HOW THE AISA-LED JNUSU BETRAYED 27% OBC RESERVATION.

The JNU Academic Council had decided in 2007 to implement 27% reservation for OBC students.

at one go, precisely because JNU already had a relatively high percentage of OBC students.

(around 20% to 21 %) owing to the deprivation points system. In fact, in 2007 the percentage of.

~ OBC students went up to 24% as noted in the minutes of the Academic Council:.

"The number of students belonging to the other backward castes [sic] enrolled this year.

[2007-08] has been close f9 24% which together with the students belonging to SC/ST/PH.

categories and those admitted from the socially deprived sections come to more thanhalf of the total enrolment." [p.13, Minutes of AC Meeting held on November 20, 2007].

It should be obvious that in the admissions for 2008, if the proportion of OBC students is less than.

24%, that would imply a decline in the percentage of OBC students admitted to JNU compared.

NSUI once again congratulates the student community of JNU for successfully leading the movement for campus democracy and bringing back the historic JNUSU Election process. In the last three years, the JNU student communitY has been witness to an authoritarian regime run by the administration. Since there wasn't an elected JNUSU. the administration was somehow successful in its anti student agenda. During this period, while the communist organizations were busy blaming each other, the NSUI stood up to the students cause. Installing wi-fi facility in JNU campus, a fully functional SBI branch, bringing out second admission list, single window and online admission process, new hostels, new ambulance for the health centre, introduction of UGC Non-NET scholarship, Maulana Azad and Rajiv Gancihi Scholarship are some of the achievements of .

NSU1. .

All these demands were met because of the strong persistence of NSUI activists. However, there are many issues and demands which have not been fulfilled yet. A fully functional placement cell, increase in MCM and UGC Non-NET fellowship, RGNF to all SC/ST, PH and VH students, a 24x7 functional library, fully functiona I and 24x 7 health centre with permanent doctors, better facilities .

in hostels, increase in RGNF and Maulana Azad fellowships, internal bus service and metro feeder buses etc are some of the issues that require immediate attention. NSUI is committed to fight for these demands in the interest of the students. We need a strong JNUSU for getting these demands materialized. While there are organizations in this campus who are more concerned about a Jasmine or a Tulip Revolution taking place somewhere in the world than thinking about getting a 24x7 health centre or library, NS Ul prioritizes JNU specific issues. 18 March AC Meeting: Ensure Social Justice! .

16.3.11 Demand Administrative Accountability !! .

.

JNU Academic Council (AC) will be meeting after one whole year on March 18th (coming Friday). For the past few years, the entire JNU community has witnessed a gross breakdown of JNUs democratic decision-making process as well as a visible decline of JNUs credibility as a public institution upholding certain basic ethical and democratic values. The manner in which the JNU administration has been scuttling the proper implementation of the legally mandated OBC reser-vations in JNU in a shameful display of institutionalised casteism is a prime example of this phenomenon. The upcoming AC meeting is therefore crucial - it is high time that those people responsible for JNUs loss of credibility, and for scuttling of social justice in this institution known for its democratic credentials, are held accountable. .

What exactly is at stake? .

Over the past three years, more than 400 OBC students have been denied admission in JNU for NO fault of theirs, but simply because of JNUs faulty admission process. 277 students were denied admission last year alone. Who is responsible for this criminal injustice? .

Since 2008, JNUSU, the student community, and several faculty members have been demanding a change in JNUs faulty cut-off criteria. When the administration went to the extent of even subverting an AC decision in its single-minded agenda to scuttle OBC reservations, the victimized students were forced to approach the Delhi High Court for justice. The Delhi High Court (HC), in its 7th September judgment, had REJECTED JNUs admission policy on OBC reservations. .

Instead of implementing the HC verdict in JNU, and moving towards correcting JNUs policy, the JNU administration shockingly chose to challenge this verdict in the High Court and filed a REVIEW PETITION in the Delhi HC against the 7th September verdict. Subsequently, on December 23rd 2010, the HC once again upheld its 7th September verdict and dis-missed JNUs review petition. This raises certain very important questions: .

JNU, despite being a public funded institution is behaving like a private individual litigant, challenging an existing law which it is legally bound to accept and implement. .

.

.

The JNU administration decided to independently and unilaterally move the HC to challenge the 7th September verdict without the mandate of any university body. Clearly, neither the Deans Committee, the Standing Committee on Admissions, JNU Academic Council or any other statutory decision-making body has been consulted on this issue. This is a highly dangerous trend, with far-reaching repercussions for JNUs transparent and democratic decision-making process. .

JNU administration is fighting all these legal cases to SCUTTLE OBC reservation by SPENDING PUBLIC FUNDS. In other words, a central university is not just overruling its own decision-making bodies, it is subsequently trying to justify its unilateral policies by spending public funds! Why should funds meant for the development of the university be spent to defend an administrations ideological predilections? Can any administration be allowed a free hand to misuse public funds in this manner? .

Time and again, JNUs admission policy has been held to be illegal in the court of law (first in the 7th September judgment, and again on 23rd December 2010). In these cases, the court held that JNU should offer admission to the litigant students. And still JNU refuses to offer admission to all the victimized students! Should a central university create such an unprecedented situation wherein every student eligible for admission is forced to move the courts, fight a long legal battle, and prove once more that JNU is legally in the wrong?.

Justice must prevail for all students, not just for those who are able to fight long and expensive cases in the court. It is the responsiblity and duty of public institutions to change their faulty policies and not wait for each and every victim to force them individually to deliver justice. .

There is another critical issue at stake, which too reflects JNU administrations typical casteist mindset to scuttle fulfilment of OBC seats. The JNU administration is trying is set a low quantum of relaxation viz. the qualifying/cut-off marks fixed for MPhil/ PhD are 40 for general and 35 OBC students and for BA/MA, it is 30 for general and 27 for OBC students. This is arbitrary and once again violative of the Supreme Court directives, which categorically states that a maximum relaxation of 10 % - which is 10 marks in an evaluation of 100 marks- should be provided to fill all the OBC seats. .

Recognition for More Madarsas: When madarsa certificates were first recognized in the 30 April 2008 AC meeting, it was decided that recognition would gradually be expanded to include new madarsas too. This has not yet happened. The coming AC, as per the decision of the 30 April, 2008 AC meeting, must expedite the process of recognition of more madarsas across the country. .

At the upcoming AC meeting on March 18th 2011, these issues have to be addressed if JNUs democratic credentials and commitment to social inclusion are to be defended. Apart from offering admission to all the victimised students, and setting the correct cut-off criteria (in keeping with the 7th Sep HC verdict), the quantum of cut-off should also be correctly assigned. .

In an All Organisation Meeting called by AISA last night, it was decided that a joint PUBLIC MEETING on all these issues will be held on 17 March and a united Protest Demonstration will be held in front of the AC Meeting on 18 March. AISA appeals to the student community to strengthen the ongoing struggle to ensure proper implementation of OBC reservations and expanding other steps of social inclusion in JNU! .

JNU Administration Reconfirms Its Casteist Character Once Again! .

Deans Committee Decision on Cut-Off Criteria for OBC Reservation Upturned -.

JNU Reverts Back to Its Earlier Faulty Cut-Off Criteria Under YFE Diktats! .

Unite To Defeat This Casteist Ploy To Scuttle OBC Reservation ! .

In a most shocking move today, the JNU administration has yet again attempted to tamper with the proper implementation of OBC reservations and social justice in JNU. As the student community is well aware, a decision was taken at the Deans committees meeting of 17th June 2010 in favour of an admissions model that would ensure correct implementation of OBC reservations and fulfilment of OBC seats. Today (12th July), almost a month after this decision in favour of correct implementation of OBC reservations, the JNU administration called a hasty meeting of the same Deans Commit-tee, where its earlier decision was upturned and revoked. The Deans Committee has now recommended that the JNU administration continue to follow the faulty, illegal recommendations of the Aditya Mukherjee committee which have led to massive non-fulfilment of OBC seats for the past two years. .

This decision was apparently taken after a legal notice was sent by YFEs advocate Puneet Jain to the JNU administra-tion claiming that the admission model that JNU is planning to follow this year is illegal and violative of the Supreme Court directives vis-à-vis implementation of OBC reservations. Based on this legal notice, the JNU administration sought the legal advice of two more lawyers (Mohinder JS Rupal and PP Rao). Both these lawyers as well as the JNU administrations own lawyer (not surprisingly) came to the opinion that the Deans Committee had taken an illegal and wrong decision on June 17th and that JNU had indeed been following a correct model for the past two years! Therefore, the JNU administration called another meeting of the Deans Committee, and the earlier decision was revoked in effect ratifying the administrations incorrect implementation of OBC reservations. Let us not forget that todays decision is also a shameful rejection of JNUs own Academic Councils decision to do away with the Aditya Mukherjee Committees recommendations on OBC reservation. .

The JNU administration might try to explain and justify this shocking and shameful volte-face, but the REAL reason is crystal clear. May we ask the JNU administration: if indeed there was some legal ambiguity why did the administration not seek ANY legal advice in the four long months since the AC meeting of 18th March, where the Aditya Mukherjee Committees recommendations were clearly rejected? Why did the administration wait till the last minute, when all the results are ready and when the admission process is underway? .

May we also remind and warn the administration: a legal notice or a mere letter from a single lawyer questioning the legalityof the JNU admissions process DOES NOT amount to a legal injunction, or a stay order from a court. It is merely the opinion expressed by a lawyer if the casteist lobby can bring a couple of lawyers to defend its casteist interpretation of the Supreme Court judgement, the progressive sections in JNU can (and in fact have already done so) provide legal recommen-dations questioning the administrations position. It is indeed shameful that the JNU administration has wilfully chosen to selectively use legal opinion suitable to its well known casteist agenda! .

The student community has not forgotten that ever since the Deans Committee came up with its decision in favour of correct implementation of OBC reservations, the YFE has consistently been attacking this decision. In the past week, YFE has come up with two leaflets abusing the Deans Committees pro-reservation decision. In its posters, the YFE had called the Deans Committees decision illegal and had in fact threatened to serve a legal notice against JNU. It is therefore obvious that the casteist lobby constituted by YFE and some sections in the faculty as well as in the JNU administration have together conspired to once more bring up the bogey of legal ambiguity to scuttle proper implementation of OBC reservations. What we have witnessed today is a well-thought out, well-planned game plan by the anti-reservation lobby. .

The timing of Deans Committees volte-face also reveals the dubious game plan of this casteist lobby: Had the Deans Committee not given a favourable verdict in June, the JNU administration was well aware that it would have to face massive opposition and resistance from progressive sections in JNU (including students as well as teachers). The administra-tion knew full well that its position was legally untenable the protracted debate in this campus on the correct method of implementation of OBC reservations had already been clearly clinched. Therefore, the only way out for the casteist lobby in the administration to once more scuttle OBC reservations was to wait till the last minute, and THEN create spurious confusion over some purported legal ambiguity! .

It is now the second week of July, and the evaluations of all the examination papers have been completed. JNU is on the verge of announcing its results for 2010-2011 and clearly, those opposed to social justice and reservations in the administra-tion have realised that the OBC quota is going to be fulfilled this year. And since this is complete anathema to the anti-reservationists, they have come up with this new ploy to delay the implementation of OBC reservations this year too. .

The JNU administration seems determined and hell-bent to cross all limits in its single-minded endeavour to scuttle OBC reservations and social justice in JNU. It is determined to undermine every single democratic decision-making body in the campus from the Deans Committee, to the Academic Council, to the Executive Council in its attempt to scuttle reservations. Nothing could be more shameful for an institution of JNUs reputation, which has had the long tradition of upholding social justice and fighting to ensure equality and democracy. .

WHY TAMPERING WITH 3% RESERVATIONS FOR PH STUDENTS?.

According to the Indira Sawhney judgement of 1993, the admission of PH students has always.

been horirontal. But in the name of implementing horizontal reservations for P·H students, the JNU.

administration cannot fail to fulfill the entire quota of 3% for PH students. Duped by the JNUAdministration's logic, the JNUSU office-bearers have resorted to making false claims of havingchallenged the implementation of horizontal reservations in the Academic Council. This iscomplete bunkum. We challenge the JNUSU office bearers from AISA to mak~ the minutes of theAC meellng public, where their dissent regarding this has been noted. It is only when the.

differently abled students have raised their voice, supported by other organisations, that this.

issue has been redressed. .

JNUSU OFFICE-BEARERS HAVE FAILED .

It is clear from the above that the JNUSU office-bearers from the AISA have failed to live up tothe election mandate and have in effect frittered away the hard won rights of the JNU studentcommunity. The JNUSU office-bearers have kept the student community totally in the darkregarding crucial decisions related to this year's admission process in JNU. The desperateattempts currently being moue by the JNUSU President and ther;.AISA to justify the moves of theadministration and spread confusion within the student community make their complicity. in theJNU odminislratjon's gome amply clear. SFI warns the JNUSU President and the.AISA against.

siding with the anfi-student moves of the JNU administration, which will not be accepted by the.

student community. .

There are several issues related to this year's admissions which need to be understood andresolved in a way so that the interests of the student community, particularly those belonging todeprived sections, are protected. In view of this, the SFI is putting forward the following demands,which need to be met in order to redress the problems in this year's admission process..

SFI DEMANDS: .

1. A meeting of the Standing Committee on Admissions should ~be called immediately totake stock of how many students have joined so for. The date of thi"S emergency meetingshould be such that there is enough time before the last date (141h August) to bring further.

On 12th of January 2007 we have filed another petitior: no. 35/2007 in the name of Youth for Equality Vs. Union ofIndia challenging the OBC reservation. Senior Advocate Ashok Desai and Adv. M.L. Lahoty argued the case..

On February 20'h 2007 a petition has been filed in the name of All India Equality Forum Vs. Union of India. SeniorAd. Rajeev Dhawan argued the case. .

On 25th of April 2007 another petition has been filed in the name of Citizen for Equality Vs. Union of India. SeniorAd. P.P. Rao argued the case. The long and strenuous efforts of Youth For Equality paid off when all the Senior and learned advocates ofIndia agreed to fight the case of Youth For Equality at the Supreme Court of India free of cost.29th March 2007 -SC Stayed the OBC Reservation BillIn a "landmark Order, the Hon'ble Supreme Court on 29th of March 2007 stayed the OBC reservation actpassed by the Parliament. The Bench of Justices Arijit Pasayat and L S Panta delivered the verdict on the batch ofpetitions filed by Youth For Equality through various organizations and individuals challenging the decision asbeing ultra vires (unconstitutional). Keeping the petitions in mind, the Bench stated that Section 6 of theReservation Act was not applicable since no data on OBCs has been collected in the last 76 years. The Court also directed the Government to reserve·some percentage of 27% foreconomically backwad people. The Court also denied reservation in unaided institutffins. At the same time Courtasked to define the criteria for Creamy layer and for identification of OBCs. Merit has also been consideredimportant. The Government has been directed not to dilute the Merit to unreasonable extent.After the judgment what has happened is already conveyed to the student community over the past fewmonths. 18 March 2011 AC Meeting : An Appeal to JNU Faculty .

A meeting of JNUs Academic Council (AC) is scheduled for March 18th 2011. This AC meeting -which is scheduled to happen exactly an year after the previous AC meeting -is being held in the backdrop of JNUs administrations continuous scuttling of OBC reservations in JNU, despite a clinching verdict delivered by the Delhi High Court (HC) indicting JNUs admission policy regarding OBC reservations. .

The student community, as well as various faculty members, and even JNUs AC (which is one of the highest academic decision-making bodies in the university) has unequivocally rejected the Aditya Mukherjee Committees faulty and illegal cut-off criterion for OBC students, which is leading to large-scale non-fulfillment of OBC seats in JNU. Despite this widespread opposition, the administration continued with its faulty admission policy, and therefore this year alone, 277 OBC students were denied admission and their constitutionally protected rights of reservation by the JNU administration. And now, even after the Delhi HC (in its judgment of September 7th 2010) has held JNUs admission policy to be bad since it is rendering OBC reservations in JNU illusory, the JNU administration is stubbornly refusing to admit those eligible OBC students who have been criminally denied admission in JNU for no fault of theirs. .

It is also a matter of serious concern that ever since the OBC Reservation Act came into effect, the JNU administration has shown a shameful track record of false promises and undermining of a transparent, democratic decision-making process in JNU simply in order to subvert social justice and prevent the proper implementation of OBC Reservations in JNU. .

From 2008 onwards, the JNU administration has used the devious ploy of the faulty and illegal cut-off criteria to steal OBC seats and deny admission to OBC students. This happened despite the JNUSUs timely interventions from 2008 itself, repeatedly pointing out the fallacies of JNUs cut-off criteria for OBC students. .

Then, when the student community and the JNUSU protested, they instituted a committee under the chairpersonship of Prof. Aditya Mukherjee to look into the matter. Subsequently, even in the face of all logic and legal proof repeatedly provided by the progressive sections in the entire JNU community, the Aditya Mukherjee Committee was used by the administration to ratify its faulty and illegal admission process time and again. .

As a result of a long struggle by the democratic sections in the entire JNU community, the Academic Council (at its March 18th 2010 meeting) finally rejected the Aditya Mukherjee Committees recommendations. Subsequently, the Deans Committee upheld the ACs position in its 17th June 2010 meeting. It endorsed the demands of the student community and corrected the illegal and faulty cut-off criteria being followed by JNU. .

In July 2010, acting on spurious legal opinion served by the casteist Youth for Equality and prepared by lawyers well-known for their anti-reservation positions, the JNU administration shamefully overruled the AC decision and unilaterally issued an order in its own name reverting back to the Aditya Mukherjee Committees recommendations without taking the sanction of the AC. .

Again, in December 2010, the JNU administration decided to challenge the 7th September 2010 verdict of the Delhi HC through a Review Petition, once again acting unilaterally and without consulting or informing any of JNU's existing decision-making bodies. .

.

For the past three years, we have witnessed a shameful spectacle of institutionalized casteism in JNU. It is high time therefore that the JNU administration put an end to its casteist machinations. For precisely this reason, the upcoming AC meeting to be held on March 18th is absolutely crucial. At this meeting, several issues have to be settled conclusively: .

Cut-off Criterion for OBC Students: JNU has to correct the illegal cut-off criterion that it has been following for the past three years. After the 7th September Delhi HC verdict, it has no option but to implement the verdict in JNU and award relaxation for OBC students from the minimum qualifying marks and NOT from the marks obtained by the last general category candidate admitted. The anti-reservation, casteist YFE and its supporters have challenged the HC verdict in the Supreme Court. However, the SC has refused to stay the HC verdict, and therefore, the HC verdict will HAVE to be implemented. .

Quantum of Cut-off: Apart from the very definition of cut-off, it appears that the administration is retaining its bureaucratic and anti-reservation approach by arbitrarily setting a low quantum of relaxation viz. the qualifying/cut-off marks fixed for MPhil/ PhD are 40 for general and 35 OBC students and for BA/MA, it is 30 for general and 27 for OBC students. This is arbitrary and once again violative of the Supreme Court directives, which categorically states that a maximum relaxation of 10 % should be provided to fill all the OBC .

STUDENT-YOUTH CHARTER OF RIGHTS RIGHT TO EMPLOYMENT CHARTER .

1. .

Employment with dignity should be given the status of a fundamental right by the Central government Make an Employment Guarantee Scheme for urban areas. .

Unemployed youths above the age of 25 should be given respectable unemployment allowances by every State government. .

.

3. .

All workers under contractual or honorary basis should be immediately regularized as permanent workers. Make Commissions and Boards formed for giving employment regular and transparent. Fill vacant posts immediately. .

RIGHT TO EDUCATION CHARTER .

1. .

Scrap the current Right to Education law which denies the principle of right to basic education and encourages the privatization and commercialization of education. Bring a new Right to Education bill based on ·common school system·r .

Immediately repeal the Private Universities Bill, Foreign Universities Bill along wtth all the bills proposed in Parliament by the MHRD, which clear the way for privatization of education and corporate loot. Repeal the recommendations of the Lyngdoh Commission, which are against the principles of democracy and conduct Students' Union elections accqrding to democratic procedures on all campuses. .

Make laws at Centre and State levels to regulate and monitor the exorbitant fees structures, admission processes, evaluation processes and administration of all primary to higher educational private and semi-government institutions. Guarantee the implementation of reservation in educational institutions so that all deprived sections of society are represented, ensure democracy, transparency and removal of all discrimination! .

DEMOCRATIC RIGHTSCHARTER AGAINSTCORRUPTION AND CORPORATE LOOT .

1. .

Scrap the government Lokpal draft Pass an effective Jan Lokpal Bill which brings the army, judiciary, NGOs, PM, MPs and ministers in its ambit. Make the structure of the Lokpal socially inclusive and democratic. Repeal the privatization and new economic policies basically responsible for corruption! .

2. .

Stop giving tax concessions to corporate houses. Scrap the policies which facilitate the privatization and corporate loot of land, minerals, water, coal, seeds, spectrum and other natural resources. Declare all natural resources to be national wealth! .

3. .

Repeal repressive laws such as AFSPA, UAPA and the Seditjon Act as well as measures like Operation Green Hunt which have been made to suppress democratic movements and protest. .
