"A disputa expõe os pontos de vista de duas ideologias contrárias, mas que precisam conviver em harmonia. Enquanto os artistas reivindicam seus direitos e reclamam de obras que teriam sido apagadas, o poder público se apega às leis para tentar demonstrar sua razão.
No entanto, a briga de gato e rato, entre grafiteiros e governo, não é novidade e muito menos um privilégio da capital paulista. Todas as grandes metrópoles também vivem ou viveram esse tipo de situação. Nova York, Los Angeles, Madri, Berlim e Tóquio são bons exemplos.
Berço do grafite moderno, Nova York passou anos tentando combater os muros e trens pintados. Leis foram criadas e revogadas, muito dinheiro foi investido... e a disputa continua. Para se ter uma idéia das proporções da batalha em Nova York, para apagar os grafites dos metrôs – um dos principais ícones do movimento – foram precisos 15 anos, 150 milhões de dólares e mais de 80 mil horas de trabalho na limpeza de vagões.
Em São Paulo, de acordo com a comunicação interna do metrô, todos os vagões são diariamente vistoriados. Caso algum grafite seja encontrado é imediatamente apagado.
Paralelamente, organizações ligadas ao grafite buscam formas de burlar essas leis para se manifestar e deixar o seu recado. Por exemplo, a Graffiti Research Lab (GRL), entidade dedicada a desenvolver novos métodos e ferramentas para artistas da rua, criou a técnica Electro-Graf, com a utilização de tinta condutora para que leds luminosos possam ser utilizados em desenhos nas paredes. No site da GRL são postados vídeos que ensinam as novas formas de intervenção artística.
No meio desta batalha, a prefeitura de São Paulo tenta utilizar e lei municipal Cidade Limpa, que padroniza o tamanho de placas publicitárias e anúncios de fachadas, para justificar o desaparecimento de algumas obras.
“Falta é oportunidade. No momento a prefeitura municipal de São Paulo tem apagado o grafite. Por isso está mais difícil fazer arte”, disse Oswaldo Júnior, o Juneca – ex-pichador e um dos expoentes do grafite brasileiro. “No caso, o grafite polêmico é aquele que é feito onde não se poderia fazer. No final dos anos 80 fui muito perseguido pela prefeitura de Jânio Quadros. Quando a Luiza Erundina assumiu, fui convidado para um programa de televisão e perguntei para ela como ficaria a nossa situação. Ela respondeu que toda forma de manifestação artística era liberada. Com isso, não oficialmente, o grafite foi liberado e ganhou força. Passados 20 anos, com essa história de Cidade Limpa, estão, incoerentemente, apagando os grafites. As obras paulistanas são conhecidas mundialmente. Os desenhos dos Gêmeos, por exemplo, são muito famosos no exterior e estão dando lugar a esse cinza”, completou Juneca.
Em contrapartida, a prefeitura de São Paulo oferece espaços para o grafite, desde que a autorização seja expedida pelo proprietário ou pela secretaria responsável.
“A única objeção legal em relação ao grafite é o fato de não poder apresentar menção a produtos ou serviços, porque fere a Lei Cidade Limpa. O grafite pode ser feito em áreas particulares com autorização do proprietário, desde que não seja de cunho publicitário. A arte também pode ser praticada em áreas públicas, com autorização do município. Os artistas precisam entrar em contato com a Secretaria de Participação e Parceria, que aciona a subprefeitura responsável pela área em que os grafiteiros querem fazer o trabalho para autorizar o uso do espaço”, disse a prefeitura por meio da assessoria de imprensa da Secretaria das Subprefeituras. Por ir contra os princípios do grafite, a solução encontrada pela prefeitura não agrada muito os artistas do spray.
“Não tem como dizer onde pode e onde não pode. Isso depende do artista. No meu caso, desenvolvi um senso fino. Sei até quanto tempo posso tempo posso ficar pintando. Por isso que digo que o que legitima o grafite não é a galeria, mas sim a rua. É preciso ter essa sacada”, Celso Gitahy, um dos pioneiros do grafite no Brasil.
Outro ponto que alimenta a disputa é a pichação, que muitas vezes é confundida com o grafite. Enquanto o grafite trabalha com desenhos e cores, a pichação é focada nas letras, sendo ainda considerada uma arte marginal.
“É claro que o grafite deve ser considerado uma forma de expressão artística no ambiente urbano, mas também é preciso ter em mente que o espaço utilizado por esses artistas é público, e uma das obrigações do poder público é a manutenção desses locais. E por manutenção entenda-se combater a pichação, que muitas vezes sobrepõe-se ao grafite. Para atender tanto os interesses dos artistas quanto dos outros munícipes, a Prefeitura de São Paulo coloca à disposição dos artistas algumas áreas próprias para grafitagem”, aponta a prefeitura por meio da assessoria de imprensa da Secretaria das Subprefeituras. Late in the afternoon on the last day in March 2009, I walked into Bryant Park, which is located behind the New York Public Library, between 41st and 42nd Street, facing Avenue of the Americas. There were several people reading and basking in the sun, a couple people typing on their laptop computers, and one chess game underway. I spent about half an hour wandering around to see what looked photo-worthy, and then wandered off to get some dinner...
This woman was typing away on a laptop computer ... alas, it was not an Apple Powerbook. But maybe she doesn't know any better. Just think: if she had been typing on a Mac, her photo probably would have been published a thousand times by now!
