October 15, 2012 - "Using Transnational Commercial Contracts to Regulate Business" - PPR Fellow Fabrizio Cafaggi gave a Penn Program on Regulation Seminar on how transnational contracts can regulate international commerce. Cafaggi presented the contents of his recent paper regarding his research into transnational contracts and their impact upon business practices. Cafaggi found that transnational contracts typically incorporate measures to attempt to comply with measures set out by regulatory organizations like the Organization for Economic Co-operation and Development whose own provisions cannot necessarily be enforced on their own, but through cooperation with larger corporations, may be enforced as contractual obligations between businesses. Cafaggi's upcoming book, entitled "Enforcement of Transnational Private Regulation". Cafaggi's work in transnational regulation is part of a larger body of work researching the subject hosted by the European University Institute and funded by the Hague Institute for the Internationalisation of Law (HiiL). Commentators in the seminar included Penn Law Professor Charles W. Mooney; Wharton Professor of Legal Studies and Business Ethics, David Zaring; and Associate Dean for International Affairs at Penn Law, Dr. Amy Gadsden.
