Last week, two separate pronouncements (a verdict by the Delhi High Court and a significant observation by the Supreme Court) nailed yet another case of blatant communal framing and also 62 killings in Manipur. The cases are chilling enough. Two young Kashmiris, Mirza Nissar Hussain and Mohd. Ali Bhat had earlier been sentenced to death in 2010 in connection with the Lajpat Nagar Blasts in 1996. And now the Delhi High Court has acquitted both of them of all charges! It has also commuted the death sentence of another accused Mohammed Naushad to life imprisonment. Let us see what theverdict says: .

The nature of grave prosecution lapses, in regard to various issues such as lack of proof connecting some of the accused with the bomb incident, failure to hold TIP [Test Identification Parade] of articles and the accused,

[and] not recording the statements of vital witnesses

. underline not only its lapses and inefficiencies, but also throw up a question mark as to the nature and truthfulness of the evidence produced .

Nothing could be more telling: So now we have people sentenced to death, based on LIES and fabricated facts! .

Hearing a writ petition complaining of mass fake encounters in Manipur, the Supreme Court on 23 Nov told the Manipur government: You people are killing each other. You are doing what the Maharashtra and Gujarat governments did in fake encounters. It is a serious matter. So now, EVEN the highest court of law is acknowledging what everyone in the North East knows. .

We are living in times when it is commonplace for innocent youth to be framed as terrorists, where it takes years and years before their innocence is finally proved. Mirza Nissar Hussain and Mohd. Ali Bhat had to wait for 16 whole years for justice. This isnt for the first time that we are seeing innocent Kashmiri youth being framed and imprisoned only to be acquitted by a higher for lack of evidence. .

The recent acquittal of Mirza Nissar Hussain and Naza and Mohammed Ali Bhatt in Nov 2012, after 16 years in custody,only reminds one of the Jan 2012 Delhi High court verdict, which too acquitted another Kashmiri youth, Mohammad Amir Khan declaring him innocent after he spent 14 years of his youth in jail. Amir, who was only 18 and preparing for his school exam, was abducted by police in 1998, charged with being the mastermind of serial blasts in and around Delhi. This young boy of 18 was named in 20 cases of blast under all the possible Sections, tortured in jail for 14years andfinally releasedin2012,whenprosecutionfailedtoproduceashredof evidenceconnectinghimtoanyof these blasts. In the 14 long years he spent in jail, his father, running from pillar to post for justice, died of a heart attack and his mother suffered a stroke that paralysed her totally. Amir came out to another world and is today trying to pick up the pieces of a life destroyed, his future still bleak. Upon his release one journal Firstpost.com aptly commented Mohammad Aamir Khans story should qualify as a case study for someone doing research on How terror cases are probed in India. .

In October 2012, Shabbir Ahmed and Shafaquat Iqbal were acquitted by a Delhi court, after a five-year trial. Additional Sessions Judge Savita Rao acquitted Ahmed, Iqbal and Pakistani national Mohd. Hassan, of all terror charges. .

Be it Kashmiris or young Muslims from Azamgarh, Malegaon and Darbhanga, we are today witnessing a regime where there is absolutely no accountability for the investigating agencies who are framing and arresting young people throughout the country without even a shred of evidence. .

The recent pronouncements by the High Court and Supreme Court have once again highlighted a shocking reality of our times-the Kafkaesque world where young men are picked up, sometimes snatched by one agency from another and presented to the world as dreaded terrorists. From Kashmir to the North-East and in several parts of the mainland too, similar episodes are played out with remarkable regularity. After USB-C win, EU tells Tim Cook that Apple must ‘open up its gates to competitors’

 

The iPhone 15 has USB-C, a move largely due to impending legislation in the European Union requiring smartphones and other products to use a common charger. Apple also might soon be forced to open the iPhone up to third-party app stores and sideloading thanks to the Digital Markets Act in the EU.

 

In new comments today, EU industry chief Thierry Breton reiterated that Apple must “open up its gates to competitors.”

 

For a quick refresher, the DMA is a wide-ranging piece of antitrust legislation aimed at tech companies. Under the law, Apple must make changes to iOS, the App Store, and Safari that improve the interoperability of those platforms with other ecosystems. As the legislation is currently written, Apple will have until March 5 next year to comply.

 

As reported by Reuters, Breton made the comments after a meeting with Cook in Brussels this week. Breton said that following the iPhone 15’s switch to USB-C, Apple must now open up things like the App Store to its competitors.

 

“The next job for Apple and other Big Tech, under the DMA is to open up its gates to competitors,” Breton said. “Be it the electronic wallet, browsers or app stores, consumers using an Apple iPhone should be able to benefit from competitive services by a range of providers.”

 

Apple’s counterargument has been that opening up the iPhone in these ways will significantly compromise user security and privacy. Breton, however, doesn’t buy this argument. “EU regulation fosters innovation, without compromising on security and privacy,” he said this week.

 

While iOS 17 currently doesn’t include any support for third-party app stores or sideloading, Apple VP Craig Federighi said following WWDC in June that Apple is “working with the EU” to ensure compliance.

 

The expectation is that Apple will do whatever it can to limit the availability of sideloading and third-party app stores. The company could also be forced to open iMessage up to other messaging platforms, but that’s still being debated.

Will ‘Made in India’ iPhones Outshine China’s?

Analysts from JP Morgan said that Apple would move 5% of global iPhone 14 production to India and, by 2025, India will become a global hub for manufacturing 25% of all iPhones.

 

When it comes to manufacturing quality products or timely deliveries of orders, India still has its struggles. According to recent reports, a 50% rejection rate was observed for iPhone casings made in India. It is alleged that the phones manufactured domestically did not meet Apple’s quality criteria and ended up as waste or recycled material. With the increasing shift towards manufacturing in India, does this statistic conclusively determine the fate of manufacturing for the world’s largest phone company or are we scrutinising the manufacturing process through the wrong lens?

 

India started assembling the older generation iPhones in 2017 and it was only towards the last quarter of 2022 that they started manufacturing new models, i.e., iPhone 14 in India. Until then, China had been, and still is, the largest manufacturer of Apple products. In 2022, over 90% of Apple products, such as iPhones, iPads and Macbooks, were made in China.

 

China’s Dominance

China started manufacturing iPhones in the middle of 2007. Steve Jobs moved the majority of manufacturing to China because the cost of labour was the lowest compared to other countries. In addition, China was then the only country in the world with a ready-made supply-chain network with production lines that could be scaled up in no time. Further, Tim Cook has mentioned that the reason China remains the manufacturing hub is not solely due to the availability of cheap labour, as it is widely believed, but also because of skill availability, quantity and location. To work on a profitable model, Apple does not own any factories in China and only works with manufacturing companies on a contractual basis.

 

Roadblocks in India’s path

 

Although Apple’s suppliers have been in India for some time now, in 2020, Karnataka’s Wistron plant in Narasapura, Kolar, was vandalised by their employees. It was alleged that delays in payments and extended working hours led to protests by the workers, where company property and phones were destroyed. Wistron had incurred losses of over INR 437 crore due to the resultant vandalism and theft.

 

In addition, with every manufacturing curve, the ramp-up period takes considerable time and depending on unit production capacity and the number of workers, the period can go up. China has been manufacturing iPhones since 2007—which gives it a ten-year jump start when compared to India— but has lost contracts due to its highly unstable government bodies and efficiency stance. India, a fairly new competitor in the iPhone manufacturing space, still has a long way to go and the current statistics might not be enough to seal its dream of becoming the next global manufacturing hub.
