Ever since the debate regarding massive anomalies and discrepancies has been unearthed in this year's admission process, there has been wide questioning ot the socially-sensitive admission process of our university. As a result. the ongoing admission process is not only shrouded by opacity, but also flawed in various ways. Vv'hile the 3% 11orizonlol reservation for PH category was initially done away with. the 12% OBC reservation along with the seat-increase of 18% has also not been properly fulfilled our university this academic yeor. But 1he major cause of concern in this year's admissions has been seat-cuts across centres and schools. This is all t11e more serious since there was supposed to be an 18% seai increase in the university. Whil.e the administration has willfully bulldozed its anti-student proposals 'to be implemented in our campus from 1·he coming academic session. But in this entire issue, the most shameful role has been played by the JNUSU l_eadership in being complici to all these decisions and also no informed the students about their 'brave acts' of surrender. The student councillors hod kept the pressure on the JNUSU to convene an emergency council meeting to discuss this issue 'thread-bare. It was only after this consistent pressure, the JNUSU 1eadersr1ip felt it necessary to coli a council meeting. However. it was extremely unfortunate that the JNUSU President and other office-bearers never did the proper home-work and took no efforts to understand the gravity of the situation. As a result, the meeting turned out to be an informal one with no decisjons being taken on the course of action. .
The JNUSU leadership and a section of the council have refused to ac cept the fact that. there had bee]l sear-cuts in the university. fhe offer system prevalent earlier in JNU which resulted in a large number of studenls joining the university has been done away with. The current lisi·s of selected students fix an upper-bound on admissions, thereby deprivir1g large sections of students from pursuing their academics in our university The JNUSU leadership has been arguing that the system of Offer was not legally tenable. However, on 6th June 2008, the JNUSl:J leadership said: .
"As we are well aware, JNU always "offers" around 30% seats over the official "intake", and now the administration is planning to do away with the practice of offering higher number of seats, repeating the oft repeated excus.s; of lack of infrastructure. Any cursory study of intake, offer and joining data would indicate that this move might leave JNU's intake unfulfille<:L Therefore, Administration is actually planning to scuttle the full potential of proposed seat increase being actually realized. This is a classic case of giving with one hand, while taking away with the other.''.....See JNUSU Pamphlet dated 06-06-08 .
We would like to ask the JNUSU office-bearers why they have stepped back from this position and aJguing on behalf of the admiAistration so vehemently? It is a··result of the Administration's ploy and the complicity of the Administration that there has been seat cuts in this University. Let us compare the case o·f students adrnltted to the various M.Phii/Ph.D programmes in JNU in 2007 and those numbers possible to come in 2008: .
Total no. of students admitted to M.Phii/Ph.D in 2007 =680 .
Total no. of students possible to be admitted in 2008 = 663 Deficit= 17 .
{due to upper-bound on admissions) .

Ttl is cleorly s!1ows that tt1ere hos been a deticit of 1.7 sea ts Ihis year. compared to last year. So. ii is clear that instead of having on 18% seat increase. there has been a decrease. In fact. this has been found true in centres like CHS in SSS, CILS in SIS and CILIn SLL&CS. In fact. in MA Urdu, there has been no waiting list too. Similar cutsin seats hove also been in centres !ike SA Russian. Havtng been exposed of their complicity in !he entire discrepancies of tt;le admis~lons, the JNUSU leadership and the organizo1ion representing them has been working overtime 1o 90nvince '!he students that 12% OBC reservation and 18% sent increase has been ensured in the campus. As far as OBC reservation is concerned, the fact that only 12% OBC reservation has been implemented (which Is also questionable) is actually a regression for the JNU student movement since 20-24% students from the OBC category were already admitted In the campus last year. The non-implementation of seat increase along with a decrease in the proportion of OBC students effectively means that major academic expansion of our campus that was possible has been scuHied by JNU Administration, with full complicity of the JNUSU leadership. ~-c,.v....f-.
Since, 'he JNUSU leadership has clearly decided not to lead H1e struggle against f-ee hil(e. it is incumbent upon us as the Councillors In JNUSU to mobilize students and force the administration not io decrease a single seat in any centre. We appeal to the studenf'communily to participate in large numbers ln torr1orrow'sdemonstrotion to compel the administration to withdraw the anti-student mQve of seat cut. .

should stand between 40 and 30. It is th1s cut-off mark on which the selection of an OBC candidate should be based, and .
which the university should decide beforehand, reflecting the university's own standard. .
The intake is then filled according to a ,.merit listu, since there are a number of students who have scored above the cut-off mark. In both categones, unreserved and OBC, it is the "merit list" that becomes the logical criteria on which to offer admission If suff1c1ent seats were available, then all candidates scoring above the "cut-off mark" would get admission However, since seats are limited. some students of both categories may not get admission. Until such time as the seats are fulfilled. the university must go down to the benchmark [cut-ofn for providing admission. .
But shockingly, the system that is being followed by JNU in clear contravention of these criteria Is proceeding as follows: In a particular course: .
JNU has a base mark (which it erroneously interprets as "eligibility" and not "cut-ott which the Act requires) for unreserved candidates (40 marks) and 30 marks for SC/ST candidates and prepares a respective merit lists. It is still not clear what JNU considers as the base mark (or what i.t erroneously interprets as "eligibility") for OBC candidates .
The merit list begins with the person who has scored the highest marks. .
Supposing, the highest mark in the merit list is 90, then the merit list will proceed until the seats in the general .
category are filled. .
Let us say that the last mark on which the general seats are filled is 70 marks. .
JNU then declares this 70 (the last mark on which the general seats are filled) as the "cut-off' for the general category/unreserved candidates. It then gives a 10 marks relaxation to define the "cut-off' for the OBC candidates. (All OBC students who achieve marks between 90 and 70 are absorbed in the general category). .
The university is arguing that that the stipulated OBC quota (1 2% this year) has to be filled by those students who get marks between 70 and 60. This is absurd logic, and is an ideal recipe for not filling the OBC quota. .
If the OBC quota is not fulfilled by incorporating all students who receive between 70 and 60 marks, then the university argues that. as per law, the residual seats will go to students of the unreserved category. .
The above mechanism is not in accordance with the Act and the MHRD Directive, rather it violates the basic definitions of categories and very direction and spirit of the Act. As a consequence, it is also creating a serious discrepancy 'n the admission process. .
This situation has arisen because of JNU's faulty definition of "cut-off". "Cut off', which is a policy parameter and must specified in advance based on university's own standard of excellence, has been wrongly equated with "merit", which is a post-factum outcome variable depending on the competitive performance of unreserved category students (crossing the cut-off) and the number of seats in a particular course. Thus as per the Act, when relaxation should be provided on the dcut-off' for the unreserJed category (ie the pre-determined policy figure of 40), JNU is providing on "merit" (ie. say 70 ) of the unreserved category. .
This basic mistake leads to a more fundamental problem whereby the opportunity granted by the Constitution for the reserved category gets tied to the fluctuating performance of unreserved category rather than specified in advance based on university's own standard of excellence. .
What this process also does is instead of filling OBC reservation, It provides more seats to the general category while creating the possibility of leaving the OBC seats permanently unfulfilled. .
In the current process the required percentage of OBC seats is not fulfilled only because it does not treat an OBC .student independently on the standard of the university and the remaining seat may go to that unreserved candidate who has equal or lesser marks to a candidate selected in OBC category. It must be noted that candidates whether unreserved/OBC/SC/ST must be evaluated on the standards of the institution reflected in its pre-determined ''cut-off', and not on the performance of any particular category candidates, which is a clear violation of the directive. .
JNUSU condemns the gross tampering with rules that the administration has indulged in. JNUSU demands that _JN_U must reverse its biased and illegal interpretation of the law and the "cut-off" criterion in the current adm1ss1on process and immediately fulfil the stipulated OBC quota for 2008. .
~he~ the REAL debate, and the real danger 1s here, attention is being diverted from this crucial issue by certain organlsa.tlons.. They are busy slandering the JNUSU by peddling misleading data, spreading immense confusion regarding ~ totally 1m~g1ned "seat cut", and constantly changing their demands. This belles a complete lack of interest and seriousness In properly rmplementing OBC reservations and other concrete anomalies prevailing ir. the process. .
T~e administration has to be forced to correctly interpret the law and fulfil the legally mandated seat increase. ~hat rs happening right now is a gross violation of the law of the land. When the university authorities are not willing to admit this, JNUSU will intensify the agitat:on and fight at every forum against these castelst attempts to curtail reservation. .
In the light of this attitude of the JNU administration JNUSU will hold a Protest Demonstration at UGC too as the JNU administration _ca~no~ be allowed to have their casteist ~nd erroneous ways jeopardising the provisions of constitutionally en~h:ln:d soc1al JUStrce and continue other gross anomalies in admissions. JNUSU appeals to the student community to JOin In a protest demonstration tomorrow (13u, August, 2008} at 2.30 pm at the UGC. Assemble at the Ad Block .

Agenda for Higher Education Scripted by Whom, in Whose Interests? .
The UPA-II regime and HRD Minister Kapil Sibal have a whole range of neoliberal prescriptions waiting to transform the very fabric of higher education in India. Which forces are scripting these changes? .
The Singh-Obama 21st Century Knowledge Initiative and the Indo-US Business Councils Higher Education Mission to India are indications of the US eagerness that India deregulate education and allow foreign players to tap the Indian education market. This market, according to ASSOCHAMs estimates, stands at $25 billion and is projected to reach $50 billion by 2015. Echoing the US diktat, Sam Pitroda, adviser to Prime Minister Manmohan Singh on innovation and infrastructure has recommended that we do to our education what we did to our economy in the 1990s i.e deregulate, withdraw state support and let the market have a free hand. Ironically in the US itself (as in other advanced capitalist countries like the UK, which are preaching that India liberalise education and economy), teachers and students have been on the war path protesting against the massive fund cuts and fee hikes. What the US (and Britain) are seeking to do is to rejuvenate their own education business by opening up shops in India. And a series of education-related Bills in the UPAs pipeline are all geared to open up our education for their profit. Some of these Bills are as below: .
The Foreign Educational Institutions (Regulation of Entry and Operation) Bill, 2010: This Bill is being introduced on the pretext that global educational institutions will be brought to the Indian students doorstep. Instead, international experience indicates that such legislation can neither attract truly world-class institutions, but can only allow unreliable educations shops to sell sub-standard wares (relatively free of regulation) to Indian students. .
The Universities for Innovation Bill 2010: This Bill proposes to set up 14 Universities for Innovation in India, which will enjoy Government funding but be totally free from any kind of regulation of standards or fees! These Universities, in the name of being free to innovate, will be free to have foreign VCs; merit-based admission process free from any obligations to reserve seats for SC/STs and OBCs; fix their own free structures; pay differential fees to faculty; and admit up to 50% foreign students (in contrast to ordinary universities which have a 15% cap on foreign students). These Universities, while enjoying Government funding in the shape of grants of land, fellowships etc, will be free from supervision by regulatory authorities like the UGC. There are no norms for curriculum, teaching quality, students assessment etc spelled out for the promoters of these universities, and no penalty for making false claims or failing to provide quality education. .
The Educational Tribunals Bill 2010 In the name of setting up educational tribunals at national and state level to resolve disputes among stakeholders in the education sector and penalise unfair practices, the aim of this Bill seems to be to restrict the recourse of teachers, employees and students to courts. This would facilitate foreign and private players in the education sector who would like to be free from the prospect of being taken to court. .
