super fast U/s 104 of MV Act. Perused the judgment of Honarable High Court in
its WP(c) No.30035 of 2016(D) dated 08/09/2016.
1. All super class services such as SF,FP etc are nationalized by the government as
per GO(P) no 73/2013 Trans dated 16/07/2013 and at present RTA has no
jurisdiction to issue such permit to private operators.
2. As per GO(P) No. 42/2009/ Tran dated 14/07/2009 and as per para 33 of the
judgment of Honarable High Court in WP(c) No.14793 of 2006 dated
10/04/2015,the Chief Executive Officer of the STU is the competent authority
to determine the traffic demand of a nationalized route. In para 15 of the
judgment of Honarable High Court in WA 670/2014 dated 05/02/2016,it is that
issue of additional permit apart from the scheme will upset the scheme ,which is
legally impermissible.
3. KSRTC has produced copy of regular permit as Super Fast on the very same
route issued by RTO Nationalized Sector and has objected the issuance of this
temporary permit U/S 104.
