Speed Limiters at the time of manufacture and all trucks

 

On September 7th, The Federal Motor Carrier Safety Administration and the National Highway Traffic Safety Administration released a Notice of Proposed Rulemaking that would mandate speed limiters on heavy-duty trucks. The proposed regulation seeks to require that truck manufacturers activate speed limiters at the time of manufacture and all trucks with engine control modules (ECUs) capable of restricting speed be activated on trucks already on the road. The Agencies are not, however, prepared to pick the speed that the speed limiters should be set at and are considering options of 60, 65, or 68 miles per hour.

 

OOIDA opposes the speed limiter mandate because it is based on flawed science and will detract from highway safety. OOIDA encourages its members to submit comments via www.regulations.gov at Docket # FMCSA-2014-0083 or Docket # NHTSA-2016-0087 (All comments received will be duly considered by the joint FMCSA and NHTSA team, comments only need to be posted to 1 docket). The public comment period will be open until Monday, November 7th.

In addition to submitting comments to the Agencies, we must also alert Congress why a speed limiter mandate would be dangerous for the nation’s highways. FMCSA and NHTSA are not moving forward at the direction of Congress with this proposal, but at the behest of special interests, who hope to use a mandate to their competitive advantage. In fact, there has not been a single committee hearing in either chamber devoted to speed limiters and their effect on safety.
