Whistleblower, Qui Tam Lawsuit: Healthcare, Pharma, Financial – How to Report Fraud

topclassactions.com/lawsuit-settlements/lawsuit-news/1497...

Who’s Affected?

Have you witnessed your employer committing fraud in government programs like Medicare, military contracts, or others? If so, whistleblowers can earn large cash rewards if they are the first to report the fraud in a False Claims Act lawsuit, also known as a “qui tam” lawsuit or whistleblower lawsuit.

Pharmacists, billing pros, healthcare employees, financial consultants and other insiders have earned more than $1 billion in whistleblower awards.

With help from employees reporting fraud in whistleblower lawsuits, taxpayers have recovered billions of dollars from companies involved in Medicare Fraud, Financial Fraud, Flawed Pharmaceutical Products, Tax Fraud, Government Contracts, Physician/Hospital Kickbacks and other misconduct.

Whistle blower reports are a powerful tool to help stop fraud and help the government recover some of its losses.

In exchange, whistleblowers will typically be rewarded with 15 to 30 percent of what the whistleblower lawsuit recovers.

Whistleblower lawyers are actively seeking people who may have witnessed fraud committed against the government. Find out if you have a case by filling out the confidential form on this page now.

Overview: What Types of Fraud Are Committed Against the Government?

Medicare or Medicaid Health Care Billing Fraud

Healthcare billing fraud, through Medicare, Medicaid or other government program, occurs when a healthcare provider bills for unnecessary services or services never received by a Medicare patient.

Medicare or Medicaid fraud is usually committed by hospitals, physicians, pharmacies, medical product or medical device providers, labs, ambulance transport companies, home healthcare agencies or other medical provider that bills a government program for medical products or services.

Examples of healthcare fraud may include:

Fraudulent upcoding in medical billing.

An ambulance company claiming emergency services for a simple transport or entering into a kickback arrangement with hospitals.

Overcharging for medical goods or healthcare services.

Kickback or illegal referral arrangements between providers.

Providing services that are not medically necessary.

Claiming and billing for services provided by a physician when the care was provided by a less qualified employee.

If you believe you have witnessed Medicare fraud or health insurance fraud, you may qualify to file a whistle blower lawsuit against your employer on behalf of the government. Fill out the form on this page now for a FREE case evaluation.

Government Procurement and Military Contract Fraud

Government contractor fraud occurs when companies contracting with a government agency or the military do any of the following:

Overcharge for goods or services.

Perform sub-standard work or substituting lower quality materials than promised.

Bill for services not performed.

Provide inaccurate information about completion, quality, or timeliness of contract work.

Government contractors involved in whistleblower lawsuits include defense (military) contractors, security or environmental contractors, or any other company cheating on their agreements with the Federal or State government.

Other Fraud Types: SEC Corporate Fraud, IRS Whistleblower Statute & More

If your employer is involved in securities – stock fraud, the Securities Exchange Commission or the “SEC” has a whistleblower statute that rewards people who report corporate fraud and protect them with anti-retaliation rules.

IRS tax fraud — when companies do not pay the IRS taxes they owe or are involved in a scheme to avoid taxes — is covered by the IRS whistleblower rules. If the fraud is substantial the Internal Revenue Service pays tax whistle blower rewards.

What is a Whistleblower Lawsuit/Qui Tam Lawsuit?

Whistleblower lawsuits are the only way to report fraud and collect a cash reward under the U.S. False Claims Act and the 31 State False Claims Acts, including New York, Florida, Texas, and California False Claims Acts.

Warning to Tipsters: If you call and report fraud directly to the government you will not be eligible for a reward beyond a small amount. The only way to earn a cash reward under the False Claims Act is to file a whistleblower lawsuit.

Qui tam lawsuits are lawsuits filed by whistleblowers under the False Claims Act. A qui tam lawsuit is filed by an individual or another company that claims another company has defrauded the government in some way.

The person who files a qui tam lawsuit is called the “relator,” commonly known as the whistleblower. A relator may be an employee, former employee, a competitor, or another contractor or subcontractor who has some knowledge of the alleged fraud.

Qui tam lawsuits cannot be based on public information, unless the whistle blower is the source of the public information. The whistle blower is considered the original source of the allegations.

The False Claim Act dates back to the Civil War and was signed by President Abraham Lincoln to protect against fraud against the government. It has been amended several times since then to accommodate a variety of situations.

How Do You File a Whistleblower Lawsuit?

Qui tam lawsuits are sent directly to the Justice Department for review. They are kept confidential while the government investigates whether or not the allegations are valid. It also gives the government a chance to decide if it wants to join the lawsuit.

This is done before the company being charged is informed about the qui tam lawsuit. The government has 60 days to review the lawsuit, but this time is often extended.

The identity of the whistleblower is protected while the complaint is “sealed” and the Department of Justice investigates. In SEC cases the whistleblower’s name is typically never revealed.

The first whistleblower to file the qui tam lawsuit is the one that will be considered by the court, even if another one contains more detail. This is designed to encourage potential whistleblowers not to hesitate to file their whistleblower lawsuits. So it is critical to speak with a whistleblower lawyer as soon as possible to learn your rights.

A whistleblower lawyer can help you determine the best course of action. Fill out the form on this page now for a FREE case evaluation.

What Do Whistleblowers Receive as an Award?

Whistleblowers may receive 15 to 30 percent of the amount of money that the government recovers as a result of the qui tam lawsuit per the U.S. False Claims Act and also the 31 state False Claims Acts that come into play when the government agency that was financially damaged was a state government.

In 2014 and 2015 more than $500 million were paid to whistle blowers each year as rewards ranging in amounts from $75,000 to more than $50 million.

What Job Protections Exist for Whistleblowers?

There are anti-retaliation laws protecting whistleblowers who blow the whistle on their own employer or another company. These individuals are provided whistleblower protection under the U.S. False Claims Act, state False Claims Acts, and the IRS and SEC statutes.

Whistle blowers are protected against retaliation which includes being fired, demoted or harassed. Penalties for such retaliation include reinstatement and substantial damages. These amounts are in addition to anything received as a cash reward.

Boeing Whistleblower Who Raised Quality Concerns Is Found Dead

John Barnett had accused the plane manufacturer of retaliating against him after he flagged problems he saw at Boeing’s 787 factory in South Carolina.

A prominent Boeing whistle-blower, a former quality manager who raised concerns about manufacturing practices at the company’s 787 Dreamliner factory in South Carolina, was found dead on Saturday with what appeared to be a self-inflicted gunshot wound, according to local officials.

The whistle-blower, John Barnett, was in Charleston for a deposition for a lawsuit in which he accused Boeing of retaliating against him for making complaints about quality and safety.

Quality problems involving both design and manufacturing have plagued Boeing for years — most prominently after the crashes of two Boeing 737 Max jets in 2018 and 2019, and again since a fuselage panel blew out on a Max flight shortly after takeoff two months ago.

Mr. Barnett filed the complaint against Boeing with the U.S. Labor Department in 2017 under the AIR21 Whistleblower Protection Program, which protects employees of plane manufacturers who report information pertaining to air carrier safety violations. He left the company that year.

Boeing’s lawyer deposed Mr. Barnett on Thursday and he was questioned by his own lawyers for half the day Friday. They were scheduled to complete the deposition on Saturday morning, said Robert Turkewitz, Mr. Barnett’s lawyer in the case.

When Mr. Barnett, 62, did not show up on Saturday morning and did not answer phone calls, Mr. Turkewitz said he grew concerned and called Mr. Barnett’s hotel. Mr. Barnett was then found dead in his pickup truck in the hotel parking lot.

The Charleston County Coroner’s office confirmed the death, which it said appeared to be “a result of a self-inflicted gunshot wound.”

The Charleston Police Department noted the coroner’s finding in a statement and said it was conducting an investigation. “Detectives are actively investigating this case and are awaiting the formal cause of death, along with any additional findings that might shed further light on the circumstances surrounding the death of Mr. Barnett,” the department said.

Mr. Turkewitz said Mr. Barnett’s experience at Boeing had deeply affected him.

“It was really weighing on him, what was going on, and reliving all these things that had happened and the stress it had caused,” Mr. Turkewitz said.

An administrative law judge with the Labor Department was hearing the whistle-blower case, which was in discovery. A trial had been set for June.

Mr. Turkewitz said he planned to proceed with Mr. Barnett’s case, on behalf of Mr. Barnett’s family. “What John wanted was at least for it to make a difference,” he said.

In a statement, Boeing said, “We are saddened by Mr. Barnett’s passing, and our thoughts are with his family and friends.”

Known as Swampy because of his Louisiana roots, Mr. Barnett worked at Boeing for nearly three decades until he retired in 2017. He had worked at Boeing’s factory in Everett, Wash., before moving to a new factory in North Charleston, S.C., in 2010 to work on Boeing’s 787 Dreamliner, a wide-body jet that was the company’s most important new plane in a generation.

After two of Boeing’s 737 Max planes crashed in 2018 and 2019, Mr. Barnett’s concerns about quality issues at Boeing were featured prominently in The New York Times and other news outlets, as examples of widespread problems with the company’s manufacturing.

Mr. Barnett told The Times in 2019 that he had discovered clusters of titanium slivers that were hanging over flight control wires in some planes. Those slivers were produced when fasteners were fitted into nuts.

Mr. Barnett said in interviews that he had repeatedly urged his bosses to remove the slivers but that they had refused and moved him to another part of the plant.

The Federal Aviation Administration in 2017 required that Dreamliners be cleared of shavings before they were delivered to airlines. Boeing said at the time that it was complying with that directive and was working with a supplier to improve the design of the nut. But the company said that the issue did not present a flight safety issue.

Mr. Barnett also told The Times in 2019 that he had reported to management that defective parts had gone missing, raising the possibility that they had been installed in planes.

He said that his bosses told him to finish the paperwork on the missing parts without figuring out where they had gone.

The F.A.A. investigated and found that Boeing had lost some damaged parts.

“As a quality manager at Boeing, you’re the last line of defense before a defect makes it out to the flying public,” Mr. Barnett told The Times in 2019. “And I haven’t seen a plane out of Charleston yet that I’d put my name on saying it’s safe and airworthy.”

Mr. Barnett, who lived in Pineville, La., shared his concerns again in interviews with The Times this year as questions about quality issues at Boeing re-emerged after an incident on Jan. 5 in which a panel blew off a Boeing 737 Max 9 plane in midair during an Alaska Airlines flight.

“Over the years, it’s just been a steady pecking away at quality” at Boeing, Mr. Barnett said, adding, “This is not a 737 problem. It’s a Boeing problem.”

Boeing needs to “get back to basics,” he said. “They need to get back to airplane building 101.”

Mr. Barnett’s mother, Vicky Stokes, said in an interview on Tuesday that her son’s experience with Boeing had taken a heavy toll, making him look older than his three brothers even though he was the youngest. “He just carried this on his shoulders for so many years,” she said.

In an interview in January, Mr. Barnett said he no longer flew on planes because of what he’d seen during his time at Boeing.

“I’m not going to set foot on an airplane today,” he said. “It’s sad. It breaks my heart. I love Boeing. I love what it used to stand for.”

To reveal the truth is to find yourself under attack as WikiLeaks now find itself. Rep. Peter King is pushing for the website to be declared a Foreign Terrorist Organization. It is now clear what the United States is desperately trying to hide from the American People and the world.

The WikiLeaks website today said that it was under a forceful internet-based attack with the site inaccessible to users in U.S. and Europe.

The site, which just distributed a trove of U.S. diplomatic documents, said in a Twitter message on that it is under a 'distributed denial of service attack,' a method commonly used by hackers to slow down or bring down sites.

WikiLeaks was also under attack on Sunday - but the latest assault - believed to come from China - appears to be more powerful.

www.dailymail.co.uk/news/article-1334232/WikiLeaks-websit...

Whistleblower WikiLeaks said today its Web site has been targeted by a massive computer attack, just hours before an expected release of classified U.S. documents.

"We are currently under a mass distributed denial of service attack," WikiLeaks said on its Twitter feed. Efforts to reach the page as of this writing were unsuccessful.

The site released 75,000 confidential files on the war in Afghanistan in July and defied a series of warnings from the Pentagon and other government officials by releasing nearly 400,000 secret files from the Iraq war last month. In a Twitter post last week, the whistleblower site announced it was preparing to release its largest cache of classified documents.

"Next release is 7x the size of the Iraq War Logs. Intense pressure over it for months," WikiLeaks said last week.

In a follow-up Twitter post today, WikiLeaks said newspapers such as El Pais, Le Monde, Der Speigel, The Guardian, and the New York Times would post the files, even if its site was inaccessible. (Update at 1:30 p.m. PT: The files have since been released, revealing among other things that the U.S. ordered surveillance of U.N. leaders.)

The White House has condemned the leaks, saying they put lives at risk, and conservative commentators argued that Wikileaks.org should be shut down by any means necessary.

The WikiLeaks Web site has in the past been proposed as the first public target for a U.S. government cyberattack. One Washington newspaper argued that WikiLeaks' offshore Web site should be attacked and rendered "inoperable" by the U.S. government. A State Department adviser who served under President George W. Bush wrote a column calling on the U.S. military to "electronically assault WikiLeaks and any telecommunications company offering its services to this organization."

Bradley Manning, an Army intelligence specialist, is suspected of being a source for the document-sharing Web site and was charged in June with obtaining "more than 150,000 diplomatic cables" from the State Department.

Update November 29 at 6:24 a.m. PT: CNN reports that a hacker named "the Jester," who claims to have been involved with U.S. Special Forces, is claiming responsibility for the attack on the Wikileaks site "for attempting to endanger the lives of our troops, 'other assets' & foreign relations."

On Saturday 29 January, I went to meet and photograph some of the activists staging their weekly protest outside Belmarsh Prison against the continued detention and extradition proceedings against whistleblower and dissident journalist Julian Assange.

The previous Monday the High Court had made its decision regarding whether Julian Aaange' could request an appeal hearing on his extradition case at Britain's Supreme Court. As Julian Assange's fiancée, Stella Morris, left the building she smiled briefly, an immediate indication that there was at least some good news. She then gave a brief speech to a crowd of supporters and the press -

'Make no mistake,' she declared, 'We won today in court,' but then added, 'but let's not forget that every time we win, as long as this case is not dropped, as long as Julian is not freed, Julian continues to suffer.'

While Assange's defence team were granted the right to apply for a hearing at the Supreme Court, it will be up to Britain's highest court to decide whether to agree to consider his case. That decision on a possible Supreme Court hearing is expected sometime in the next two to three months.

Unfortunately, the remit of the appeal has been restricted to examining the United States' claimed legal promises on how Assange will be treated, rather than to the wider issues of freedom of speech, the CIA plot to assassinate him, the extent to which the evidence against him has obviously been fabricated or as to whether his treatment in Belmarsh Prison has amounted to torture.

If convicted in the United States on the charges of espionage for exposing US war crimes in Afghanistan and Iraq as well as other wrongdoing by the United States and other governments, he faces up to 175 years in prison.

After weeks of devoting their "1 in 5 million" weekly anti-government protests to Aleksandar Obradovic, the whistleblower for the Krusik ammunition factory while he was under house arrest in his native Valjevo town in western Serbia, Belgarderes welcomed him at the rally on Saturday, N1 reported.

The crowd cheered the man many considered a hero who did not yield to pressure and refused an 'indecent' offer to stop talking about shady businesses in arms trade that damaged Krusik and the state-owned arms dealer Jugoimport SDPR, while the profit went to private companies, one of which Obradovic linked to the father of Interior Minister Nebojsa Stefanovic.

"The truth cannot be hidden. The example of Krusik shows the anatomy of the regime," Obradovic told the crowd in Belgrade on Saturday.

He said that "a better future doesn't come on its own; we have to fight for it."

"I'm one of you; we'll succeed if we believe in victory," Obradovic told the crowd.

A huge banner reading 'Aleksandar Obradovic Our Hero' was posted on a lorry which from the speakers had addressed the protesters for the last 54 Saturday's in a row.

protest 1 od 5 milionaIzvor: N1

The traditional walk passed by the state RTS TV and continued outside the seat of Serbia's President Aleksandar Vucic.

Just over a month ago, Obradovic addressed the Belgrade rally for the first time by phone from his home, telling the demonstrators that everyone could overcome their fears like he did.

He said he revealed the illegal activities at Krusik to help others rid themselves of their fear. "If I could do it, trust me, every one of you can," he said.

Obradovic then added he did not consider himself a hero or a measure of courage but just an ordinary man who refused to watch his company being destroyed.

He was arrested in September, held under house arrest, moved to the jail, and after media published the story which triggered a public outcry, Obradovic was again placed under house arrest.

Three months after the arrest, a court released Obradovic three days ago. However, he is accused of publicising business secrets.

Serbia's authorities say he cannot be treated as a whistleblower under the law since he gave the documents to a foreign journalist instead to the respective institutions.

His lawyer said there was no evidence which could prove Obradovic's guilt. The lawyer said Obradovic was the whistleblower and could even be a witness in the case he revealed.

Obradovic leaked documents showing that Stefanovic's father was involved in deals with Krusik at privileged prices with the ammunitions he bought for export to Saudi Arabia ending up in the hands of Islamic extremists in Yemen.

Several hundred people gathered at Chater Garden in Central, Hong Kong yesterday to show their support for Edward Snowden, the NSA whistleblower who recently made the US NSA PRISM electronic surveillance program public.

Since the PRISM program does not really distinguish its users — and specifically if is _really_ is to protect the American public from terrorism, then it is clear that foreign traffic is its target, banners and signs specifically call on the US government to stop spying on foreign data.

Snowden has also mentioned that the Chinese University of Hong Kong (CUHK), its being the main backbone of Hong Kong’s internet traffic, has been one of the hacking target by the NSA, including other private businesses and citizens. The locals are specifically enraged by this fact, especially since the US has called on China for doing cyber espionage on American technology companies.

Perhaps China is also trying to do anti-terrorism? Hey, you never know.
