Paris, 4 February 2016 – Mediation Week kicks off today at the International Chamber of Commerce’s (ICC) Global Headquarters in Paris with a roundtable event for alternative dispute resolution (ADR) professionals and academics. The forum brings together some of the world’s top names in the field who will also participate in the 11th ICC International Commercial Mediation Competition taking place from 5-10 February 2016.
ICC Mediation Week includes the ICC International Commercial Mediation Competition and ICC Mediation Roundtable. This edition ran from 6-12 February 2020 in Paris, France.

MediaTIC building, Barcelona, Spain
MediaTIC building is an emblematic building with a pioneering architecture - that has become one of the symbols of the 22@ innovation district in Barcelona. The particular cube of 38 meters of height has a different facade cladding according to its orientation and the solar incidence for maximum environmental efficiency and considerable energy saving. It houses a 14,000 square meters ecosystem where environments of innovation and research, technological training and business activity coexist. Extra-specific activities also take place, such as lectures in the auditorium, or conferences and events related to information and communication technologies or to the economic and development challenges of the city.
The medIa-TIC building is a good example of the new smart and sustainable architecture in Barcelona, which uses the latest technology. Officially inaugurated in 2010, it is designed to be a communications hub and meeting point for businesses, r&d centres and institutions in the field of information and communication technologies (ICT) as well as for the media and audio-visual sectors. It hosts the following companies
and institutions: Barcelona digital Technological centre, Cibernarium (a digital training centre for companies and professionals), the open university of Catalonia, among others.
A highly personal creation of the cloud-9 architect’s office, the medIa-TICc building is in the shape of a cube and is formed by large iron beams covered in a plastic coating of inflatable bubbles, which offer glimpses of the fluorescent structure of the building. The attractive covering also has a functional utility as a way of regulating light and temperature, primarily preventing 114 tons of CO2 a year from escaping from the building, and offering a 20% saving on climate control. Every facade of the media-TIC is different: from the outside, they reveal parts of their interior spaces and give a diverse plasticity, while from the inside they offer spectacular views. The translucent and innovative covering, ETFE (Ethylene Tetrafluor Ethylene), recently approved as a construction material, is in itself an innovation in Spanish building: it acts as an external covering and a mobile sunscreen that helps light to penetrate and affords heat savings. The skin is activated using pneumatic mechanisms thanks to “luxometer” sensors that automatically and independently activate the chamber inflation and deflation devices according to how much solar energy there is. These luxometers are energy independent.

Eine tatsächliche Beendigung des Streits gemäß einer Befriedigung ist davon abhängig, ob es gelingt, einen Ausgleich der unterschiedlichen Interessen und/oder Verletzungen der Emotionen, die zum Konflikt geführt haben, herbeizuführen. Dazu müssen Personen- und sachbezogene Ebene(letzteres die Interessen) separiert und auseinander gehalten werden. Lediglich sofern das gelingt, kann eine ergebnisorientierte Beendigung im Interesse beider Konfliktparteien erzielt werden.(sog. Harvard Konzept, Fisher, Ury, Getting to Yes, 1981)
In der Mediation wird der Streit nicht mit einen Streitschlichter gemäß eines Alles-oder Nichts Entscheidung "geregelt" oder mit Hilfe einen (faulen) Kompromiss überwunden, sondern durch Aufarbeitung der Gegensätzlichen Interessen über Verständnismachung der tatsächlichen (hintergründigen) Interessen, aufgelöst. Dies kann für beide Parteien im Idealfall zu einer Win-win-Situation führen. Diese (Auf)-lösung kann kein außenstehender Dritter erledigen, sondern bloß die Beteiligten selber, da bloß sie ihre Positionen kennen. Der Interessenausgleich führt des Öfteren dabei, dass aus dem Streit zwischen zwei Personen sogar beide als Gewinner hervorgehen.
Konfliktlösung mit Hilfe von Mediation?
Grundsatz für die Mediation ist die Teilnahme aller am Konflikt Beteiligten an dem Prozess der Lösung. Dabei bedarf es der Bereitschaft aller Beteiligten, sich freiwillig mit dem Streit auseinander zu setzen. Dies setzt aber die Kompetenz voraus, nicht alleinig die eigenen Interessen kritisch zu betrachten, sondern sich ergebnisoffen mit dem Standpunkt der Gegenpartei auseinander zu setzen und zu verhandeln.
Aufgabe des Mediators ist es, die hinter den vordergründigen Streitpunkten liegenden Gefühle, Gründe und wirklichen Interessen für die Konfliktlösung nutzbar zu machen und herauszuarbeiten. Gelingt dieser Prozess des Zuhörens, des Eingehens und der ergebnisorientierten Reflexion von Standpunkten, kann das Ergebnis nicht allein die Auflösung des Konflikts selbst, sondern zugleich die Chance für die konstruktive Wiederherstellung der gestörten Bindung selber sein, wenn auch auf anderer Ebene. (beispielswiese. bejahende Verständigung als gemeinsame Eltern bei Paarkonflikten).
Ist Vermittlung für mich geeignet?
Wünscht man von der gegnerischen Partei nur das, was einem der individuellen Anschauung nach juristisch zusteht, dann ist der Mandant bei einem Rechtsanwalt bestens aufgehoben. Allein ein Richter wird in letzter Instanz dem Mandant sagen können, was einem gesetzlich wirklich zusteht.
Sofern Sie sich aber vorstellen können, im Interesse der Kinder mit dem Partner nach der Auseinandersetzung noch eine Elternbeziehung zu leben, auch wenn die Paarbeziehung für immer gescheitert ist, dann sieht die Sache sehr wohl anders aus. Ist es für Sie vorstellbar oder sogar begrüßenswert, dass Sie mit Ihren Geschwistern auch nach der Erbstreitigkeit noch freundschaftlich verkehren? Suchen Sie tatsächlich eine faire Beendigung, die nicht lediglich die Durchsetzung Ihrer eigenen belangen beinhaltet?
