The upcoming JNUSU elections are being held in very challenging times -for the student movement and for the country. Our land. forests, minerals and all natural resources are being handed over on a platter to facilitate corporate profits and corruption, sexual violence as well as communal and casteist offensives are increasing even as the mastermind of the 2002 genocide is being promoted as the next Prime Minister; dissenting voices are being arbitrarily arrested and jailed and the witch-hunting of minorities continues. Tribals are being displaced from their forests, peasants from their lands, workers from their rights to form unions and students from their right to affordable, quality education and dignified employment. .

In this phase since March 2012, when JNUSU election was restored after a long gap, JNU students have witnessed how AISA visualised and introduced several key policy-level issues and put them firmly on the map of JNU's student movement: such as reduction of weightage of viva marks, mandatory gender orientation programmes, setting up of a JNU Press and expanding the time period of the UGC fellowships to cover the entire research period. .

In the past one year, we have ensured significant achievements in some of our struggles: for instance, the process of starting the JNU Press is now in place, remote access to the Library's database has been ensured, UGC's attempts to curtail the JRF scholarships and subvert .

To address massive hostel crisis, SPS dorm facilities for 150 students with mess facilities for Rs 1965 was ensured. Administrative attempts to curtail photocopying in JNU was successfully resisted, thus defending students' inalienable right to research material. New courses were introduced in SIS and SSS (including optionals for SL students), a separate centre for Korean language was started along with its long awaited M.Phil. programme, Metro feeder buses have started operating. .

Th1s IS explained below. Why is the OBC quota in JNU not being fulfilled: Where lies the administration's fraud? .

The present moment is acritical juncture in implementing OBC reservations.Until last year, OBC students seeking admission were given 5extra marks on the basis of the deprivation point system. According to theOBC reservation law, OBC students can be given ar~uction of upto 10 marks. Why is it that with a5mark reduction.OBC students constJtuted 12% of the university'sstrength, while with reservation JNU is not able to fulfil even this number? Clearly, t11ere is adiscrepancy mthe way JNU is implementing thequota. In the meeting of the Standing Committee held on 11 111 August, the JNUSU Office-Bearers exposed the complete illegality of the basis on which the JNU .

Administration is defining and implemer.ting the law on OBC reservafion. According to the law and the MHRD directives, the university must fix "cut-off marks" for both unreserved and OBC candidates well in time. This cut-off is institution specific: it is the clear parameter on which it is evaluated whether students fit the standards of the institution or not. InJNU, for the unreserved candidates the cut off mark is 40, meaning that this is the benchmark that sets the standard of the university. The Supreme Court has stated that a maximum relaxation of 10 po1nts can be given to OBC candidate with regard to the un-reserved candidates as adifferential .

Accordingly, in JNU, the "cut-off mark" for OBC candidates should stand between 40 and 30. But this is something the university has .

not done. .

The crucial pomt of contention has to do with where we apply the 10 mark relaxation The Administration is presenUy arguing that this relaxation is to be .

applied on merit. In such acase,let us take the example of a particular centre: .

In this centre.suppose the merit list for the unreserved category is filled between 90 to 70 marks. Then,as per the JNU's argument,the 10 marks relaxation .

for the OBC cand1dates means that the quota has to be filled by students getting marks between 70 and 60. In this example,60 marks is the last benchmark .

for an OBC candidate to get admission.After this,if the quota is unfulfilled. the remaining seats will go to the general category. .

If the rematnrng seats are offered to the general category, then astudent of the general category can be given aseat at 65 marks,or 60 marks, or 55 marks. .

In the first situat1on.where a seat is given to an unreserved candidate getting 65 marks, then aseat has already been given to an OBC candidate at 65 marks.wh1ch means that the OBC candidate who has received the seat should actually be in the General Category and not in the OBC ment list' In the second situation, the general and the OBC candidates have been admitted at the same cut-off which is iflegal as OBC's should receive a10 mark relaxation in the cut-off! In the tflird situatjon,where the general candidate is taken in with 55 marks, ti1en the new general category student is below in merit to the last candidate .

Thomas Jefferson High School for Science and Technology, or TJ, is the nationโ€™s top-ranked public high school. Fairfax County Public Schoolsโ€™ (FCPS) recent changes to TJโ€™s admissions process specifically aim to reduce the number of Asian-American childrenโ€”and only Asian-American childrenโ€”who can attend TJ. The school districtโ€™s race-based admissions scheme garnered nationwide interest and strong opposition from the Coalition for TJ, a group of over 5,000 parents, students, alumni, staff, and community members who advocate for school diversity and excellence through race-blind, merit-based admissions. Represented by PLF in federal court, the Coalition is challenging FCPSโ€™ race-based admissions scheme as a violation of the Fourteenth Amendment.
