Gov. Jack Markell signed House Bill 64, which provides for a Delaware Medical Orders for Scope of Treament (DMOST), a voluntary document that allows patients near the end of their lives to make their wishes about care known to health care providers.

At the May 28 bill-signing in the Governor’s Office in Wilmington, Judge Susan DelPesco, who helped shepherd the bill through along with sponsors Rep. Michael Barbieri and Sen. Bethany Hall-Long, called DMOST “the Civil Rights Act of the baby boom generation.”

Because DMOST is a medical order, health care providers will receive specific direction from each patient in carrying out their wishes. It is voluntary, and will be used by a person whose doctor would be not be surprised if they die within the next year. The form can be revoked by the patient at any time.

“A decision on the part of the patient and now a promise we can keep,” said Dr. Kathleen McNicholas of Christiana Care, who worked on the bill as well.
