A Special CBI Court today passed a life sentence on Bihar school teacher Rupam Pathak, holding her guilty of culpable homicide of Bihars Purnea MLA from BJP Raj Kishor Kesri. This sentence is a gross miscarriage of justice, exposing the gender bias in a range of institutions and the hollowness of the Bihar Governments claims of empowerment of women. .

The Bihar CM was forced to order a CBI enquiry into the Rupam Pathak case precisely because of public protests against the Bihar Governments attempts to smear Rupam Pathaks character and suppress the history of her complaints of rape and sexual harassment against the BJP MLA Kesri and his aide BN Rai. But the CBI enquiry has merely probed the killing of Kesri, and has failed to investigate Rupam Pathaks complaint of sexual harassment. Not only that, BN Rai was not even arrested allowing him to be free to influence and threaten witnesses. While rape-accused BN Rai remained free, Rupam Pathak herself was denied bail, and prevented from having any opportunity to clear her name! .

What led a young school teacher to publicly stab an MLA of a ruling party, in full view, in his own home? Rupams long-standing complaint of rape and sexual harassment by Kesri and his aide BN Rai had been ignored by the Bihar police and ruling political establishment of which Kesri was a powerful and pampered leader. Seeing no hope of justice, Rupam, a 35-year old school teacher, was pushed to take the desperate step of attacking Kesri in his own house. .

After the incident, Deputy CM of Bihar, Sushil Kumar Modi, was quick to declare that Rupam Pathak was a blackmailer and murderess, while Kesri was a man of pure character and a hero of the 1974 movement. Opposition leaders like Laloo Prasad too echoed the same. But when AIPWA and other womens groups in Bihar took up the matter, they found that Rupam Pathak had accused the MLA and his aide BN Rai of rape and sexual harassment some months before the killing, but had mysteriously withdrawn her case on the eve of the Assembly elections. What pressures forced her to do so? The CBI has failed to investigate these questions, and has also ignored Rupams complaint against BN Rai. .

The Rupam verdict also raises other questions. We have, time and again, come across cases where killings by men get relatively lenient sentences on the ground that these are crimes of passion. Stabbing cases in street brawls resulting in deaths usually carry light sentences. Why, then, has Rupam been awarded an extremely harsh life sentence, completely failing to take into account the extreme provocation and desperation she felt, due to the faint prospect of any justice against her powerful rapists and sexual harassers? Is this not an instance of blatant gender bias? .

In the landmark Kiranjit Ahluwalia case of London, a woman victim of domestic violence took her husbands life, and received a harsh life sentence. But eventually, thanks to the efforts of womens groups, the sentence was relaxed, and domestic violence was recognised in future as an instance of extreme provocation. The Rupam Pathak case ought to be a similar instance in Indian jurisprudence, where acts of desperate violence by women who have been subjected to sexual violence ought to be seen as the result of the failure of our systems to provide a credible prospect of justice for women in cases of sexual violence. This ought to hold true specially in cases of repeated and prolonged sexual abuse or harassment, where attempts to secure justice through the police have been subverted or crushed. .

Even now, why is it that the rulers of Bihar, the police, as well as even the CBI and the court, are so eager to consign Rupam to jail, at the same time suppressing her accusations of rape and sexual harassment because they threaten the image of the ruling political alliance? .

We must demand bail and justice for Rupam Pathak, and a re-investigation by the CBI into the whole case, especially into Rupam Pathaks complaints of sexual violence, and the immediate arrest of BN Rai. .

When corporations subvert democracy .

July 2010 --Liberation --The June 7 verdict by the Bhopal court sets a precedent for the worst of corporate crimes --and even nuclear disasters too --to be treated like a traffic accident. Bhopals verdict was constrained because of the order of Justice Ahmadi Bench of the Supreme Court dated September 13, 1996, in which the charges against Indian officials of Union Carbide India Limited (the subsidiary majority owned by Union Carbide Corporation) were diluted. Since February 2001, the culpability lies with the Dow Chemical Company, which took over Union Carbide Corporation USA. .

All the seven convicted in the Bhopal gas tragedy have been sentenced to two years in jail and a fine of Rs1 lakh (100,000) each and got bail for a surety of Rs 25,000 each. Union Carbides subsidiary in India has been found guilty and fined to the order of Rs500,000 for the industrial disaster. All the officials accused in the Bhopal catastrophe, including Keshub Mahindra, the former chair of Union Carbide India Ltd and current chair of Mahindra & Mahindra Company, have been let off lightly for the disaster that happened during his tenure. They were found guilty under Sections 304-A (causing death by negligence), 336, 337 and 338 (gross negligence) of the Indian Penal Code instead of 304-II (culpable homicide not amounting to murder). .

What is quite clear from the verdict is that generations to come will view Supreme Courts act of reducing the charge against Union Carbide Corporation officials in 1996 from manslaughter (which is punishable with imprisonment up to 10 years) to death caused by a rash or negligent act (carrying a maximum penalty of two years) with deep suspicion that belittles its moral stature. .

As early as in 1973, Carbide CEO Warren Anderson was aware of the flaws of the Bhopal plant untested technology, faulty design and its unsafe location and operation. In December 1987, the Central Bureau of Investigation filed criminal charges of culpable homicide against 10 officials, including Union Carbide Companys president Warren Anderson. Why was this charge diluted? Anderson was the chairperson and CEO of Union Carbide Company when the lethal methyl isocyanate (MIC) leaked from a pesticide plant of the companys Indian subsidiary on December 2-3, 1984. Anderson was arrested and then released on bail by the Madhya Pradesh police on December 7, 1984, and left for US even as victims continued to suffer because of the industrial disaster. Anderson, who lives in New York, served as Union Carbide CEO until his 1986 retirement. .

In 1992, Anderson was declared a fugitive by the Bhopal court for failing to appear for hearings in a case of culpable homicide after his case was separated from the case in which eight people employed by Union Carbide were convicted. In July 2009, an arrest warrant was issued for him. The government of India took some 19 years to move a formal request for his extradition in May 2003 but the US rejected Indias request for the extradition of Anderson in June 2004 saying the request did not meet requirements of certain provisions of the bilateral extradition treaty. .

The sense of urgency with which the congress led UPA government moved to get the Bihar Assembly .

dissolved is yet another glaring testimony to the frequent misuse of Article 356 by the willful dispensation at the .

centre and deserves to be condemned in most vociferous terms. The assembly was dissolved when Mr. Buta .

Singh failed to install a government of his choice and could not usher truce between the warring cabinet .

ministers Paswan and Laloo who were up in arms in a cowboyish political one-upmanship. All .

possibilities should have been explored for government formation (as required after elections). But Mr. .

Buta Singh dissolved the assembly in the night itself even before the NDA, which was closing in with .

majority, could stake claim. Elections entail huge expenditure and re-election within two months of the last .

election will take its toll on the economy of Bihar which is already in shambles. .

The dissolution of the Assembly is a cruel rebuff to the aspirations of the people of Bihar who crave for .

progress and development and who had been condemned for the last 15 years to reel and wail under the reign of .

terror of the RJD government supported by the Congress and the communists. The elections in Bihar threw up .

massive Anti-Laloo mandate but the congress, with its henchman Mr. Buta Singh, left no stone unturned to .

subvert democracy and reverse the mandate and saddle the people of Bihar again with the Jungle Raj of RJD. .

The dissolution of the Assembly has come as breather for Laloo and during the upcoming re-elections (which must take place within the next 6 months) and a desperate Laloo, in connivance with the congress and the communists, will go all out with his bullets and bullies to regain power and large scale rigging cannot be ruled out. Interestingly, the UPA has been uncannily and unwittingly committing these constitutional grafts during night. Pratap Singh Rane was hurriedly sworn-in as the CM of Goa in the dead of night. And the decision to dissolve the Bihar Assembly was arrived at the unearthly hours of may 22nd by misleading the President when he was away in Moscow. When the world sleeps, the congress rises to thieve away democracy in bundle it away to Rome in a cruel 'TWIST WITH DESTINY'. .

The Sadistic, communist power braking cartel is gloating over the subversion of democracy and the accusation of the so called horse trading is a fayade ~ehind which the uncouth and totalitarian congress and communists are trying to cover up and legitimise their criminality which they have perpetrated in Bihar. .

The decision of dissolving the Bihar Assembly has given credence to the belief that congress, with full support from the opportunist communist demagogues, has successfully throttled the due constitutional process of government formation by taking recourse to the criminal minded stooge it has appointed to gubernatorial position in Bihar. The congress led UPA government, ever since it came into being, has been striking at the foundations of democr~tic institutions leading to the erosion of faith in democracy. The UPA government has been targeting the state governments that are being run by the central opposition, starting with the uncouth, unwarranted, unconstitutional and perverted replacing of governors, going on to the insidious and clinical attempts to destabilise the state governments of Gujrat, Chhatisgarh, Jharkhand and Goa, and finally and most disgracefully Bihar where Mr. Buta Singh and his family, having failed to cobble up a government under RJD, dissolved the assembly in a bid to preempt any rightful attempt of constitutional process of government formation by NDA. .

The UPA clearly has lost its way what with its allies pulling in different directions, and in the absence of any positive programme and agenda, the only premise on which the UPA continues to rule is its Anti-NDA stance. The congress is ruthlessly trying to rebuild their monopoly on political spectrum and drive home the message that any attempt to create a space of opposition to its autocratic policies would be met with defeat. The congress in connivance with the communists are trying to usher in nee-emergency situations, inspired as they seem to be from the rnost horrid and darkest period of Independent India. But the nationalists and democratic minded people of this country will not allow the nightmarish scenarios of 1977, 1984 to be recreated and have free re-runs. Ironically, at a time when the anti·national communist stooges of Cilina and Russia cry foul of Vande Mataram, they have no qualms whatsoever to sing VANDE·MATA-ROME and help congress in pushing the country into political chaos. .

The congress must remember that no political party in the history of the world, has been able to rule till eternity, and if the subsequent governments start replicating the same trends, democracy will die an untimely and unfortunate death for which only the congress and the communist would be culpable. .

On Nandigram Incidents .

14 people have died in Nandigram due to the confrontation between the police and violent agitators. One person (out of 14) died because a bomb that he was trying to throw at the police burst in his hands. .

The police firing is highly unfortunate and deplorable because poor people have lost their lives. It is particularly disturbing because it has happened under the Left Front Government, which is committed to the cause of the working people, particularly the rural poor. The Left Front Government in West Bengal must take immediate steps to ensure the restoration of peace and normalcy in Nandigram. The Left Front Government must also ensure that such incidents of police firing do not occur in future. .

The police firing on 14th March is regrettable, but the culpability of the opposition parties in West Bengal, namely the Trinamool Congress, the BJP, the Congress, SUCI and naxalites cannot be overlooked. The issue of land acquisition had been settled when the Chief Minister of West Bengal announced on 3rd February 2007 that no land would be acquired in Nandigram. Since then he has repeated that announcement several times, which has been widely reported in the media. Several all-Party meetings were convened both at the district as well as the state level to discuss and resolve the issue. The opposition deliberately stayed away, because they wanted the situation to precipitate. This is a hallmark of right-reactionary politics (which the ultra-Left also practices); to create, justify and encourage a situation of lawlessness, provoke reaction by the state machinery and then indulge in cheap and destructive politics over dead bodies to perpetuate the cycle of violence and counter-violence. .

Condemning the police action in Nandigram without for once criticizing the total anarchy and lawlessness deliberately created by the entire opposition under the leadership of the Trinamul Congress and others, will not serve the cause of restoring normalcy in Nandigram. Over 2500 Left sympathisers, all poor villagers, have been staying in makeshift relief camps over the past two and a half months since they were forcibly evicted from the villages. The area was declared out of bounds for the district administration and all communication links and roads were cut off. This was surely not a democratic form of protest. Moreover, the demand on the basis of which the protest had started was accepted by the State Government a month ago. What was continuing in Nandigram after the CM's announcement was a violent spectacle aimed not at resolution but at confrontation. A police person was lynched inside Nandigram a few days ago. Houses of Left supporters were torched. There was an incident of murder of a young girl followed by gang rape of another woman. In none of these cases was the police allowed to enter the villages and investigate the crimes. No democratically elected Government can allow such absolute anarchy and lawlessness to continue. The degree or intensity of police action can of course be questioned and any loss of life is avoidable. However, if one chooses to look at the case from an objective point of view, the Government could not have remained a silent spectator to the precipitating violence in Nandigram and was compelled to act by an irresponsible, confrontationist and violent opposition. .

SFI appeals to the progressive and democratic minded students to take a reasoned view of the two and a half month long series of incidents in Nandigram and rebuff the concerted campaign launched by the anti-Communist gang up from the ultra-right to the ultra-left aided by sections of the media. .

SFI condemns the Naxallte attack on a police post in Chattlsgarh where more than 50 police personnel were killed by the Maoists. This kind of mindless violence serves no purpose other than claiming lives and alienating common people. The violent Maoists of our country, who have learnt no lesson of democracy from their Nepalese comrades, need to be thoroughly isolated. .
