In this picture, we can see some property such as bicycles and tables left on the lawn. The tenants of the property left the home and no longer live here, however, they left a substantial amount of their property both inside and outside the home without the permission of the property owner. We were not able to take pictures of the inside of the home, however there was also significant damage to the home, including water damage.
Legal risks for the former tenants include being sued for the torts of trespass, and negligence. This could qualify as trespass because the former tenants left personal items on the landlord’s property without express or implied permission. The landlord also clearly expressed his objection to this. The landlord could sue the former tenants in hopes of being awarded specific performance, such as ordering the former tenants to retrieve their belongings from the property. In addition, the property damage could qualify as negligence. Firstly, the former tenants owed the landlord a duty of care because by the nature of their relationship, the actions of the tenants could have direct consequences on the landlord and his property. Secondly, the tenants breached the standard of care, because any reasonable person would believe that tenants should treat the home in a respectable manner, and inform the landlord or take action when there is a potential of damage to the property. Thirdly, the behaviour of the former tenants caused the landlord to suffer property damages, and ultimately a monetary loss. He will have to go through significant expenditures to restore the property to its original condition, or to continue to use it for business. The landlord has also lost potential future income due to the time it will take to repair the home, without tenants living in it and providing rental income. Lastly, the damages suffered by the landlord were not too remote as it is reasonably foreseeable that this type of conduct by tenants directly results in damage to the landlord and his property. Another legal issue to address includes the fact that the former tenants did not pay rent for the last two months before leaving the home. Furthermore, the former tenants are not answering the phone calls or attempts to communicate from the landlord.
We believe that the landlord has a strong case to sue the former tenants for the torts of trespass and negligence due to the obvious and tangible effects of their actions. Collectively, the evidence used to support the landlord’s case includes proof that tenants trespassed on personal property (physical evidence) and the four conditions for negligence. Through proving that there was no express/implied permission for tenants to leave belongings on the property and that tenants caused damages by not providing their owed duty of care will increase the landlord’s chances of a successful lawsuit.
