Last week, two separate pronouncements (a verdict by the Delhi High Court and a significant observation by the Supreme Court) nailed yet another case of blatant communal framing and also 62 killings in Manipur. The cases are chilling enough. Two young Kashmiris, Mirza Nissar Hussain and Mohd. Ali Bhat had earlier been sentenced to death in 2010 in connection with the Lajpat Nagar Blasts in 1996. And now the Delhi High Court has acquitted both of them of all charges! It has also commuted the death sentence of another accused Mohammed Naushad to life imprisonment. Let us see what the verdict says: .

The nature of grave prosecution lapses, in regard to various issues such as lack of proof connecting some of the accused with the bomb incident, failure to hold TIP [Test Identification Parade] of articles and the accused,

[and] not recording the statements of vital witnesses

. underline not only its lapses and inefficiencies, but also throw up a question mark as to the nature and truthfulness of the evidence produced .

Nothing could be more telling: So now we have people sentenced to death, based on LIES and fabricated facts! .

Hearing a writ petition complaining of mass fake encounters in Manipur, the Supreme Court on 23 Nov told the Manipur government: You people are killing each other. You are doing what the Maharashtra and Gujarat governments did in fake encounters. It is a serious matter.So now, EVEN the highest court of law is acknowledging what everyone in the North East knows. .

We are living in times when it is commonplace for innocent youth to be framed as terrorists, where it takes years and years before their innocence is finally proved. Mirza Nissar Hussain and Mohd. Ali Bhat had to wait for 16 whole years for justice. This isnt for the first time that we are seeing innocent Kashmiri youth being framed and imprisoned only to be acquitted by a higher for lack of evidence. .

The recent acquittal of Mirza Nissar Hussain and Naza and Mohammed Ali Bhatt in Nov 2012 after 16 years in custody only reminds one of the Jan 2012 Delhi High court verdict, which too acquitted another Kashmiri youth, Mohammad Amir Khan declaring him innocent after he spent 14 years of his youth in jail. Amir, who was only 18 and preparing for his school exam, was abducted by police in 1998, charged with being the mastermind of serial blasts in and around Delhi. This young boy of 18 was named in 20 cases of blast under all the possible Sections, tortured in jail for 14 years and finally released in 2012, when prosecution failed to produce a shred of evidence connecting him to any of these blasts. In the 14 long years he spent in jail, his father, running from pillar to post for justice, died of a heart attack and his mother suffered a stroke that paralysed her totally. Amir came out to another world and is today trying to pick up the pieces of a life destroyed, his future still bleak. Upon his release one journal Firstpost.com aptly commented "Mohammad Aamir Khans story should qualify as a case study for someone doing research on How terror cases are probed in India". .

In October 2012, Shabbir Ahmed and Shafaquat Iqbal were acquitted by a Delhi court, after a five-year trial. Additional Sessions Judge Savita Rao acquitted Ahmed, Iqbal and Pakistani national Mohd. Hassan, of all terror charges. .

Be it Kashmiris or young Muslims from Azamgarh, Malegaon and Darbhanga, we are today witnessing a regime where there is absolutely no accountability for the investigating agencies who are framing and arresting young people throughout the country without even a shred of evidence. .

The recent pronouncements by the High Court and Supreme Court have once again highlighted a shocking reality of our times-the Kafkaesque world where young men are picked up, sometimes snatched by one agency from another and presented to the world as "dreaded terrorists". From Kashmir to the North-East and in several parts of the "mainland" too, similar episodes are played out with remarkable regularity. Doesn't after every bomb blast a fairly typical story that appears in the media. The cast changes marginally, and the plot moves between Kerala, Bhatkal in Karnataka, Azamgarh in Uttar Pradesh (UP), Darbhanga in Bihar, Ujjain and Khandwa in Madhya Pradesh (MP), with detours to Hyderabad, Maharashtra and Gujarat. SIMI, IM, Lashkar-e-Toiba (LeT) and HuJI morph seamlessly into each other in this story of homegrown terror. .
