Interior of Big Brutus near West Mineral, Kansas. It is the second largest electric shovel in the world. It is 16 stories tall and weighs 11 million pounds. It was built in 1962 at a cost of $6.5 million by the Bucyrus Erie Company of Milwaukee. It was purchased by the Pittsburg & Midway Coal Mining Company of Pittsburg, Kansas. In 1974 it was silenced. Brutus has been open to tourists since 1985.

I was unaware that "privacy laws are on the books in France" (John Goldsmith) that might make this photo illegal - or possibly actionable in a civil suit.

 

After I took it, a woman (who is not visible in the shot) said that her mother (who is) objected to her photograph being taken. I had enough understanding of French to follow what she meant, but not enough mastery of it to reply effectively. The chap wearing the headphones was not so constrained and after a short voluble exchange she retreated.

 

It is my belief that the principle holds: no-one can have any reasonable expectation of privacy in a public place. These days not only does nearly everyone have a camera - the lack of people using smart phones in this shot is actually remarkable in itself - but everywhere is covered by cctv. There is at least one such a camera visible in this shot. In using the metro, the person in question ought to have known that she would be observed by thousands of people and many cameras. I doubt that any law in Europe would stand up to a challenge. And this in a country where the principle of human rights were first declared, and street photography was born.

 

And, by the way, the construction of the Paris Métro coincided with the start and spread of photography. A new book couples the two. trib.al/dcTVFvv
