VERA BAKER'S DEATH

An Inquest and S.M.'s Court Proceedings

Charges Against Hannah Matilda Dalton and Percy Norman Henry

Both Accused Committed for Trial

The adjourned inquest into the circumstances surrounding the death of Vera Baker, at Nurse Dalton's Home, Arthur-street, Ponsonby, Auckland, was resumed before Mr. E. C. Cutten, S.M., at the Magistrate's Court last Saturday. In addition, Mr. F. V, Frazer, S.M., occupied a seat on the bench, the object being to expediate matters and

as a good deal of the evidence given at the coronial inquiry would be used in the police charges against Nurse Dalton and Percy Norman Henry.

Hannah Matilda Dalton, who was present, was represented by Mr. R. A. Singer; Mr. J. F. Hosking looked to the interests of Percy Norman Henry, and Chief-Detective McMahon represented the police.

The only evidence taken at the opening of the inquest on Tuesday, November 6, was that of deceased's uncle, Joseph Baker, waterside worker, residing in Clark-street, Kingsland. He said Miss Baker was a single girl of 23 years of age. As far as witness knew, the deceased had been employed as a domestic servant at Mt. Eden. Her father and mother were dead.

The first witness called on Saturday was Francis Vernon Frazer, S.M., who stated that he accompanied Detectives Hollis and De Norville to Nurse Dalton's house, Arthur-street, Ponsonby. A court was opened by him at the house, and the evidence of Vera Baker taken. The girl's statement was to the effect that Hannah Matilda Dalton had performed an illegal operation on her on or about October 24.

At this stage the Magistrate's Court was declared to be open, and the clerk of the court read the charges imposed against the two accused persons.

Hannah Matilda Dalton was charged with the unlawful use of an instrument with intent to procure abortion, and also with the murder of Vera Baker. Percy Norman Henry was also charged with aiding and abetting in the abortion, and was jointly charged with murder. Detective McMahon said the cases would have to be taken separately. The charges against Nurse Dalton were proceeded with first.

Dr. Florence Keller said that on November she received a telephone message from Nurse Dalton making an appointment at the doctor's house. Nurse Dalton arrived a few minutes later. Nurse Dalton

DETAILED THE GIRL'S HISTORY.

The doctor stated that she commenced an examination, but eventually the deceased was told that she had better go home and go to bed. Vera Baker did not say anything to her, except to ask the fee. Subsequently witness received two telephone messages — one on November 2 and the other the following day. As a result of the latter message, witness went to accused's house about 9 a.m. Nurse Dalton explained why she had sent the second message. She said she had rang up a second time instructing witness not to come, as the patient was better. Witness went into the bedroom to see the patient and made an examination. At this stage witness described in detail the result of that examination. Witness told Nurse Dalton that the girl would have to go to the hospital right away. The nurse asked if the necessary operation could not be performed there. Vera Baker, said, "I don't want to leave the nurse; I want to stay here.” About three hours later the operation was performed, Drs. Drier and P. M. Keller being present. Witness stayed with the girl until about six o'clock that evening. Accused said, "I wish this girl had never Come to me; I don't know how

There was evidence of marked peritonitis. Witness was present at the post mortem on the body of the deceased.

In answer to the Chief-Detective, witness was of opinion that it was possible, but not probable, that the lacerations were caused by deceased herself.

Dr. Neill McDougall stated that, on November 5, he performed the postmortem examination on the body, of Vera Baker. There were no external marks of violence. From the postmortem examination witness was of opinion that cause of death was acute septic peritonitis. It was possible the force to have been used by deceased, but highly improbable.

Detective-Sergeant Holllis said that, in company with Detective De Norville, He interviewed Percy Norman Henry, and asked him what he knew of the matter. Henry made a statement which was taken down. Henry said that on October 23 he accompanied Vera Baker to Nurse Dalton's house. He admitted he was the cause of the young woman's trouble. He was not in a position to get married. The young, lady went to Nurse Dalton's house again, on October 24. He, (Henry) received a telephone message from Miss Baker asking him to come over that night as everything was all right. He went to Nurse Dalton's house that night, saw the girl, and paid Nurse Dalton £10 for the operation and £1 10s for extras. He admitted he visited the house on several occasions afterwards, and took the young lady for a walk.

At this stage of the proceedings, Mr. B. C. Cutten, S.M., Coroner,

which was to the effect that "Miss Vera Baker died on November 5, 1917, at Auckland, the cause of her death being acute septic peritonitis. There was sufficient evidence to warrant one Hannah Matilda Dalton being placed on her trial on a charge of having unlawfully used an instrument on the said Vera Baker with intent to procure her miscarriage, and also to warrant one Percy Norman Henry being placed on his trial on a charge of aiding and abetting the said Hannah Matilda Dalton in the commission of such offence."

Dr. Drier corroborated the previous medical testimony.

Detective Hollis gave further testimony, and stated, that he accompanied Mr. Frazer, S.M., and Detective De Norville to Nurse Dalton's house on November 3 last. From what was subsequently learned, he and Detective De Norville interviewed accused as to how. Vera Baker came to be in her house. She stated that the young lady came to the house the Wednesday after Labor Day. When Nurse Dalton's husband came on the scene, and accused said, "You thought that I was good, but

I HAVE BEEN BAD."

She further stated that she had befriended the young woman. She said that she had used something on the girl, and had told Detective Hollis the truth about it.

Detective De Norville corroborated.

Mr. Singer raised an objection to accused signing any statement.

The objection was upheld by Mr. Frazer, S.M.

Accused, who was not asked to plead, reserved her defence, and was formally committed for trial.

The accused is an elderly nurse, and had to be assisted in and out of the court room.

The case against Percy Norman Henry (26) was then proceeded with.

The evidence was practically a recapitulatlon of that given in the foregoing case. Accused reserved his defence and was committed to the Supreme Court for trial.

JURY FAIL TO AGREE.

ALLEGED ILLEGAL OPERATION.

The trial of Hannah Matilda Dalton on the charge of having caused the death of an unmarried woman, named Vera Baker, was continued in the Supreme Court yesterday, before Mr. Justice Cooper. The Hon. J. A. Tole, Crown Solicitor, prosecuted, and Mr. Singer conducted the defence.

Dr. Florence Keller, in cross-examination by Mr. Singer, said that after the abdominal operation, which was performed by herself and Dr. Drier, on November 3, the deceased girl told them that she had used an instrument upon herself.

Re-examined by Mr. Tole, the witness stated that the condition of peritonitis discovered at the operation indicated the probability of infection within five or seven days previously.

Dr. Ezra N. Drier gave corroborative evidence as to the injured condition of deceased's organs discovered at the operation. The general peritonitis was the cause of death, and was due to the introduction of some external means of infection, at least five days previously. He doubted whether the infection took place as early as October 24.

To Mr. Singer: It was possible that the injury might have been inflicted by the patient herself, but he did not think it was probable, in view of the extent and manner of the wound.

Dr. Neil McDougall stated the results of the post-mortem examination, his conclusions being similar to those of the other medical witnesses.

Detective-Sergeant Hollis deposed that on November 3 he and Detective de Norville visited the prisoner's house, and obtained from her a signed statement to the effect that the deceased girl came to her, said she was in trouble, and asked accused to screen her. The statement particularised certain treatment of the deceased during a stay of two days in accused's house, and mentioned the receipt of £11 10s from a man. Witness thereupon swore an information, charging the prisoner with attempting an unlawful operation. A Court was opened in the sick-room that night by Mr. Frazer, S.M., and the evidence of Vera Baker was taken. She swore that on October 24 the prisoner performed an operation upon her at her own request; and that accused, referring to the fee charged, said that she made it high because she was undertaking a great risk. Deceased also withdrew her earlier statement that she had used an instrument upon herself, and re-asserted that this her final statement, represented the truth.

His Honor observed this connection that he must direct the jury that, according to a decision of the English Court of Criminal Appeal in a similar case, the statement of the girl to Dr. Keller was not admissible in evidence.

Addresses by Counsel.

Mr. Tole, in addressing the jury, submitted that, according to the medical evidence, the infection of the deceased must have taken place during her residence in the accused house.

No evidence was called for the defence. Mr. Singer, in addressing the jury for the defence, claimed that the Crown, to support the charge, must prove absolutely that accused had caused the death of Vera Baker. It was not for the jury to find whether accused used an instrument upon deceased on October 24.

His Honor said that that was one of the essential questions. The jury had to find (1) whether the prisoner used an instrument upon the deceased, and (2) whether, if so, the act of the prisoner was the cause of death.

Mr. Singer pointed out that the indictment contained no count which charged the prisoner with attempted illegal operation.

His Honor agreed that upon an indictment for manslaughter an accused person could not be found guilty of a lesser offence. Still, as the charge hung upon an alleged unlawful act, the jury must first find whether there was an attempt at such an act, and then, if so, whether that act caused the woman's death.

Mr. Singer said the medical testimony was that the septic condition disclosed at the operation would be a development of only a few days—certainly not ten days, as required by the theory of interference on October 24. He suggested, as fitting in with the condition of septic development proved, the probability that the deceased had tampered with herself on October 30, when she was shown to have been absent from Dalton's house.

His Honor's Direction.

His Honor, in directing the jury, said that in order to convict the accused they must be satisfied beyond reasonable doubt that the death of Vera Baker was caused by some unlawful act on accused's part. With regard to the deceased's evidence before the magistrate, there were no indications that she was not, at the time perfectly competent to be examined. The jury must use their own judgment as to the reasonableness of her contradiction in that evidence, of her previous statement that she had used an instrument upon herself. There was ample evidence to support the conclusion that prisoner did perform an operation. That, however was not sufficient. They must be satisfied beyond reasonable doubt that the girl's death resulted from that operation. If it might have been due to some other cause they should acquit the prisoner of manslaughter and she was not at present being tried for anything else.

After deliberating for upwards of an hour the jury returned to Court requesting further enlightenment on medical questions. Dr. F. Keller was recalled and gave it as her opinion that the state of peritonitis which she discovered had taken from five to seven days to develop. It was consistent with the idea of infection, even as far back as October 24.

Four hours from the time of their original retirement, the jury announced that there was no prospect of their agreeing upon a verdict. His Honor accordingly discharged them.

On the application of the Crown Prosecutor His Honor granted an order for a new trial, which, however, as no jury panel is provided for next week, will not take place until the February sittings. The terms of bail were fixed at the prisoner's recognisance of £300, and two sureties of £150 each.

HANNAH DALTON'S TRIALS.

A Final Verdict of Not Guilty.

An elderly woman, Hannah Matilda Dalton, was charged before his Honor Mr. Justice Hosking, on Tuesday, with that on October 24, she did unlawfully use an instrument upon Vera Baker. The Hon. J. A. Tole prosecuted for the Crown, accused being defended by Mr. R. A. Stringer.

The evidence given was on lines similar to that given at the first trial. It was alleged that the woman, Vera Baker, had died following on an illegal operation alleged to have been performed by the accused, who denied the allegation. The suggestion was made that the deceased had tampered with herself, and that the accused befriended the girl Baker.

It was just on twenty minutes past six when the jury retired, and at a quarter to ten the foreman announced that there was

NO POSSIBILITY OF AN AGREEMENT.

The jury was then discharged and a new trial was ordered for the next day.

On Wednesday, for the third time, Mrs. Dalton faced the jury. It will be remembered that at the last criminal sessions she was charged with manslaughter in respect to the girl, Vera Baker, but the jury disagreed, and at the present sessions an additional indictment had been laid charging her with performing an illegal operation as shown above. This charge was heard on Tuesday when the jury failed to agree. The same evidence was tendered again at the retrial on Wednesday. This time the jury agreed on a verdict of not guilty.

VERDICT OF NOT GUILTY

TRIAL OF YOUNG MAN.

The quarterly criminal session of the Auckland Supreme Court was concluded yesterday before Mr. Justice Hosking.

A young man, Percy Norman Henry (Mr. Algie), was charged with having, at Auckland, on or about October 24, 1917, counselled and procured one Vera Baker to unlawfully permit to be used on her an instrument or other means with intent to procure a miscarriage. There was a second charge against the accused of being a party to the manslaughter of Vera Baker, but the Crown offered no evidence on this indictment, and, on His Honor's direction, the jury returned a verdict of not guilty.

The principal evidence for the Crown was a signed statement by the accused admitting that he took Miss Baker to a Mrs. Dalton's with the object of having an illegal operation performed, and that he paid to Mrs. Dalton £11 10s.

Giving evidence on his own behalf, the accused said he wanted to marry Miss Baker, but the latter refused. Eventually, much against his will, he agreed that an operation should be performed, and he accompanied Miss Baker to Mrs. Dalton's house. Mrs. Dalton was out, and he again offered to marry Miss Baker, and, when she refused, he told her that he would not consent to an operation being performed. Subsequently the girl communicated with him, stating that she had been admitted to Mrs. Dalton's, and that an operation had been performed. She asked him to come up and bring with him some money. He paid £11 10s. He had no knowledge that an operation was to be performed.

After a retirement for 20 minutes the jury returned a verdict of not guilty, and the accused was discharged.

Nehru Group of Institutions, Coimbatore is deeply committed in harboring and executing ideas and conversations that are cutting edge and relevant. The HR conclave is a part of this endeavor. The second annual HR Conclave was organized by Nehru Group of Institutions which was attended by industry experts from the HR world as well as academicians. The two day event was conducted at Nehru Institute of Engineering and Technology on 7th September 2018 and at Nehru Institute of Engineering on 8th September 2018.
