In the event of activating the Emergency Signals On button it would momentarily drop/shunt every track circuit, throw every signal back to on/danger/caution, occupy every track circuit berth with an NDA (No Description Alarm Indication), place every level crossing into a lower mode & then send a distress emergency alarm to all neighbouring fringe interface boxes.

 

Basically an emergency stop button that would in effect kill all routes & stop ALL !! traffic movements within about 4 seconds or so.

 

As far as I'm aware it was never used in anger & the only time it got used was during routine system tests.

(doravante denominados "Participantes"),

   

Amparados no Memorando de Entendimento para a Realização de Atividades de Cooperação com Terceiros Países, assinado em 27 de março de 2007;

   

Inspirados nas disposições do Plano de Ação da Parceria Estratégica entre Brasil e Itália, assinado em 12 de abril de 2010;

   

Relembrando o Acordo de Cooperação Ambiental entre Brasil e Itália, assinado em 16 de dezembro de 2004, visando o desenvolvimento de programas conjuntos e projetos no quadro da Convenção-Quadro das Nações Unidas sobre a Mudança do Clima e do Protocolo de Kyoto;

   

Considerando o papel estratégico das energias renováveis, incluindo a bioenergia, no enfrentamento dos atuais desafios globais, como a mudança do clima e a necessidade de desenvolvimento sustentável;

   

Reiterando seus compromissos, na condição de co-presidentes da Parceria Global para Bioenergia (GBEP), de favorecer a disseminação de tecnologias de energia renovável, inclusive biocombustíveis;

   

Reconhecendo a importância dos 24 indicadores voluntários de sustentabilidade para bioenergia aprovados pela GBEP como ferramenta para auxiliar o desenvolvimento de políticas e programas nacionais de bioenergia;

   

Considerando o potencial estruturante da produção sustentável de bioenergia, especialmente em países em desenvolvimento, e seus benefícios para o desenvolvimento socioeconômico;

   

Chegaram ao seguinte entendimento:

   

Artigo 1

 

Diálogo sobre Políticas

   

Os Participantes pretendem estabelecer um diálogo sobre políticas para bioenergia como forma de estreitar vínculos e tratar de questões de interesse mútuo tais como:

   

a) intercâmbio de informações sobre produção e uso sustentáveis de energia a partir de fontes renováveis, incluindo biomassa, e outras áreas de interesse relacionadas;

   

b) cooperação para promover a aplicação de tecnologias na área de bioenergia, incluindo biocombustíveis;

 

c) cooperação para promover uso de biomassa para produção de eletricidade;

   

d) cooperação com vistas ao estabelecimento de um mercado mundial para biocombustíveis e tecnologias relacionadas; e

   

e) promoção de padrões e normas globais harmonizados para biocombustíveis em foros pertinentes.

     

Artigo 2

 

Cooperação em Terceiros Países

   

Com vistas a promover a produção e a utilização sustentável de energia renovável internacionalmente, os Participantes pretendem:

   

a) identificar oportunidades para auxiliar países em desenvolvimento no estabelecimento de marco regulatório para a promoção de energia renovável, incluindo produção e uso de biocombustíveis;

   

b) cooperar com organizações multilaterais pertinentes e bancos de desenvolvimento para canalizar recursos novos e adicionais para a promoção de opções de energias renováveis em países em desenvolvimento;

   

c) promover a realização de estudos de viabilidade para a produção sustentável de bioenergia em países em desenvolvimento, especialmente na África;

   

d) elaborar, conjuntamente, projetos de cooperação técnica para capacitar recursos humanos do setor de biocombustíveis e de co-geração.

     

Artigo 3

 

Comitê Gestor

   

1. Os Participantes concordam em estabelecer um Comitê Gestor, integrado por representantes de alto nível de cada Governo, ou seus representantes, para conduzir a implementação das atividades realizadas no âmbito deste Memorando de Entendimento.

   

2. As instituições designadas para participar do Comitê Gestor serão:

   

a) pelo lado brasileiro, o Ministério das Relações Exteriores e o Ministério de Minas e Energia;

   

b) pelo lado italiano, o Ministério do Meio Ambiente, Terra e Mar, bem como as agências vinculadas.

   

3. O Comitê Gestor pode convidar representantes do setor privado, acadêmico e de organizações não-governamentais e outras instituições, conforme apropriado, e como parceiros na implementação das atividades ao amparo deste Memorando de Entendimento.

   

4. Reuniões do Comitê Gestor deverão ser realizadas, em princípio, anualmente, alternadamente no Brasil e na Itália, conforme mutuamente acordado.

     

Artigo 4

 

Propriedade Intelectual

   

1. Em conformidade com as respectivas legislações e os acordos internacionais em vigor, as Partes adotarão as medidas adequadas para proteger os direitos de propriedade intelectual resultantes da implementação do presente Memorando de Entendimento.

   

2. As condições para aquisição, manutenção e exploração comercial dos direitos de propriedade intelectual sobre possíveis produtos e/ou processos obtidos em decorrência do presente Memorando de Entendimento serão definidas em projetos, contratos ou programas de trabalho específicos.

   

3. Os projetos, contratos ou programas de trabalho específicos determinarão igualmente as condições de confidencialidade de informações cuja revelação e/ou divulgação possam pôr em risco a aquisição, a manutenção e a exploração comercial dos direitos de propriedade intelectual sobre possíveis produtos e/ou processos obtidos em decorrência do presente Memorando de Entendimento.

   

4. Os projetos, contratos ou programas de trabalho estabelecerão, se aplicável, as regras e procedimentos concernentes à solução de controvérsias em matéria de propriedade intelectual.

     

Artigo 5

 

Custos de Implementação

   

1. Custos relacionados às atividades sob este Memorando de Entendimento estão sujeitos à disponibilidade de fundos apropriados, em conformidade com as disposições orçamentárias e as leis relevantes de cada Participante.

   

2. A implementação de cada atividade particular sob este Memorando de Entendimento requererá que os Participantes definam por escrito os termos e condições para o financiamento necessário, de acordo com a legislação nacional relevante de cada Participante.

     

Artigo 6

 

Emendas

   

Este Memorando de Entendimento poderá ser emendado a qualquer tempo, pelo mesmo procedimento indicado no Artigo 8(1).

     

Artigo 7

 

Controvérsias

   

Qualquer controvérsia relacionada à interpretação ou à implementação deste Memorando de Entendimento será resolvida por meio de consultas entre as Partes.

     

Artigo 8

 

Efeitos, Validade e Denúncia

   

1. O presente Memorando de Entendimento terá efeito mediante notificação pelos Participantes, por via diplomática, do cumprimento dos requisitos legais para a sua entrada em vigor. Este Memorando de Entendimento permanecerá em válido por dois (2) anos, automaticamente renováveis por períodos iguais de dois (2) anos, a menos que um dos Participantes notifique o outro, pela via diplomática, de sua decisão de terminar o MdE, pelo menos 3 (três) meses antes da data da sua renovação.

   

2. O término do presente Memorando de Entendimento não afetará as atividades em execução.

   

Feito no Rio de Janeiro, em 21 de junho de 2012, em dois originais, nos idiomas português e inglês, senda todos os textos igualmente autênticos. Em caso de divergência de interpretação, prevalecerá o texto em inglês.

MEMORANDUM OF UNDERSTANDING BETWEEN

 

THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL

 

AND THE GOVERNMENT OF THE ITALIAN REPUBLIC

 

ON BIOENERGY COOPERATION

   

The Government of the Federative Republic of Brazil

   

and

   

The Government of the Italian Republic

   

(hereinafter referred to as the "Participants");

   

BASED on the Memorandum of Understanding for the implementation of Cooperation Activities in Third Countries, signed on March 27, 2007;

   

INSPIRED by the dispositions established in the Action Plan of the Strategic Partnership between Italy and Brazil , signed on April 12, 2010;

   

RECALLING the environmental cooperation agreement between Italy and Brazil, signed on December 16 2004, aimed to the development of joint programs and projects in the framework of the United Nations Framework Convention on Climate Change and of the Kyoto Protocol;

   

CONSIDERING the strategic role of renewable energy, including bioenergy, in addressing current global challenges such as climate change and sustainable development needs;

   

REITERATING their commitment, as co-chairs of the Global Bioenergy Partnership (GBEP), to help the dissemination of renewable energy technology, including biofuels;

   

RECOGNIZING the importance of the 24 voluntary sustainability indicators for bioenergy endorsed by GBEP as a resource to assist the development of national policies and programs for bioenergy;

   

CONSIDERING the structuring potential of the sustainable production of bioenergy, specially in developing countries, and its benefits for socioeconomic development;

   

Have reached the following understanding:

     

Article 1

 

Policy Dialogue

   

The Participants intend to establish an energy policy dialogue as a way to build closer ties and address questions of mutual interest such as:

   

a) information exchange on the sustainable production and use of energy from renewable sources, including biomass, and related areas of interest;

   

b) cooperation to promote the deployment of bioenergy technologies, including biofuels;

   

c) cooperation to promote the use of biomass to produce electricity;

   

d) cooperation towards the establishment of a world market for biofuels and related technologies;

   

e) promotion of global harmonized standards and codes for biofuels in relevant fora.

     

Article 2

 

Cooperation in Third Countries

   

With a view to foster the deployment of renewable energy internationally, the Participants intend to:

   

a) identify opportunities to assist developing countries in the establishment of a regulatory framework to promote renewable energy, including biofuels production and use;

   

b) cooperate with relevant multilateral organizations and development banks to channel new and additional resources to promote renewable energy options in developing countries;

   

c) promote the execution of feasibility studies for the sustainable production of bioenergy in developing countries, particularly in Africa ;

   

d) to jointly develop technical cooperation projects for capacity building in the biofuels sector and cogeneration.

     

Article 3

 

Steering Committee

   

1. The Participants agree to establish a Steering Committee, consisting of high-level representatives of each Government, or their designees, to guide the implementation of the activities undertaken under this Memorandum of Understanding.

   

2. The appointed institutions to participate in the Steering Committee shall be:

   

a) On the Brazilian side: the Ministry of External Relations and the Ministry of Mines and Energy;

   

b) On the Italian side: The Ministry for the Environment, Land and Sea, as well as its concerned agencies.

   

3. The Steering Committee can invite representatives from the business sector, academia, non-governmental organizations, and other entities as deemed appropriate, and as partners in implementing the activities under this MoU.

   

4. Meetings of the Steering Committee should be held, in principle, once a year, alternately in Brazil and Italy , as per mutual agreement.

     

Article 4

 

Intellectual Property

   

1. In accordance with their respective laws and international agreements in force, the Parties will take appropriate measures to protect intellectual property rights resulting from the implementation of this Memorandum of Understanding.

   

2. The conditions for the acquisition, maintenance and commercial exploitation of intellectual property rights of potential products and/or processes obtained as a result of this Memorandum of Understanding will be defined in projects, contracts or specific work programs.

   

3. The projects, contracts and specific work programs will also determine the conditions of confidentiality of information of which the disclosure or dissemination may jeopardize the acquisition, maintenance and commercial exploitation of intellectual property rights of potential products and/or processes obtained as a result of this Memorandum of Understanding.

   

4. The projects, contracts and work programs will establish, if applicable, the rules and procedures regarding the settlement of intellectual property disputes.

     

Article 5

 

Implementation Costs

   

1. Costs related to the activities under this Memorandum of Understanding are subject to the availability of appropriate funds, in conformity with budgetary provisions and the relevant laws of each Participant.

   

2. The implementation of each particular activity under this Memorandum of Understanding will require that the Participants put into writing the terms and conditions for the necessary funding, in accordance with each Participant relevant national legislation.

     

Article 6

 

Amendment

   

This Memorandum of Understanding may be amended at any time by the same procedure described in Article 8(1).

     

Article 7

 

Disputes

   

Any dispute about the interpretation or implementation of this Memorandum of Understanding will be resolved through consultation between the Participants.

     

Article 8

 

Effective Date, Validity and Termination

   

1. This Memorandum of Understanding shall come into effect upon notification by the Participants through diplomatic channels, once their respective internal legal procedures have been fulfilled. This Memorandum of Understanding shall be valid for two (2) years, automatically renewed for equal periods of two (2) years, unless one of the Participants notify the other, through diplomatic channels, of its decision to terminate it given a three-month notice prior to the date of renewal.

 

2. Termination of this MoU will not affect activities already under implementation.

   

Done at Rio de Janeiro , on June 21st, 2012, in two originals, in the Portuguese and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.
