"At the end of one of the main avenues of Pamplona, Carlos III Street, is the one that is one of the largest architectural complexes in the city and can be seen from almost any point in the center of the capital of Navarre. It is the monument to the Fallen, the second largest Francoist exaltation in Spain after the Valley of the Fallen and the first located in an urban environment. Despite being a building built in homage to the "dead in the crusade," as stated in an inscription engraved on the frontispiece now hidden behind a canvas, in reference to the deceased of the rebel side in the Civil War, the monument has dodged the new Memory law that has been approved in Congress and that will now pass through the Senate, in which no reference is made.
As the historian Fernando Mikelarena points out, in the text finally approved after the agreement of PSOE and Unidas Podemos with some of its usual partners, it does state in its article 35 that buildings and constructions and the elements that have townships that are on the public road that exalt the Franco dictatorship will be considered elements contrary to democratic memory. For the university professor and author of half a dozen books and more than a hundred articles published in scientific journals, however, the appreciation that only those who make "commemorative mention" to the dictatorship will be considered contrary makes him free from being considered as such. And in 2008 the Administrative Court of Navarre (TAN) already published a resolution declaring that the Fallen were no longer a monument that constituted a Francoist symbol because it had been converted into an exhibition hall and the symbolism had been covered. A resolution that has served as a reference for several judicial rulings on the monument and that was published before the bodies of the coup generals Emilio Mola and José Sanjurjo were exhumed from the crypt of the monument in 2016."
