Do I need probate for a small estate?
If the estate is of a certain size, and in solely the deceased’s name, you might be able to go through a smaller procedure, this is known as the Small Estate Procedure. These procedures save money, time and are an alternative to applying for probate. This is because there is a lot less paperwork, and therefore its less time-consuming leaving a lot less delay. In most cases, if the deceased owned property solely, it must go through the full probate process in order to transfer the property to anyone else. If however a property is jointly owned, it passes automatically to the survivor and probate would not be required to transfer the property.
What happens if you don’t do probate?
It depends on what type of property and assets the deceased owned and or if they had debts. If you are a close relative of the deceased i.e child or spouse and probate is not required to deal with the estate then there is not generally a problem, most distant relatives may have problems from other family members if they do not go through the process. However, not all the assets go through probate. For example, jointly owned assets that transfer to the surviving owner, or if the deceased has any assets that are in a trust these also might avoid having to go through probate. Note however if probate has to applied for then all assets are taken into account including jointly owned assets and some assets which are held in trust depending on when they were given away to trust and whether the deceased retained a benefit.

So I'm wandering through the garden center's four acres of luscious plants, feeling a bit guilty as I was just taking photos and not planning to buy anything, when a woman approached me and asked, "Why don't you buy something, instead of just taking pictures?"
