The policy of the Central Government was to encourage and enable the establishment of SEZs in the private or joint sector in association with the States or by their governments themselves. .

Meanwhile, a lot of time was spent in evolving an all-encompassing legislation called the Special Economic Zones Bill, which was introduced in Parliament earlier this year and passed subsequently. The Special Economic Zones Act, 2005, got the Presidential imprimatur in June. The Act, however, is yet to be notified, even though there has been a tremendous surge in interest for the launch of SEZs, as is evident from the growing number of big industrial houses applying to the Board of Approval for putting up SEZs in many areas. .

Indias SEZs are no patch on their massive Chinese counterparts for a host of reasons. Partly, it is because China divided each region into an SEZ and granted preferential treatment to foreign ventures that enabled high-cost industrialised countries to use it as an attractive outsourcing platform for manufacturing activities. Though India has, of late, emerged as the preferred destination for back-office business process outsourcing in IT and software industry, it is way behind China as an emerging outsourcing platform for manufacturing activities. .

It is against this harsh reality that the new-fangled idea of SEZs could make a modest start in showcasing India's manufacturing prowess, attract foreign direct investment (FDI) and facilitate domestic manufacturers to make a foray into SEZs. .

To clarify issues on the SEZs, Business Line spoke to Mr Lalit B. Singhal, Director-General of the Export Promotion Council for EoUs (export-oriented units) and SEZ units (EPCES). Mr Singhal was earlier Joint Director-General of Foreign Trade (DGFT). He was conversant with trade policy making for a number of years before joining the newly created EPCES. .

The original SEZ concept was floated in the 2000 Exim Policy, and the SEZ Bill was introduced and passed in Parliament only in mid-2005. In the intervening period, so many changes impacting India's foreign trade have happened. What is the rationale for the SEZs, what are their objectives and how far will the proposed Act boost exports? .

The concept of export processing zones was introduced in 1965, much before the advent of the SEZ Act, in 2005. Major objectives of the SEZ Act include generation of additional economic activity, promotion of export of goods and services, as also investment from domestic and foreign sources and creation of employment opportunities. .

NEW DELHI: India should retain all options in the education sector to be exercised at a ``suitable time.'' There should neither be any haste in opening it to foreign participation under a multilateral regime without adequate safeguards nor should the sector be used as a bargaining chip for obtaining gains in other sector. These are the broad conclusions of a policy paper prepared and likely to be circulated by the Human Resource Ministry on the issue to Foreign Direct Investment (FDI) in higher education. .

The paper, prepared by the Higher Education Bureau of the Ministry, dismisses the commercial trade-based approach of the Commerce Ministry which had "restricted itself to a narrow, middle class Business Process Outsourcing (BPO)-IT perspective.'' .

Skill shortage .

The likely skill shortage, the so-called Mckinsey's missing millions, account for no more than 0.5 million by 2010 a miniscule figure considering India's annual higher education enrolment figures of over 10 million annually, sources in the HRD Ministry point out. .

Opening up the entire education sector merely to provide soft skill to BPO training to some 0.5 million city graduates would mean barking up the wrong tree. .

Problems of contradiction .

On the other side, opening up would also lead to real problems of contradiction of access and increased dualities between the richer and poor sections of society, the paper says. .

Further, increased investment alone will not be able to resolve issues of quality. A sound, effective and transparent regulatory regime is required to eliminate distortions, encourage competition and quality, penalise profit-skimmers and enforce transparency, according to the paper. .

The paper calls for better regulation of private capital as a necessary step before any liberalisation in FDI. .

It also calls for an alternative reform agenda in terms of State-led inclusive growth with a long-term vision of generation of knowledge through liberal funding of the research and for a number of .

The objective in regard o mode 3 i.e. "commercial presence" category of service providers, which is a euphemism for FDI in service sector, is now clearly stated as : "Commitments on enhanced levels of foreign equity participation; removal or substantial reduction of economic needs test; commitments allowing greater flexibility on the types of legal entity permitted." The objectives of the multilateral investment regime which developed countries had pushed earlier on from Singapore Conference in 1997 and given up in the aftermath of Cancun, have surfaced now in this form. And this time, with active support and collaboration of India. The other such issue is government procurement. This too has made its re-entry through GATS. The declaration enjoins the member countries to engage in "more focused discussions" on the subject. The gains of Cancun have thus been frittered away. .

The members are also mandated to develop discipline on domestic regulation pursuant to Article IV:4 of GATS. This is explicitly intended to circumscribe and erode the authority of the nation-states to regulate the service sector in the national interest to further national policy objectives. .

The structural flexibility of GATS which was won after a hard struggle in the Uruguay Round has also been reduced by introducing an element of compulsion in regard to participation in plurilateral negotiations."
