Mr. Spalding Denies That He Paid Certain Money Which Is Said to Have Been Paid in Promoting His Campaign for U. S. Senator – The Herald’s Efforts to Ascertain Who Paid This Money

On the 19th inst. The Herald published an editorial entitled “Mr. Meserve’s Betryal,” in which it had something to say concerning the betrayal by the S. P. Republican machine of Mr. Mesersve in his candidacy for the endorsement of the Republican party for United States senator, and the machine’s services in favor of the candidacy of A. G. Spalding. Among other things The Herald in this editorial said:

“It is stated, however, and apparently upon very good authority, that Mr. Spalding sought to secure title to this indorsement by sending his chekc for $50,000 to San Francisco to be expended by the Alden Anderson campaign committee and by sending sundry checks to swell the campaign funds of various candidates for the state legislature. It is very certain that Herrin, the head of the Southern Pacific machine, gave the word that Mr. Meserve’s candidacy should be frowned upon and Mr. Spalding’s candidacy promoted by that machine.”

On the 20th inst. The matter of Mr. Spalding’s alleged contributions in aid of the S. P. machine was referred to in the news column of The Herald. On the 22nd inst. The Herald received the following letter from Mr. Spalding:

“San Diego, Cal., August 21, 1910

“Editor Los Angeles Herald, Los Angeles, Cal:

“Dear Sir: From an editorial in the Los Angeles Herald of August 19, I quote the following: ‘It is stated, however, and apparently upon very good authority, that Mr. Spalding sought to secure title to this indorsement (of United States senator) by sending his check for $50,000 to San Francisco to be expended by the Alden Anderson campaign committee, and by sending sundry checks to swell the campaign funds of various candidates for the state legislature.’ This alleged rumor was reiterated as a fact in The Herald’s issue of August 20.

“The above statement is absolutely untrue in every respect. I have not contributed, nor have I been asked to contribute, one dollar to any political party, nor to aid in the election of any of ‘the various candidates’ referred to.

“In justice to myself and to others who have been maligned, in the interest of truth and in fairness to the voters of California, I must insist that your paper publicly, and with equal prominence retract at once the statement above referred to.

“Awaiting a reply, I am, Yours sincerely,

“A. G. Spalding.”

To this letter the editor of The Herald returned the following reply on the day on which Mr. Spalding’s letter was received:

“Mr. A. G. Spalding, San Diego, Cal.”

“Dear Sir: I have to acknowledge receipt of your favor of the 21st inst. Addressed to the editory of the Los Angeles Herald, which was delivered to The Herald offices last night during my absence from the city, and which I received this morning.

“I note your objections to an editorial statement appearing in The Herald of the 19th inst. To the effect that it was reported on apparently very good authority that you had made certain campaign contributions to the Alden Anderson campaign, as well as to certain candidates for the state legislature, and that you characterize these statements as being absolutely untrue in every respect; that you further state you have not been asked to contribute one dollar to any political party, nor to aid in the election of any of the various candidates referred to. You close by insisting that The Herald publicly and with equal prominence retract at once the statements referred to.

“In this connection permit me to say first that The Herald endeavors to be exceedingly careful concerning statements which it publishes that may reflect upon anyone, and never publishes a statement of character that it does not conceive it has reliable evidence of the truth of. The Herald believed that it possessed such evidence of the truth of the statements of which you complain as to justify their publication. If they are untrue, The Herald will be glad to correct them. I think, however, you will have no reason to object to furnishing The Herald some evidence of their lack of truth, and to the end that we may secure such evidence as far as your personal statement can give it to us, I respectfully ask you to give The Herald an answer to each of the following questions:

“First - Are you aware of any money having been expended in promoting your campaign for United States senator by any person, business organization or association of any kind other than what you contributed personally?

“Second - Are you aware of any money having been paid to any Republican candidate for nomination for the legislature in Los Angeles county by yourself or by any person pretending or claiming to represent you?

“Third - Are you aware of any money having been paid to any Republican candidate for nomination for legislature outside of the county, by you or by any person pretending to represent you?

“Fourth - Are you aware of any money having been paid by yourself or by any person pretending to represent you to the campaign committee or organization of any candidate for the Republican nomination for governor of the state of California, or to any manager of the campaign of any such candidate?

“Fifth - Do you know what number of a four-page circular, newspaper size, entitled ‘Spalding for Senator’ was mailed from San Francisco in sealed envelopes stamped with two-cent stamps, addressed to voters and newspapers of the state of California?

“Sixth - Was this circular referred to in the last question mailed by your procurement and with your knowledge and consent?

“I trust you will favor The Herald with answers to the foregoing questions, and I desire to assure you again that the matter complained of was not published until The Herald had assurances from sources which it conceived to be worthy of credence of its correctness.

“Trusting that I may hear from you, I bet to remain, Very sincerely yours,

“T. E. Gibbon.”

On the 23ed inst. The Herald received from Mr. Spalding a telegram as follows:

“Mr. T. E. Gibbon, Editor Herald, Los Angeles, Cal.:

“Your letter of August 22 is just received. My letter to you of August 21 fully covers the matter in the editorial in The Herald of August 19. You make a definite false statement calculated to do me an injury. You have assailed my integrity. I again demand that an immediate retraction of these statements as requested in my letter to you of the 21st inst.

G. Spalding”

In the first place Mr. Spalding, in his telegram characterizing The Herald statement as false, seems to ignore the fact that The Herald did not state absolutely that the expenditures had been made but that “It is stated, however, and apparently upon very good authority” that these expenditures had been made. It will also be noted that Mr. Spaldign failed to reply to the questions in The Herald’s letter relating to the expenditures charged against him.

In reply to Mr. Spalding’s telegram of the 23d. Inst. the editor of The Herald send Mr. Spalding the following letter:

“August 24, 1910,

“Mr. A. G. Spalding, San Diego, Cal.

“Dear Sir: I have to acknowledge your wire of the 23rd inst., in which you acknowledge receipt of my letter to you of the 22nd and refer to your letter of the 21st to The Herald as fully covering the matter contained in the editorial in The Herald of August 19.

“In your telegram you say that The Herald has made a definite false statement calculated to do you injury, that your integrity has been assailed and you repeat your demand for an immediate retraction of the statements made in the editorial referred to.

“First, I desire to say that The Herald does not concede that it has made a false statement concerning you, if the campaign contributions referred to in The Herald editorial of which you complain were paid in your behalf, with your knowledge, although they might not have been paid by yourself personally. Of course, everyone who has had anything to do with politics knows that nothing is more common than for a candidate to dodge the responsibility for expenditures in his campaign by saying that he did not make these expenditures personally. As I understand the law, any campaign expenditure made in behalf of a candidate, with his knowledge, is, in the eyes of the law, his expenditure.

“It was in order to prevent any misapprehensions as to your position, and the meaning of the declaration contained in your letter of the 21st inst. That you had not contributed, nor had been asked to contribute, one dollar to any political party, nor aid in the election of any of the various candidates referred to, that the questions contained in my… (Continued, Part 2)
