This is not a political documentary.
It is a crime story.
No matter what your politics, "Enron: The Smartest Guys in the Room" will make you mad. It tells the story of how Enron rose to become the seventh largest corporation in America with what was essentially a Ponzi scheme, and in its last days looted the retirement funds of its employees to buy a little more time.
There is a general impression that Enron was a good corporation that went bad. The movie argues that it was a con game almost from the start. It was "the best energy company in the world," according to its top executives Kenneth Lay and Jeffrey Skilling. At the time they made that claim, they must have known that the company was bankrupt, had been worthless for years, had inflated its profits and concealed its losses through bookkeeping practices so corrupt that the venerable Arthur Anderson accounting firm was destroyed in the aftermath.
The film shows how it happened. To keep its stock price climbing, Enron created good quarterly returns out of thin air. One accounting tactic was called "mark to market," which meant if Enron began a venture that might make $50 million 10 years from now, it could claim the $50 million as current income. In an astonishing in-house video made for employees, Skilling stars in a skit that satirizes "HFV" accounting, which he explains stands for "Hypothetical Future Value." Little did employees suspect that was more or less what the company was counting on.
Skilling and Lay were less than circumspect at times. When a New York market analyst questions Enron's profit and loss statements during a conference call, Skilling can't answer and calls him an "a-hole;" that causes bad buzz on the street. During a Q&A session with employees, Lay actually reads this question from the floor: "Are you on crack? If you are that might explain a lot of things. If you aren't, maybe you should be."
One Enron tactic was to create phony offshore corporate shells and move their losses to those companies, which were off the books. We're shown a schematic diagram tracing the movement of debt to such Enron entities. Two of the companies are named "M. Smart" and "M. Yass." These "companies" were named with a reckless hubris: One stood for "Maxwell Smart" and the other one ... well, take out the period and put a space between "y" and "a."
What did Enron buy and sell, actually? Electricity? Natural gas? It was hard to say. The corporation basically created a market in energy, gambled in it and manipulated it. It moved on into other futures markets, even seriously considering "trading weather." At one point, we learn, its gambling traders lost the entire company in bad trades, and covered their losses by hiding the news and producing phony profit reports that drove the share price even higher. In hindsight, Enron was a corporation devoted to maintaining a high share price at any cost. That was its real product.
The documentary is based on the best-selling book of the same title, co-written by Fortune magazine's Bethany McLean and Peter Elkind. It is assembled out of a wealth of documentary and video footage, narrated by Peter Coyote, from testimony at congressional hearings, and from interviews with such figures as disillusioned Enron exec Mike Muckleroy and whistle-blower Sherron Watkins. It is best when it sticks to fact, shakier when it goes for visual effects and heavy irony.
It was McLean who started the house of cards tumbling down with an innocent question about Enron's quarterly statements, which did not ever seem to add up. The movie uses in-house video made by Enron itself to show Lay and Skilling optimistically addressing employees and shareholders at a time when Skilling in particular was coming apart at the seams. Toward the end, he sells $200 million in his own Enron stock while encouraging Enron employees to invest their 401K retirement plans in the company. Then he suddenly resigns, but not quickly enough to escape Enron's collapse not long after. Televised taking the perp walk in handcuffs, both he and Lay face criminal trials in Texas.
The most shocking material in the film involves the fact that Enron cynically and knowingly created the phony California energy crisis. There was never a shortage of power in California. Using tape recordings of Enron traders on the phone with California power plants, the film chillingly overhears them asking plant managers to "get a little creative" in shutting down plants for "repairs." Between 30 percent and 50 percent of California's energy industry was shut down by Enron a great deal of the time, and up to 76 percent at one point, as the company drove the price of electricity higher by nine times.
We hear Enron traders laughing about "Grandma Millie," a hypothetical victim of the rolling blackouts, and boasting about the millions they made for Enron. As the company goes belly up, 20,000 employees are fired. Their pensions are gone, their stock worthless. The usual widows and orphans are victimized. A power company lineman in Portland, who worked for the same utility all his life, observes that his retirement fund was worth $248,000 before Enron bought the utility and looted it, investing its retirement funds in Enron stock. Now, he says, his retirement fund is worth about $1,200.
Strange, that there has not been more anger over the Enron scandals. The cost was incalculable, not only in lives lost during the power crisis, but in treasure: The state of California is suing for $6 billion in refunds for energy overcharges collected during the phony crisis. If the crisis had been created by Al Qaeda, if terrorists had shut down half of California's power plants, consider how we would regard these same events. Yet the crisis, made possible because of deregulation engineered by Enron's lobbyists, is still being blamed on "too much regulation." If there was ever a corporation that needed more regulation, that corporation was Enron.
Early in the film, there's a striking image. We see a vast empty room, with rows of what look like abandoned lunchroom tables. Then we see the room when it was Enron's main trading floor, with countless computer monitors on the tables and hundreds of traders on the phones. Two vast staircases sweep up from either side of the trading floor to the aeries of Lay and Skilling, whose palatial offices overlook the traders. They look like the Stairway to Heaven in that old David Niven movie, but at the end they only led down, down, down.

The Story
The company closed its doors in the middle of the night without even letting the workers know, they came to work and were locked out unable to even retrieve their belongings.
The remains were auctioned off, lockers still have clothes in them.. pretty sad when you work for a place for years only to get a big slap in the face for your efforts.
Ever wonder where the sense of pride and dedication to the workplace went? Walk through a place like this and you'll be reminded pretty quick.
It seems as well, that the employees were stiffed for more than $700,000 back pay and vacation pay medical bills and their 401k.
To make matters worse, Sunset Bank Dragged them through a bureaucratic mess for more than a year forcing some employees to face personal bankruptcy.
In the end, the owner was indicted in 10 counts of theft, fraud, robbing the 401k fund and other acts of pure greed, he received 7.5years in prison and left behind many lives devastated.

Once-upon-a-time two litle girls named Christina and Jackie stumbled upon the cave of the three gnomes.
"Do you grant wishes?" Christina asked.
"Do you see plasma tv here? Do you see porsche parked outside? Do you see any six foot tall models bringing me beer? If I could grant wishes do you think I'd be living in a cave with these two guys?" responded one of the gnomes.
"Don't pay any attention to him." said the second gnome, "He's grumpy right now because he just wrote a check to his ex-wife."
"He's always grumpy." said the third gnome, rolling his eyes, "Why do you think his wife left him in the first place?"
"If you don't grant wishes, then what do you do?" asked Jackie.
The first gnome responded "We give words of wisdom to young ones like yourself. Would you like some words of wisdom?" Christina and Jackie nodded their heads.
"First off any investment that depends on your recruiting more members is a scam. Second, stick to index funds and third check your fiancee's credit score before you get married and your 401K won't be in the mess that mine is now." said the first gnome. "Oh and check your fiancee's bloodwork too. That could save you a couple of nights sitting on the pot with a full bladder afraid to pee because it burns."
"Nevermind all that," said the second gnome, "the secret to happiness is..."
"What the %$#@ do you know about happiness!" interrupted the first gnome.
"I think someone better start smoking again or he's going to have to find another cave to live in." said the third gnome.
Christina and Jackie walked away as the three gnomes continued arguing. "Do you think we'll ever find the secret of happiness?" asked Jackie?
"I think it probably has something to do with not living in a cave with three little gnomes" replied Christina.
Even while she is cheering on her beloved Princeton Tigers football team behind her as they played Harvard, she is very concerned about her future; she is afraid her 401K portfolio will be managed by a Yale graduate.

Had lunch with Flynn today, my former college roommate and longest chronological friendship--we go back, way back to fourth grade. Two just-turned-fifty guys swimming in nostalgia over a hot lunch and cold iced tea.
Of course, we talk about the past--Springsteen's Glory Days, of sorts. The people we knew, the things that we've experienced, and the people that are only ghosts in the present, fading from the tapestry of life like an old sun-bleached postcard. Of course, we talk about the joys (and, what's the opposite of joy?) of getting older, grayer, slower, wiser. Grown children in college, the prospect of retirement on the distant horizon, importance of colonoscopies and cancer screening, and the heart-wrenching sorrow of euthanizing a beloved furry family pet. Yep, that's what old guys talk about: it's not about girls in bikinis or mai tais on the beach, not anymore.
On the way home, I detour through the cemetery. Chicken bacon ranch salad digesting in a pool of coffee and stomach acid. Weather-worn stones from the 1800s convey many short lifespans, in some instances of only 13 or 29 years, and I'm having a reaction to such a temporal existence. I'm feeling mortal, fragile, temporary; that's just the headspace I'm in today. In a corner of the small lot, I locate the grave marker for the UNKNOWN COLORED CIVIL WAR SOLDIER: nondescript, flat on the earth, fake plastic flowers adjacent. Sadness for the forgotten, sorrow for the unknown.
Is it more than anything a desire to not be unknown? Maybe that's what we all want. Maybe that's what I want: to not be unknown to my friends, family, children; to have my dreams, hopes, and fears articulated to those who matter most? As I get older, having more discussions with peers on 401K retirement strategies, I seem to get more nostalgic and pensive and retrospective. All of these things are not criteria for old-man-syndrome, but part of the nature process of life and just a specific season of life. This sure is a wild ride, this life.

The roadkill diverted his attention as he passed. From just a glimpse, his mind filled in every detail. It was a dog, clean, well cared for, someone’s pet. Its eyes were frozen open, bearing a somewhat worried expression, but no understanding of what had happened. Its legs were spread in front of it, dead and stiff, as if in a final last ditch effort to leap out of the way. It had been close, the front half of the dog had, in fact, made it safely across the freeway. Unfortunately, the back half had not. The expression on the dog’s face stuck in his memory. He looked around at the other traffic feeling a sort of kinship with the other drivers. Weren’t they all just trying to get to their destinations without getting cut down? But it all seemed so random and arbitrary. He had followed the rules. He had the wife and the house and the mortgage and the 2.3 kids in college. He had the 401k and the health insurance. He had played the game and now he saw clearly that it was just a game with rules made up by the winners. Clearly he wasn’t a winner. Like the dog, he had tried and failed. Here he was, 50 years old and unemployed in the worst job market since the Great Depression. His 28 years of service at the company had been mowed down by forces he couldn’t see or understand and he was more than somewhat worried. He was scared. His eyes began to well with tears. He pulled off the road and sat in the car crying.

Sep. 24, 2008 | It's just human nature that some calamities register in the brain and others don't. The train engineer texting at the throttle ("HOW R U? C U L8R") and missing the red light and 25 people die in the crash -- oh God, that is way too real. Everyone has had a moment of supreme stupidity that came close to killing somebody. Even atheists say a little prayer now and then: Dear God, I am an idiot, thank you for protecting my children.
On the other hand, the federal bailout of the financial market (YAWN) is a calamity that people accept as if it were just one more hurricane. An air of crisis, the secretary of the Treasury striding down a hall at the Capitol with minions in his wake, solemn-faced congressmen at the microphones. Something must be done, harrumph harrumph. The Current Occupant pops out of the cuckoo clock and reads a few lines off a piece of paper, pronouncing all the words correctly. And the newscaster looks into the camera and says, "Etaoin shrdlu qwertyuiop." Where is the outrage?
Poor Larry Craig got a truckload of moral condemnation for tapping his wingtips in the men's john, but his party proposes to spend 5 percent of the GDP to buy up bad loans made by men who walk away with their fortunes intact while retirees see their 401K go pffffffff like a defunct air mattress, and it's business as usual. Mr. McCain is a lifelong deregulator and believer in letting brokers and bankers do as they please -- remember Lincoln Savings and Loan and his intervention with federal regulators on behalf of his friend Charles Keating, who then went to prison? Remember Neil Bush, the brother of the C.O., who, as a director of Silverado S&L, bestowed enormous loans on his friends without telling fellow directors that the friends were friends and who, when the loans failed, paid a small fine and went skipping off to other things? Mr. McCain now decries greed on Wall Street and suggests a commission be formed to look into the problem. This is like Casanova coming out for chastity.
Confident men took leave of common sense and bet on the idea of perpetual profit in the real estate market and crashed. But it wasn't their money. It was your money they were messing with. And that's why you need government regulators. Gimlet-eyed men with steel-rim glasses and crepe-soled shoes who check the numbers and have the power to say, "This is a scam and a hustle and either you cease and desist or you spend a few years in a minimum-security federal facility playing backgammon."
The Republican Party used to specialize in gimlet-eyed, steel-rim, crepe-soled common sense and then it was taken over by crooked preachers who demand we trust them because they're packing a Bible and God sent them on a mission to enact lower taxes, less government. Except when things crash, and then government has to pick up the pieces.
Some say the tab might come to a trillion dollars. Nobody knows. And Mr. McCain has not one moment of doubt or regret. He switches from First Deregulation Church to Our Lady of Strict Vigilance like you might go from decaf to latte. Where is the straight talk? Does the man have no conscience?
It wasn't their money they were playing with. It was yours. Where were the cops?
What we are seeing is the stuff of a novel, the public corruption of an American war hero. It is painful. First, there was his exploitation of a symbolic woman, an eager zealot who is so far out of her depth that it isn't funny anymore. Anyone with a heart has to hurt for how Mr. McCain has made a fool of her. Never mind the persistent cheesiness of his attack ads. And now this chasm of debt and loss and the gentleman pretends to be shocked. He was there. He turned out the lights. He sent the regulators home.
Mr. McCain seems willing to say anything, do anything, to get to the White House so he can go to war with Iran. If he needs to recline naked in Macy's window, he would do that, or eat live chickens, or claim to be a reformer. Obviously you can fool a lot of people for awhile and maybe he can stretch it out until mid-November. But the truth is marching on. A few true conservatives are leading a charge against the bailout. Good for them. But how about admitting that their cowboy economic philosophy was at fault here?

When I moved cross country to the Pacific Northwest from Boston I was just turning 30 and reluctantly realizing it was probably time to grow up. A couple of jumbo jets crashed into the twin towers, toppling the world economy and my hopes of making it as a commercial artist down with them. My budding art career dried up overnight. No art directors or publishers called me anymore. Suddenly my part time job as an environmental fundraiser wasn’t going to cut it and it was time to move cross country with a girl I’m incidentally no longer with and to pursue a real job…one with health benefits and a 401k. It was time to take responsibility and live the American Dream in a little cabin on the waterfront right next to her rich parents. Maybe someday we’d have kids and a dog…maybe I’d finally fit in with high society...maybe someday her well to do mother would stop judging me and like the person that I am. This entailed giving up my dreams as an artist…this meant losing my identity as a free thinker, as a rogue…as sort of a bad boy. This is the last painting I did when I lived in Boston and reflects the fear I felt of moving cross country. It tells the story of a guy named Roy…a regular guy living in the conformist 1950’s…a guy with a great job as a bread delivery driver, a guy with a supportive wife, beautiful kids and a little house with a white picket fence to call his own. In spite of having everything a regular guy could ever want, Roy eventually was compelled to rebel against conformity, religion, authority and the forces that caged him within the confines of being a regular guy and nothing more. He became more than happy to burn his perfect little house down in the dead of night and careen his truck off a cliff.
If paintings are like my children, this is my darkest, most brooding child yet. It’s a favorite amongst so many people. Years ago someone offered $6000 for it and I refused as I couldn’t bear to part with my most brooding child…one that reflects so much of my soul. That great job I was pressured to seek out so many years ago…the one with the health benefits and a 401k, like many things in life has ended a few months ago. I was just no longer affordable to keep around so they bid me adieu and sent me off into the world. I believe when one door closes, another opens and I’m trying my hand at being a commercial artist again. To move forward with my new life as an artist, I’m willing to live like one and finally sell off this painting for…as fate would have it…considerably less than the $6000 that was offered years ago. This and my other work will be at Zero Zero Gallery. 1525 Summit Ave. Seattle, WA. The opening is November 8th from 8-1030pm and will mark my reentry into the artist’s world.
