On, the one. hand we. . have Modi's off dens1ve· usage of communal1magery and explicit equation of 'nationalism'.

,' ens1ve,· · · .

wtth the Hrndu rel1g1on. .

Modi has proclaimed that he is a '~Hindu nationalist"; and this, he claims, follows from being a Hindu an<l a nationalist.· Th1s IS a ~omple~e fal~acy. In the h1story of India's freedom struggle and since, there have been many Hindus who have been lndt~n nationalists to the core, but have expressly rejected any notion of 'Hindu rashtra.' The 'Hindu nation' was always a f1gment ofthe fascist imagination of the Rashtriya Swayam~evakSangh, of which Modi is a proud product. And the '\55' modeI of" politicaI action from its i nee ption was against anti-coloniaI nationalism, and only obsessed with .

fannmg up hatred against Muslims. .

0~ the heels of his :puppy: analogy, Modi used the 'burqa' metaphor in a speech, saying that the Congress is hiding its .

failures behrnd the burqa of secularism. Again, the use of the 'burqa' (rather than the word 'purdah' which is used by .

Hindus and Muslims alike) metaphor is a very deliberate jibe aimed at the Muslim minoritv and aimed to provoke .

.

contempt for 'secularism' by equating it with Muslims. .

Clearly Modi consi_ders secularism to be a dispensable veil, but India needs it as an essential ingredient for survival .

.

and progress. · .

.

'Secular' Must Mean More Than 'Not Nakedly Communal' .

In response to Modi's 'burqa' barb, the Congress replied by saying that the 'burqa' of secularism is preferable to naked .

.

communalism. The Congress thus concurs with the BJP that secularism belongs to the realm of form and not essence. .

.

For Congress, Nitish Kumar, for Mulayam Singh, Mayawati, or Mamata Banerjee and for most other ruling class formations, 'secularism' has become nothing much more than rank opportunism, whereby the goo/posts of 'secular' .

and 'communal' can be changed according to convenience. The Congress claims to be 'secular' on the strength that its politics does not require its I eaders to compare MusI i ms to 'kutte ka baccha.' But when it comes to a positive atmosphere of ensuring equality, dignity and security of minorities, the Congress' record is a dismal one (as it that of the other non-BJP ruling class parties). The failure to implement the recommendations of the Sachar Committee, the complete betrayal of the efforts to secure justiceagainst perpetrators of communal violence (ignoring the Sri Krishna Commission .

or the liberhans Commission) are just a few of the Congress' opportunist compromises with communal forces. .

Manmohan Singh himself has, offensively, equated anti-imperialism with 'Muslim communalism', accusing opposition .

to his Government's anti-Iran vote under US pressure at the IAEA of being an attempt to 'communalise foreign policy' ! .

Defeat the Youth For (In) Equality and ABVP: While the overall conducive atmosphere of struggles on peoples· ISSues is increasmg and the students of JNU have fought a successful agitation on the issue of financ1al ass1stance. it is revealing that both the YFE and the ABVP did not participate in the agitation aimed at providing relief to the students from economically underpnvileged sections. Both these organizations represent the extreme right-wing and propagate a communal. casteist. errust and patriarchal ideology of exclusion and hatred They pose a challenge to the socially sensitive and progresstve character of JNU and their anti-democratic and intolerant .

politics must be thoroughly reJected. Defeat the infantile ultra-left: The polttics of the AISA and the ultra left IS based less on concrete 1ssues and more on sensationalism. rumour mongering and false propaganda against the Left. The failure of their modal of student politics is evident from the fact that even though they held the Presidents' post for !he last two years. they are not contesting these elecbons on the basis of their achievements or accountabtlity The empty rhetoric of the AISA must be .

rejected thoroughly Defeat the anti-student NSUI: The NSUI is an organizaoon whose acttvities revolve only around the sycophancy of their leaders. The fact that they dragged the JNUSU Election Committee to court exposes their anti-democratic character. .

They must be rejected lock-stocK and barrel. .

We appeal to all progressive. secular and democratic-minded students of JNU to give an overwhelmtng mandate to SFI-AISF in these elections to carry forward the struggle for the rights of the student community .

Goodbye POTA? ...Welcome U LPA ! Please Stay AFSPA !.

·n1e new govemment has prom1sed to repeal POTA I'dbe surprised iffhat happens before similar legislation under a clifferenl name IS put.

in place.·-Arundha~ Roy in a pubhc address in California.August 16, 2004..

POTAwasbrought in as astrong--muscled lawand sharp-toothed law to fight terrorism. Even beforeit was passed, however, it wasclear thatits intention was not somuch to interceptterrorists, as to crush protest and silence dissent,by labeling entire communities of those who questioned.

Hindutva or liberalization as 'terrorists' -whether it be tribals·of Jharkhand or Muslims of Gujarat. Kashmir and Mumbai..

The Congress led the chorus against POTA. and promised that its Government would deliver democracy.by repealing this draconian law.RecenUy, the Government announced triumphantly that POTA was, indeed, being repealed. Hasthe UPA really delivered its promise of restoringdemocracy? Lerstake ahard look:.

In the first place,it iswelcome that Sections 32 and 49of POTA have been withdrawn, which made confessions made to asenior police officer.

admissiblein evidence. This provision, an open invitation to confessions extorted by custodial torture. has gone, and good riddance. The.

prov1s10n that those accused could seek bailonlyone year after U1e dale from detention,or under wh1ch the accused could be kept in detention.

for upto six monthswithout filing charges, has been dropped.SO far,so good. But most other provisions of POT/1. havebeen retained; notjust that.even certain safeguards available in POTA have been dropped in the amended Unlawful Activities (Prevention) Act..

The vague,catch-all definition of 'terrorism' used by POTA has been retained in the ULPA;adefinition which makes it possible for governments.

to define who is aterrorist according to convenience. Under ULPA,as underPOTA and TADA too, everyone from trade-unionists, teachers..

grandfathers, children, women, tribaJs, landless poor-all can continued to be lumped together as terrorists if and when it suits the government..

In other words, ULPA,like most other anti-terrorist legislation all over the world. does little to combat terrorism, but performs the 'function' of blurringthe line between dissent, resistance and protest, and terrorism. This function is very important for governments who are facingopposition from.

people on whom they are forcing devastating policies..

The amended ULPA also retains the POTA provision that intercepted communication,(wire, oral orelectronic) can be admissiblein evidence..

In faclit has made it easier to misuse such evidence, by doing away with the few safeguards U1at POTA had stipulated for tapping telephones or.

intercepting e-mails. UnderULPA,the State wiII continueto police rts dissentingcitizens, justas underPOTA..

In other words, the 'new improved' .

.

naishakti wala ULPAretains most ofPOTA's killercanines, and adds afew new ones ofits own. Why? The.

answer is clear. the Congress and the UPA are basically serving thesame tiny elite sectionof society as the NDA did; despiteits claims of a;humanface', the factis that the inhuman policies of globalization are being aggressively pursued. Anygovernment which implements these anti-.

I .

people policies, needs black laws as a handy weapon.to intimidate civil society and make peoplefear dissentand resistance..

Under Congress' own TADA, which is supposed tohave lapsed 9years ago, landless poor arebeing sentenced to death, and also to lifeimprisonment even today, in Bihar, ruled by akey UPA ally, whileTADA charges are withdrawn from Ranveer Senachieftains. In the new UPA u dispensation, Raja Bhaiyya and Vaiko may expect relief. even. rewardsin Ministerialberths. But the rural poor and minoritiesbooked under POTA ~m .

will continue to be victimized and witch-hunted under ULPA-a blacklaw byanothername.Slater$ ressionwill simplyhave anew brand namenow.Unfortunately, the CPI-CPI(M) cwatchdogs' ofthe UPA have hailed the repeal ofPOTA withoutonce speaking outagainst the ;ase dishonestway in which POTA is being repackaged underULPA. can't.ase \oThe fact isthat even the CPI(M) has avested Interest in retaining black laws.In WestBengal, its State Govemmenthad done its best to.

)> 11. Gender of individual-Eunuch-5, female-3, male-l .

Likewise, a few more criteria can be thought of, discussed and zeroed in on the basis of which individuals can be identified and to whom the social protection and reservation benefits can be extended. Each of these parameters can be graded on a scale of 1 to 5 and a comprehensive deprivation index can be obtained. This deprivation index will have the strength to pick up the entire true backwards and eliminate false backwards. For example: Daughter of a landless. .

resource-less, illiterate laborer from a village in Jharkhand wili have all the plus points to avail the benefits of affirmative .

action policy. In contrast, a convent educated son of rich business manager from Delhi (whatever the caste may be) will not .

receive any benefit of the affirmative action plan. .

Rural Development Ministry also devised one such method with the help of I 3 socio-economic parameters which helped in .

identifying the BPL households. Though there were some inclusion and exclusion errors and later on government interfered to give more weight to caste and religion because of which the entire exercise were messed up inviting severe criticism. In Indian .

society, caste is not the on I y obstacle in the way of development of an individual. Economic conditions, educational opportunities and discrimination on the basis of gender also contribute to the denial of opportunity to express one's true merit and worth. It is important, to discuss reservation in the holistic context of much requi-ed social restructuring and not to convert it into a fetish of 'political correctness'. Admittedly, caste remains a social reality and a mechanism of oppression in Indian society. But can we say that caste is the only mechanism of oppression? Can we say with absolute certainty that poverty amongst the so-called upper castes has been eradicated? Can we say that the regions of Northeast, Jharkhand, and Chhattisgarh are on par with the glittering metros of Delhi and Mumbai? Can we say that a student from a panchayat school in Bihar is .

equipped to compete with an alumnus of Doon School on an equal footing, even if both of them belong to the same caste group? After all, this society discriminates against girls even before they are born. Such discrimination exists across religious and caste lines. And therefore, time has come now to think beyond caste, class and religion. .

Since independence, the issue of reservation has always been a strongly contended and fiercely debated subject in India. Before Mandai that had been widely accepted but after Mandai, shift came and now it is one of the tools for evil politics. Political hunger of leaders and their puppets (NSUL ABVP, SFI, AISA etc) are supporting promotion .

in reservation bill to divert our attention from different types of loot ( like coaL 2G, CWG etc). We are asking few questions to our pseudo intellectual's leftist and rightist friends -who are the beneficiaries of the proposed promotion? Whether an already oiled person by way of a secured, protective and prestigious government job needs further oilin2 for his/her upliftment? What wiJI be the impact -if such a bill is not brought to the .

parliament? Finally, what will be the impact if such a bill is passed and rese rvation in promotion is offered? YFE opposes the decision to amend the constitution to ensure the reservation in promotion for the SC/ST .

without paying sufficient critical attention to discourse of the H on ' ble Supreme Court on the issue. .
