissions process and ensure 27% OBC reservation. .

Reservation Act offers the following guidelines ( para (X) and (XI) with respect to the relaxation and application of Cut-off Rules for OBC reservation: .

Each CEI is also authorized to fix cut off marks for admission/selection through admission test, etc. for the OBC candidates with such differential from the cut off marks for the unreserved category as each institution may deem appropriate for maintaining the standards of education and at the same time ensuring that sufficient number of OBC candidates are available in keeping with the directions/observations of the Honble Supreme Court of India in this regard. This authorization by the central Government to the CEIs to fix the cut off marks in the compliance with the Apex Courts direction asking The Central Government to examine the feasibility of determining such cut-off marks. The Central Government believes that each CEI would ensure that the directions/observations of the Honble Court are followed. .

CEIs which are in process of conducting admission tests may decide on the cut-off marks for the OBC category well in time, so that consistent with the standards of the education of the CEIs, sufficient number of eligible OBC candidates are available for selection on the basis of inter-se merit against the reserve seats. Such institutions may also obtain information pertaining to the background of students who may have indicated as belonging to the OBC category in the application form, so as to identify those belonging to the creamy layer from among them for exclusion from the counseling/ interview/ group discussions/ offer of admissions. .

JNUs Position .

.

The candidates are selected for admission according to their merit and cut off is determined as per the number of seats. However, minimum qualifying marks for general category are fixed at 40 and for the reserved category at 30. For reserved category candidates if they score up to the cut off for the general (unreserved) candidates, they are offered admission as unreserved category candidates and are excluded from their reserved category. For the OBC candidates, since the Supreme Court stipulated that the cut off should be fixed up to 10 points below the cut off for general category candidates, without compromising the quality of education, the OBC candidates are offered admission 10 points below the cut off for general candidates. .

Cut off point is variable from discipline to discipline and is dependent upon the number off seats in each programme of studies. The cut off may not be the same as the qualifying marks which is the same across the discipline. .

All those who are above qualifying marks are theoretically part of merit-list, however, how many are admitted depends on the number of seats available in a programme for which cut off is set. .

JNUSUs explanation .

Clearly there is a total violation of the MHRD guidelines by JNU on the definition of cut-off. JNUs position is unethical and violative of the very spirit of social justice. Cut off, which according to the MHRD guidelines, is a policy parameter that must be specified in advance based on universitys own standard of excellence, has been wrongly equated by JNU with merit, which is a post-factum outcome variable depending on the competitive performance of unreserved category students and the number of seats in a particular course. .

It is clearly seen, JNUs present admission process does not treat an OBC candidate independently on the standards of the institution, rather it links his/her performance to the last selected candidate in the unreserved category in a particular course which is variable on the empirical performance of students in a particular course. .

This basic mistake leads to a more fundamental problem whereby the opportunity granted by the Constitution for the reserved category gets tied to the fluctuating performance of unreserved category candidates rather than specified in advance based on universitys own standard of excellence. It is imperative that JNU must set its own standards which must be reflected in a pre-determined mark, based on its own notion of standards of excellence. It must be noted that candidates whether unreserved/OBC/SC/ST must be evaluated on the standards of the institution and not on the performance of any particular category candidates, which is a clear violation of the directive. .

Other forums and documents also buttress the MHRDs interpretation, and run contrary to JNUs arbitrary and untenable position. Let us look at the statements of the individual judges in the recent Supreme Court judgment .

today met the administration and raised serious questions on the entirely flawed admission process in our campus. .

However, the administration chose to maintain its insensitive approach on the genuine demands placed by the .

councillors. .

The councillors argued that the new system of admission policy is flawed because it is leading to a decline in seats .

instead of an 18% increase. The only forum where this issue can be addressed is the standing committee on admissions but unlike the old system where the standing committee used to be called after the first phase of admissions (generally held on the 6th August), under the new system, the standing committee would have been called after all the admissions were over. Any discrepancies in the fulfillment of seats, quota in that case would have become a fait accompli. Therefore, it is necessary to convene a standing committee meeting on admissions before the final date is over so that further lists can be brought out to address the discrepancies. After consistent pressure, the councillors forced the administration to advance the Standing Committee meeting on admissions to 11th August. This is very important in the context that there is complete opacity being maintained in the entire admission process. However, on the rest of the demands, the administration remained completely non-committal. .

On Seat-Cuts: While the JNUSU councillors argued that there have been drastic seat cuts in various centres, the administration did not budge from its position. The administration argued that the offer can not be the legal basis for increasing the seats. That is a very skewed logic because the admissions for the BA programme this year are being done on the basis of the old system of offers. So does the administration mean to say that the admissions this year to the BA programme are all illegal! This whole logic of legal tenability is nothing but a subterfuge that the administration is seeking to endorse the seat cuts. The JNUSU Councillors pointed out that despite the bogus claims of seat increase, there have been seat cuts in the university. This was illustrated from the fact that while 680 students had joined various M.Phii/Ph.D programmes in JNU in 2007, the maximum of those who can join this year has been reduced to 663, thus leading to a deficit of at least 17 students straight away. .

OBC Reservation: While the 27% OBC reservation has been bulldozed by the administration in our university with the full complicity of the JNUSU leadership, even the 12% reservation promised has not been fulfilled in true letter and spirit. In many centres like ZHCES and MA CHS, no OBC candidates have been admitted this year. The Councillors countered the administration with facts, after which they opined that consultations with legal experts would be undertaken and the conclusions reached would be brought to light. However, we believe that such actions of the administration are time-taking and keeping in mind the urgency of the situation, the OBC reservation has to be implemented in all centres. This means that the administration has to bring out OBC lists in centres where no OBC candidate has been selected. .

PH Reservation: It is highly condemnable that the 3% PH reservation was taken away in JNU in this year's admissions. But after a wide-scale protest by the differently abled students and larger student community, a new list was brought out of 31 students. However, given this year's total admissions, the total PH candidates should be 56. Hence, there is an immediate need to correct this short-fall and additional lists have to be brought out to accommodate more candidates from the PH category. .

Waiting List for MA Urdu: It is indeed very surprising that in CIL, no waiting list has been brought out for the MA programme in Urdu. Even after repeated interventions by the JNUSU Councillors, the administration has refused to bring out a waiting list. Even today, they stuck to their position that the eligibility criterion had not been fulfilled. We refuse to accept such fictitious logic of the administration and demand that a waiting list be brought out in MA Urdu. .

The administration, like previous occasions has refused to heed to any of these genuine demands of the students. With the last date of admission process fast approaching on 14th August, it is highly important that the struggle against all these serious discrepancies in our socially-sensitive admission process is further strengthened and be made sharper. This requires rock-solid unity among all sections of the student community. However, it is highly unfortunate that at such a critical time, the JNUSU leadership and the organization leading it has been functioning as the spokespersons of the administration. They are working overtime to confuse the student community, thus weakening the struggle against such anti-student measures. Given the adamancy of the administration, we have decided to intensify our struggle by starting an indefinite hunger strike from today to ensure that the following demands are met: .

Historic Victory For OBC Reservations: 18.8.11 Today SC Finally Declared Cut-off to be Defined as Minimum Eligibility-Removed the Central Road Block for Non-Fulfillment of OBC Seats! .

AISA hails todays historic Supreme Court judgement on the cut-off criterion for OBC reservations. The SC verdict today vindicates the position that AISA had been painstakingly arguing against all oppositionand cynicism for the last 3 years. .

The Supreme Court bench comprising Justices R.V. Raveendran and A.K. Patnaik today clarified that the relaxation in cut-off for OBC candidates is to be calculated from the minimum eligibility mark, and NOT from the mark obtained by the last selected general category candidate. In doing so, the SC dismissed the appeal by the anti-reservation YFE and PV Indiresan against the Delhi HC verdict of 7 September 2010 and upheld the 7 Sep 2010 HC Verdict. Further, the SC has ordered that all central universities which are in the midst of their admission process must make all necessary corrections in their admission criteria, define eligibility marks as cut-off, and fulfill OBC reservations accordingly by 31 August. .

The verdict has an all-India implication-it has salvaged the OBC Reservation Act from being scuttled on the ground by deliberate casteist manipulation of cut-off norm as we have seen in JNU and DU. .

This year, the correct cut-off criteria has been implemented in JNU after a 3-year long struggle with the JNU administration. However, in several universities, including DU, the wrong criteria is being followed. Today, in DU Law Faculty, even as the SC judgement was being pronounced, anti-reservation brigade tried to physically stop eligible OBC candidates from taking admission. However, students defending social justice and reservations intervened to ensure that admission process happened according to the HC and SC verdict, As a result almost 300 OBC students, whose admissions were kept hanging all these days, got admission. .

The SC verdict today is a vindication of the struggle that was begun by the AISA-led JNUSU three years ago in 2008. Right from the first year of implementation of OBC reservations, AISA and AISA-led JNUSU identified the faulty cut-off criteria as the main stumbling block hindering the fulfillment of OBC reservations. Even other universities like DU and Allahabad University adopted this clever casteist device created by JNU, in order to ensure non-fulfilment of OBC quota and diversion of OBC seats. .

In 2008, when JNU announced its 2008 OBC admission norm, AISA alerted everyone that this method of fixing cut-offs was flawed and would NEVER allow OBC seats to be filled. AISA waged a sustained struggle against this wrong definition of cut-off, using admission data obtained through RTIs to prove the validity of our argument. In the three years that followed, AISA launched a sustained campaign and struggle to rectify the distorted implementation of OBC quotas in JNU and elsewhere. .

From 2008 till the JNU AC meet in March 2010, all other organizations in JNU ran a vitriolic campaign against AISA on this question, and refused to accept our point about the false definition of cut-off, or participate in a single protest programme or public meeting! Despite this hostility, and these attempts to divert our struggle, AISA never got distracted and conducted a lone battle for correct implementation of OBC quota. Only many JNU teachers saw the correctness of our point, supported the campaign and took bold positions in various forums like the AC or Deans Committee. .

Eventually, in 2010, our stance was vindicated by the Delhi High Court in a landmark verdict. In fact, the SFI was so upset by the Delhi HCs vindication of AISAs position that they could not even welcome the verdict for 48 hours! .

YFE however understood the importance of the HC verdict and the verdicts power to stop the YFEs ploy to subvert and deny OBC reservations, and so YFE filed an SLP (special leave petition) challenging the HC verdict in the Supreme Court. Todays verdict finally vanquished the anti-reservation forces even in the Supreme Court, which firmly upheld that cut-off and minimum eligibility were one and the same thing. .

The episode also exposed the double standards of the Congress-UPA Central government on the question of OBC reservations. In the course of the struggle, we repeatedly approached the HRD Ministry and Social Justice Ministry, asking them to step in and settle the matter by clarifying how their own law on OBC reservations was to be interpreted. Not only did the Central Government fail to do so. In fact during the JNU case in the Delhi HC, the Counsel for Central Government actually argued in support of the JNU Administration and YFE advocates, arguing against our (correct) interpretation of cut-off marks. It was only after the Delhi HC verdict vindicated AISAs 3-year long struggle that the Central Government changed its posture. .

It is indeed a moment of celebration for all those who stand by social justice and the constitutional rights of deprived sections of society to reservations. The whole struggle has exposed how anti-reservationists occupying high positions inside JNU administration tried to subvert OBC reservations by hook or by crook and today, the sustained struggle of the JNU community, including students as well as progressive teachers, against these ploys, has won a huge victory in the shape of the SC verdict. .

We appeal to all JNU students and organizations who stand by social justice to join a massive United Victory Procession from Ganga Dhaba, 9.30 pm tonight (18 August). .
