The picture was posted by me on Flickr in 2006. I have made many changes since to try and discourage downloading or showing a watermark ( stolen pictures even still show the watermark. Some were downloaded when I first posted the picture)

 

I have deleted a lot of groups and comments and even changed the tags to nothing, did not help, because I had to look at who faved this picture and the groups they belonging to

 

TO MY DISTRESS - it shows up on Adult sites that I would never have visited but found the picture when I investigated. I want it to be taken down or will take legal steps.

Why did I ever post these pictures !!! Let it be a warning to all not to post your face on the web. It will always get abused by some. Thank God I never made ANY pictures EVER that will embarrass or put me to shame - #protectedbypixsy

In the past phototheft was usually limited to small size and low resolution images, like the first three in the collage. Although I found it irritating I couldn't be bothered to do much about it and occasionally I was even amused by it.

An underwater statue in the lagoon of Mauritius and placed there in the last few years turned up in many places on the internet identified as a 13000 year old statue in the Arabian sea.

Was claimed by someone claiming to be a professional photographer

This has been posted on very many photosharing sites (eg tumblr, pinterest, socializer, google+,, imgfave, wesharepics to name just a few) without my permission ever being asked. People posting may have attributed the image to me and linked here but when people reblog on such sites the attribution is lost. And the photo then spreads further. This one has been used by commercial diving organisations in Sulawesi, Bali, Syechelles, Maldives, Turkey, Thailand .... and that's just from looking for sites in the English language.

 

Now the situation seems more complicated and worse. Flickr seems to have opened a door to our photos at higher resolution. Jellyfields ( www.jellyfields.com) is one site that has exploited that, copying photos from flickr onto their servers and making them available for download. Others may also have done so or other companies may be getting photos from Jellyfields. Flickr is looking into this situation but you might want to check for your Flickr user name on the search bar on the Jellyfields site and see if any of your photos are listed. If so they do respond to email requests to take them down. If anyone wants any help with this, do let me know.

 

Here are some uses of my photos that I have found since finding my photos at Jellyfields. No longer is this poor quality, small thumbnails ... and I am not amused by where these photos are /have been used.

This photo is being used by an American company which sells tropical fish ( something which I strongly object to, especially with a fish which rarely survives in captivity and does not apparently breed in aquariums).

This one is on a Porn site ( another type of site which I don't wish to be associated with or support in any way).

This one has been sold in the online store of a well known software company as a wall paper for mobile phones.

  

Today I sat down and filled in my first DMCA take down notices. And thought some nasty thoughts at Flickr for not protecting our photos better.

Curio's Gala Phoenix is currently in the midst of legal issues which have resulted in her content being removed from the grid, pending the outcome of her legal battle. The Digital Millennium Copyright Act (DMCA) process in Second Life requires that when there is legal action taken against your content, Linden Lab will remove it from the grid until a ruling is made. Gala's fellow content creators have come together to host a fundraiser to help with the enormous amount of legal fees she will have to bare in order to fight these baseless claims.

 

The fundraiser will be held from July 9-15, with a blogger preview on July 8th.

First time she stole my rules notecard, didn't even copy and paste it, it still said it was created by me! She just changed the names... And now this.. Please, if someone is telling you ideas, make sure they are original, find out where they have worked, do recon.. Whenever i have an idea for my club.. i check the others to make sure it isnt already used!

Why does Flickr from Yahoo! always want to hate on basketball?

 

Take a look at the Youtube video above. It's pretty boring in my opinion, just a few guys playing basketball. Nothing to see here, right folks? Move along.

 

Apparently somebody somewhere from the censorship division at Flickr from Yahoo though felt that this video needed to be removed. The user who uploaded the video tried to go through the proper Flickr from Yahoo channels to figure out just why in the blazes somebody would want to delete his inoffensive video and what follows feels like a scene straight out of Abbott and Costello.

So, tired of the above game of incompetence, atchang_2001 decided to escalate things and posted his problem and exchange to the Flickr Help forum (where I'm still permanently banned). Finally atchang_2001 got a thinking person's response to his inquiry. Zack Shepherd (who is probably the best in the customer care department based on my observations, and seems to care more than most of them) fielded the issue saying that the video deletion was probably an error.

 

From Zack:

"If the video that was removed was the same as the one you linked to than it was taken down in error. Unfortunately you also didn't get the right response when you initially wrote in and we usually do release the photo/video name. I can assure you there are no bots but as humans we do make mistakes sometimes. I'm sorry that this happened twice on the same case making it even more frustrating.

 

You are welcome to upload this video again. We are going to circle up with the team to make sure everyone is on the same page.

 

We'll also follow up with you directly with more info. "

 

Flickr by Yahoo! has recently had a horrible rash of censorship problems. From nuking user's accounts who write critical comments on President Obama's photostream, to deleting a Professional photographer's images of clothed male models, to deleting controversial anti-Obama imagery, to kicking me out of the help forum and placing secret flags on some of my inoffensive images to hide them on flickr by Yahoo, to locking down forums where folks post critical comments about their censorship, to censoring photostreams of people because they contain photos of feet -- but this one probably takes the cake.

 

Unfortunately for atchang_2001, the harmless basketball video that he says he uploaded to Flickr that you see above (along with any comments, faves, tags, or other meta data around it) is long gone. See Flickr has no way to restore content that is deleted by their staff even when it's by mistake. You'd think that this would be a feature that they'd be working on, especially given that former Flickr Chief and co-founder Stewart Butterfield admitted that it was a "mistake" for Flickr not to have this sort of functionality over two years ago. But unfortunately not only do they not have that sort of functionality they are not even working on it -- apparently they've been too busy working on their new logo for the site to deal with messy little things like protecting user data.

 

Frankly, the email exchange above is pretty unacceptable. I'm not sure if the problem is Flickr by Yahoo management or simply Flickr by Yahoo's Censorship Division management, but if Yahoo! is really serious about implementing their marketing hype that the new Yahoo! is "You," then they should probably consider getting this part of their network cleaned up a little bit. One idea might just be to stop censoring users in the first place. Then you don't have to worry about mistakes like this happening at all.

 

Deleting user content should be something that is only done as a measure of last resort, not because some underling in the censorship division didn't get enough sleep last night or hates anti-Obama imagery or basketball.

This photo was taken by me in 2008. Using Google's Search By Image feature I have found this image being used on dozens of commercial Web sites without my permission.

 

In my conversations with the Web site owners they tend to point the finger at their Web site designer. Apparently, many Web designers see Flickr, as well as the rest of the Internet, as their own personal photo library.

 

I've had a few sites agree to pay to license this photo. Many other take it down after a nice DMCA take down notice.

Yes - we've all ordered that really good deal from amazon, and yes they are too good to be true.

 

1. The consumer (Amazon Customer) usually has no idea this is going on. They purchase a design they like on their chosen product at a cheap price without a second thought as to who the artist is and whether they are purchasing an authentic product.

 

2. The products are made using screen captures of low resolution art files found on artists websites, google image searches or from artist licensed partners like Fine Art America, Society6, and Zazzle.

 

3. The fake products are mostly made by Chinese sellers, but they have also been found globally being resold by many U.S and European sellers and discount warehouses. China does not enforce international copyright treaties and their courts generally do not acknowledge intellectual property rights.

 

4. These products are often not as described, made from inferior materials and from very low resolution images that make the artwork look fuzzy and/or off-color. These low quality products often still have artist watermarks still on them. They usually sell at incredibly cheap prices and more often than not they ship from China or outside of the USA.

 

Why does Amazon let this happen?

 

$$$$ greed. We can assume the only logical reason Amazon allows and supports the illegal copyright infringement so strongly is that they can make more money selling a larger volume of cheap counterfeits vs a smaller volume of more expensive artisan original products. Amazon makes money on every counterfeit item sold. From membership fees paid by counterfeit sellers as well as a fee for every item sold and from fulfillment fees distributing these items from their warehouses.

Why does Amazon let this happen?

 

$$$$ greed. We can assume the only logical reason Amazon allows and supports the illegal copyright infringement so strongly is that they can make more money selling a larger volume of cheap counterfeits vs a smaller volume of more expensive artisan original products. Amazon makes money on every counterfeit item sold. From membership fees paid by counterfeit sellers as well as a fee for every item sold and from fulfillment fees distributing these items from their warehouses.

 

Doesn't a registered Copyright protect Artists? Why not sue them?

 

An artist in the USA has an immediate copyright at the point of creation. The copyright however, must be registered with the government in order to take legal action in court. There really is no law enforcement to help an artist. There is no assistance from the police, the FBI or the DOJ or the US government in enforcing copyright laws in online marketplaces. All of this is left up to the civil-suit court system. The U.S. copyright registration is much like a fancy extended warranty certificate from a company that went bankrupt.

 

The Chinese economy and the companies like Amazon, Ali Baba and Ebay that support these illegal activities count on this lack of enforcement. They know international lawsuits against anyone in China is a fruitless effort. These companies hide behind their "Safe Harbor" status that protects them from liability of what sellers do in their marketplaces. This then allows them to create a complex system to encourage the copyright infringements and profit from it directly without being held responsible for it.

 

Once you've taken away an artists income - they have no money to hire a lawyer. If somehow they do, companies like Amazon have a legal army that will tie up your case until you have not a penny left.

I wrote to you last month to thank you so much for all of your support during this very frustrating time. It means so much to me, and has sustained me more than I can say. However, as time has gone on with little explanation from me, you’ve had more questions, and that is understandable. I’d like to tell you what I’ve been going through, and ask you again for your support.

    

In March, I realized that Hush Darkrose was selling skins that looked very similar to mine. I often have to deal with skins that look a little too similar to mine; it’s part of protecting my copyright. I filed a DMCA takedown notice, but when Hush filed a counter-­notice, I didn’t do anything.

    

In April, Hush registered copyright of her skins in Canada. In May, she filed a copyright infringement complaint in a Canadian court against me, and then filed a DMCA takedown notice with Linden Labs. She also sent LL the notice of court action (the complaint).

    

Most of us only know a little bit about the DMCA. We know how the takedown and counter-­notice procedures work. What I didn’t know was that if the person who filed a takedown notice sends Linden Labs a notice of court action, you can’t continue to sell your content, even if you send a counter-­notice. This is why I got temporarily banned at the beginning of June: I left my skins up for sale after the counter-­notice, not realizing there was a problem.

    

In May, right after she sent the takedown notice, Hush put up a blog post. In it, she accused me of copyright infringement and claimed that a court had “reviewed the evidence” and determined her claim was valid. She even included some language she took from the complaint, rewrote it, and made it sound like the court had granted her an injunction.

    

There is no injunction. No court has reviewed any evidence. Her blog post was complete fiction.

    

I’ll say that again, because I want to be clear: there is no injunction against me. No court has reviewed any evidence. There has been no court decision against me. I am not guilty of copyright infringement. Hush’s blog post was not true. My skins are only offline because of the way the DMCA works.

    

Because there is already a case in court, I will probably have to go to court to clear my name and get my business back. Copyright litigation is very expensive, though. Just a small copyright case like this costs around $20,000 to see through, and most of that is court fees, which can’t be waived even if I found an attorney in Canada who’d take the case pro bono (I have an attorney here in America).

    

Curio is my primary source of income, and without it, I’m barely able to get by, much less afford $20,000 for a court case in another country. However, Curio is also a labor of love, and I will not just sit back and let a competitor’s lies and malice rob me of it.

    

From July 9 – July 16, 2012, a number of extremely generous content creators will be holding a fundraiser in-­world at Truth District on my behalf. I cannot express the depth of my gratitude for them, and for any SLers who come out and donate to my fight. I will also be putting up an IndieGoGo campaign to raise some money.

    

I know I’m asking a lot. $20,000 is a massive amount of money. But even a little bit helps, and maybe we can stand up against someone who is abusing a system that is supposed to protect us all.

I have two bodies, Slink Physique and Maitreya Lara, although I have demo'd Belleza and WowMeh before the whole DMCA thing.

 

2. What is your preferred mesh body available on the market right now?

Maitreya's Lara! It has the perfect balance of realistic and cartoony for me and the only body that doesn't make the area where the back turns into the buttox look too strange.

 

3. Have you changed your shape since you started wearing the body?

I did almost a complete overhaul; I've made my legs and torso a bit shorter, decreased hip width and saddlebags, increased hand size, butt size, hip length, head size, and lovehandles, added some more muscle to my arms, and reduced my tummy size.

 

4. How do you feel about mesh bodies in general?

They're definitely a vast improvement over the LL body. They look so much smoother and more defined, and I find fitting into clothes to be easier with the help of the included alpha HUDs.

In my old office, I would decorate for Halloween... but in my own style. A few purple and/or orange lights, a plush Jack O'Lantern, and some creepy-ass toys. McFarlane Toys' "Spawn" series were, and still are, some of my favorite toys as they invoke beauty and terror at the same time.

 

"Samurai Spawn" won a "Toy of The Year" award from Toyfare magazine due to it's articulation (26+ points) and level of detail. This is a special version from a 2-pack that also had many of the accessories you could purchase for this figure from the Spawn Collector's Club (the ornate and radiating battle banner and a flintlock that attached to the back of one of the bracers).
