Does the Ayodhya Verdict of the Allahabad HC Represent Peace, Closure, Justice? .
The Sangh Panvar brigade wh1ch destroyed the Babn Masjid in 1992 IS, unsurprisingly, exultant over the Ayodhya verd1ct. However. a range of 'liberal' and 'secular' commentators (including prominent media anchors) too have said that the verd1ct is an opportunity to 'move ahead', and 'let bygones be bygones·. The Hindu and the Indian Express have joined P. Ch1dambaram 1n lauding the verdict, and Pratap Bhanu Mehta has gone to the extent of arguing that the verdict represents the 'depolit1c1sation of religion'! The chorus of 'secular' approval acquired a strange bedfellow on Gandhi Jayanti: Narendra Modi declared the verdict to be 'Gandhiji's blessings', hoping that it was the first step towards achiev-ing 'Gandhiji's goal of Ram Rajya'! .
p Ch1dambaram of the Congress is saying. in defence of the verdict, that it has "not defended the demolition of the Mas;id." But has it not legalised the ideological basis of the demolition? The three judges. even while admitting that the Ram idols were illegally smuggled into the mosque premises in 1949. have failed to take legal cognizance of this clearly communal and criminal act while delivering the judgment. And the Congress as usual lacks· the moral courage to take a stand on this. .
But what about the secular liberals-the Javed Akhtars, the Barkha Dutts; even the CPI(M) supporter N Ram (editor of The Hindu)? Are they so desperate to believe Court yerdicts must by definition be good verdicts that they blind themselves to the bas1s on which the verdict was arnved at? .
Let us ask cuise!ves some hard questions about the verdict and its liber'al defenders. .
We are bemg asked to accept the Allahabad HC verdtct, leave the Ayodhya issue behind as old 1990s baggage, and 'move on' fof\vard m the 21st century But how can we 'move on' when the High Court verdict drags us back to 16th century, and, in an act that reeks of medievalism, hands over property to a deity?! .
We're being asked to be mature and 'forgive and forget' history. What's past is past, let's bury the past and move on to the futur~ that awa1ts us.yve're told. Uruguayan writer Eduardo Gale~no wr.ote. ·:some have suggested·the rr_1istaken idea that to remember is dangerous. because by remef!1bering, history·wm repeaOtself as a nightmare. '(et.__if is amn~si"a that makes history repeat i(self. repeat itself as nightmare. Amnesia implies impunity, andimpunity encourages crime". .
But the forgetfulness .advised by the Allahabad HC verdict is not just amnesia, ~ is selective amnesia. The verdict, while conveniently forgetting (and forgiving) the demolition of the Sabri Masjid on 6 December 1992, chooses to remember·the alleged demolition of a Ram temple by Babar in medieval times! How can w e·imagine that such selective amnesia (that forgets actual organized violence and 'remembers' ima.gined crimes) can be the basis of 'peace' and 'reconciliation'? .
Does the verdict uphold the drgnity and rights ofMuslims? Yes, the verdict does allow Muslims one third of the land. But on what ground? If the waqf board suit was dismissed, is the court handing .over a third of the land to the minorities as 'cllarity'? Or to keep up a fayade of 'communal harmony' and reconciliation? To tell the Muslims, 'you have no right to this property, the moral and legal right rests with Lord Ram and his 'followers' Cas represented by the Sang hi litigants), but we'll generously allow you a small piece of it anyway' is to humiliate and demean the dignity of the minorities. In effect the verdict 1s say1ng what the Sangh Parivar says to Muslims at large, "the country belongs to the Hindus, but we'll let you stay if you behave yourself and accept your infenor status and your dependence on our generosity." .
There are many more questions that can be asked of the Ayodhya verdict, which is a shame for secularism and .
democracy. But the central point is that this verdict forces us to discard any smug confidence in "ourconstitutional .
secular democratic system" and our "judicial process." Clearly judiciary is as liable as any otherarm ofthe state to .
be influenced by politics, including communal politics. Far from 'depo/iticising religion' the verdict has, by accept-.

ing a God as a legitimate claimant ofland and property, legitimised the very logic ofpoliticisation ofreligion. .
Will the Supreme Court correct this dangerous precedent, and settle the dispute based on legal means rather than political and obscurantist notions of 'aith' and 'belief? That remains to be seen. But we cannot remain silent in the face ofa shocking judicial verdict that betrays every principle and every value of modern democracy. .
