Dance was my passion, i used to train rhythmic gymnastics and ballet for a total of 15 hours a week. people said i could go far, but guess what? i had to give it up. I developed serious back problems (scoliosis, herniated discs, degenerative disc syndrome...). So the doctors said if i carried on, that i would end up with life threataning problems... It was one of the most hardest things i had to do. I have many medals and cups, i dedicated my life to dance, but i had to give it up...

He died in 1961 at 43 years of age after complications during an operation for a herniated disc. In 1999, the film actress Esther Williams claimed to have had an affair with Chandler but had ended it after she discovered that he was a cross dresser. His friends and family have always claimed that this was untrue, I must say that he always presented himself in films as a very masculine man and was one of the very few Hollywood actors who had served in the military during WW2.

I wanted to thank everyone for all the prayers and good thoughts you sent my way! It must have worked because my back is feeling so much better! I even feel ready to run and play, and wrestle with Darla, but Mommy says I can't because the vet wants me to stay in my crate for another 2 weeks! Mommy tries to carry me everywhere, like the vet said, but sometimes I'm sneaky, and she's caught me jumping off the bed and going up & down stairs. She says I'm making her a worried mess! I'm going to try to behave myself, because I don't want to have surgery, and I don't like taking those pills - they make me so sleepy and that's not any fun!

It’s been a long time since I’ve been on flickr and unfortunately, I’m back with some bad news… my little Pokey has a serious problem.

This past Friday evening, Pokey just wasn’t himself… he didn’t want to play and was just acting mopey. As the night went on, he began to cry out in pain every once in a while. We couldn’t figure out what was wrong! By 6:00 a.m. he was having trouble walking (his little back legs were wobbly). I decided we couldn’t wait for our regular vet to open, so we drove him to the only animal emergency hospital in the area (an hour away).

To make a long story short, Pokey has degenerative disc disease in his back, and may possibly have a herniated disc. I thought he was awfully young to have this kind of problem (he’s about 2 ½ or 3 years old), but the ER vet said this usually occurs in dogs between 3 and 7 years.

The vet prescribed a muscle relaxant and anti-inflammatory and told us that Pokey has to be on strict crate rest for 3 -4 weeks. He’s not allowed to walk, and must be carried everywhere. I am breaking the rules a bit, and allowing him to sleep in our bed, which he has always done (he looks like he thinks he’s being punished when I tried to make him spend the night in the crate)

The poor little guy is still in a lot of pain, but the medicines seem to help a bit. He can’t sit normally – he keeps both his back legs to one side, his back is always hunched and he keeps his head pointed towards the ceiling. It breaks my heart to see him like this, and to know that this is likely a life-changing problem for him. Pokey LOVES to run and play, jump off our bed and wrestle with his girl Darla… now he may possibly never be able to do those things again. It’s so sad!

The vet said that if Pokey does not improve within a month, or if he gets worse, he will need spinal surgery. I’ve already started searching for a good veterinary neurosurgeon to perform the surgery (which is going to be very expensive!) and I think I’ve found a great specialist located in Louisville KY. This Thursday we’ll be going to our regular vet to get a referral to the specialist (the neurosurgeon won’t see a dog without a referral - geez it’s worse than my own medical insurance!)

Please keep little Pokey in your thoughts! And if anyone has a dog that had spinal surgery, I'd love to know how it went and how they did afterwards!

For some time, I have been grappling with the reality of a body that is far from perfect. I'm not talking about issues of weight, anorexia, wanting to be a model - I'm dealing with a body that once would carry me running over mountains 20 miles at a time, ski down hills for days on end, that was able to support me through every day, every adventure, every passionate embrace, and a gratifying career.

Through the intricacies of some weak genes, my once dependable (but mortal) coil turned on me. Along for the ride, my brain chemistry has skewed. It is a cruel thing, and I just loathe the facts. And yet, there are so many people that have far more serious issues to deal with than do I, and I have a whole new appreciation for the strength of will and character that it requires to go through life with disabilities and challenges that the "average" human does not have to endure.

Through my illnesses, I have found heroes- the caretakers of the sick and ailing, those who dedicate their lives to bettering the quality of life for others, and do so for pennies, compared to what someone like Paris Hilton gets paid for being - nothing.

I’m changing. As I become weaker, I find strength I did not know existed previously. As I shed tears, I cast off prior assumptions. Life is an interesting journey, and no matter how well prepared you feel you may be, you just never know what waits tomorrow.

Spent most of the day at the hospital, but the surgery took only 40 minutes. I walked out of the hospital standing up straight. Something I had not done for 5 weeks....so happy I made the decision to have this done. As long as it heals well, I am good to go!

Disk herniation is very, very commonly diagnosed because a lot of people get it. Majority of people don’t need operation on it. But when that disk blows out against the location where the disk goes and what nerve it’s hitting. It’s also about what levels. The most common level that blows out is L5-S1, and that would go down your back of your butt, back of your thigh down to your calf. A different one would be L45 which would go in front of your thigh, down the front of your shin bone, down to your big toes. So there’s different patterns of pain that comes from each particular disk segment.

Activity aggravates them a lot, the twisting and turning. I see a lot of middle age patients that come through here, that’s when it starts. “I used to do this, used to do that.” What’s happening is you’re getting older. You just don’t know it. So that’s when the disk slowly start the early phases of degeneration. There’s little painful cracks in the disk space, that starts the process.

PALISADES INSURANCE COMPANY VS. HORIZON BLUE CROSS BLUE SHIELD OF NEW JERSEY (L-6136-19, MIDDLESEX COUNTY AND STATEWIDE)

Plaintiff Palisades Insurance Company appeals from a February 28, 2020 order granting defendant Horizon Blue Cross Blue Shield of New Jersey's motion for summary judgment and dismissing its complaint with prejudice. Plaintiff is an automobile insurance company that provides mandatory personal injury protection (PIP) benefits for medical expenses arising out of injuries sustained during car accidents. Pursuant to N.J.S.A. 39:6A-4.3(d), plaintiff allows its customers to designate their health insurer as primary for payment of car-accident-injury-related expenses, which election results in a premium reduction. The insureds named in plaintiff's complaint each elected to have defendant act as the primary payor. Despite the designation, plaintiff received and paid the claims, before they were properly submitted to defendant. On appeal, plaintiff asserts that it has a right to be reimbursed for the medical expenses it voluntarily paid under a theory of subrogation.

After reviewing the provisions of the New Jersey Automobile Reparations Reform Act (No-Fault Act), N.J.S.A. 39:6A-1 to -35, the Coordination of Benefits scheme (COB), N.J.A.C. 11:3-37.1 to -37.14, and case law, the court concluded that no cause of action for subrogation exists to allow a PIP carrier to pursue reimbursement from a health insurer for claims mistakenly paid out of turn. Plaintiff's remedies are to deny the claim upon receipt, recover payments from the medical providers, request that the insureds submit their claims to defendant and pursue an appeal if coverage is denied, or obtain an assignment of rights and pursue the appeals on the insureds' behalf. In addition, when a health carrier is exempt from providing benefits, the COB regulations allow the PIP carrier to recoup the amount of the reduced premium from its insured. None of these remedies were pursued by plaintiff in this case.

The court also concluded that further discovery would be futile, as the sought-after information is not capable of overcoming the legal obstacle faced by defendants: the absence of a legal right of subrogation to recoup payments mistakenly made out of turn.

Además, el tribunal declinó la invitación de los demandantes para imponer a los propietarios comerciales la obligación de advertir a los clientes comerciales del peligro obvio que representa conducir sobre dos conjuntos de líneas amarillas continuas para cruzar dos carriles de tráfico opuesto en una carretera con un número cincuenta y cinco. -Límite de velocidad de millas por hora para ingresar al estacionamiento de una tienda. El tribunal señaló que una manija de jarra cercana les brindaba a los conductores en dirección oeste una alternativa segura para acceder al estacionamiento de la tienda a través de una intersección controlada por un semáforo.

El tribunal también concluyó que el Estado tiene derecho a inmunidad para todas las reclamaciones formuladas en su contra en virtud de tres disposiciones de la Ley de reclamaciones por agravio: (1) inmunidad policial, N.J.S.A. 59: 2-4, por su presunta falta de cumplimiento de sus reglamentos con respecto al diseño de las entradas de entrada al estacionamiento; (2) inmunidad de licencia, N.J.S.A. 59: 2-5, por cualquier decisión de permisos, o supuesta ausencia de la misma, relacionada con la construcción y el mantenimiento de las entradas de los caminos de entrada; y (3) inmunidad de inspección, N.J.S.A. 59: 2-6, por cualquier presunta falta de inspección de las entradas de los caminos de entrada durante dos proyectos de mejora de carreteras después de su construcción. Schrope, appeals from a May 11, 2018 Law Division order granting summary judgment and dismissing her negligence claims against defendant Stefan Lerner, M.D.1 Tragically, Lerner's patient, B.M.D.,2 struck and killed Judith Schrope while driving. Plaintiff argues Lerner's negligent prescription of medication to B.M.D. was the proximate cause of the fatal crash. For the reasons that follow, we affirm the order of the trial court.

We discern the following facts from the record and view them in the light most favorable to plaintiff. See Brill v. Guardian Life Ins. Co. of Am., 142 N.J. 520, 540 (1995). On June 17, 2014, at around 9:45 in the morning, B.M.D., driving her SUV, struck decedent Schrope as Schrope was riding her bicycle on the right-hand side of a residential road. B.M.D. approached Schrope from behind and saw her in the distance. Visibility was clear and there were no cars approaching from the other direction. At the scene of the accident, B.M.D. gave a recorded statement to police. The officer conducting the interview asked B.M.D. if she was being treated for any medical conditions, and she responded "mild depression." She reported to the officer she had taken Paxil that day and had a glass of wine the prior evening. There is no evidence in the record that the police conducted a field sobriety check. The police did not request a blood draw or an Alcotest. A police report concluded, "[B.M.D.] made no attempt to move over to the left and safely pass Mrs. Schrope. [Even though] [t]he width of the roadway was measured [twenty] feet [nine] inches[,] which would have allowed ample space for [B.M.D.] to move over and safely pass Mrs. Schrope." Despite the fact that Schrope suffered fatal injuries, B.M.D. was only charged with and convicted of careless driving, N.J.S.A. 39:4-97, after a trial in municipal court.

On May 4, 2015, plaintiff filed a wrongful death and survivorship claim against B.M.D.3 Through discovery, plaintiff learned B.M.D. was under the care of psychiatrist Stefan Lerner, M.D, and plaintiff named him as a defendant in a first amended complaint. During B.M.D.'s deposition, she was asked about what medications she took. At the time of the crash, B.M.D. was prescribed at least six psychiatric medications, including: (1) duloxetine (Cymbalta); (2) lamotrigine (Lamictal); (3) lithium carbonate (Lithobid); (4) trazadone; (5) dexmethylphenidate hydrochloride (Focalin); and (6) methylphenidate (Concerta). B.M.D. admitted she took duloxetine, lamotrigine and lithium carbonate on the morning of the crash. When asked if she took trazodone the night before the crash, she testified she did not know, and, when asked if it was possible, she answered "it's possible." She also consumed some wine the night before. B.M.D. also testified she did not experience side effects from her medications except for Focalin.

Focalin is a central nervous system stimulant used to treat Attention Deficit Disorder (ADD) and Attention Deficit Hyperactivity Disorder (ADHD). B.M.D. admitted Focalin made her "feel a little speedy" as if she was "on speed." She initially denied taking Focalin on the day of the crash because "[i]t had such bad ramifications, I didn't want to bring it up," but later admitted it was possible she "took half of the dose I should have."

My notes describe what I've distilled from the info I've gotten from my doctor and the pain specialist. All I know is some days, I'm really hurting. But it could be worse....things always could be worse.

This is my MRI. It's kinda freaky to actually see my spine! I just found out that I'm probably going to have surgery on it. It's been hurting since December 15th, 2005. I got really drunk in San Francisco, and ran as fast as I could down the hills to catch the BART that stops running, at like 12:30 am on the weekends. I woke up the next morning and could barely move. Sadly, we didn't even catch the BART, we wandered around for hours looking for the TransBay bus, gave up and tried to wait it out at a Denny's until the 5am BART started running again. Gave up on that around 3am when I started to get nauseous and caught a $40 cab ride home again. Never Again I tells ya.

As odd as it may sound, I'm really excited to have the surgery. I haven't been able to do...well much of anything for the last 9 months, including getting out and taking pictures. I've had anti-inflammatory, steroids, x-rays, MRI's, physical therapy, and nothing has helped. So I can't WAIT!!!! I've never been to a hospital, much less had a surgery, so I'm kinda scared, but I don't really care anymore, I just want to get back to my normal life. Doc said that I won't be running any marathons, but atleast I'll be able walk, sit, and ride in a car again. This has NOT been fun. But we're working on the solution, and should have it fixed in a couple of weeks.

On remand, and ten years after a serious car accident, defendants raised for the first time the affirmative defenses of N.J.S.A. 52:17C-10 (9-1-1 dispatcher immunity) and N.J.S.A. 59:5-4 (failure to provide police protection). We concluded that the judge erred by (1) failing to resolve whether defendants waived the new defenses; and (2) dismissing the complaint relying on Royster v. N.J. State Police, 439 N.J. Super. 554 (App. Div. 2015), aff'd as modified, 227 N.J. 482 (2017) (dismissing a claim under the Americans with Disabilities Act).

This case involves a misapplication of Royster v. N.J. State Police, 439 N.J. Super. 554, 561 (App. Div. 2015), aff'd as modified, 227 N.J. 482 (2017), which held that "the doctrine of state sovereign immunity preclude[d] [a] plaintiff's [Americans with Disabilities Act (ADA)] claim, even though [the] defendants [had] not fully raise[d] that argument until their motion for a judgment notwithstanding the verdict (JNOV)."

Plaintiff filed claims, not under the ADA, but rather, under the New Jersey Tort Claims Act (TCA), N.J.S.A. 59:1-1 to 12-3, which unlike under the ADA, are not federal law claims. By enacting the TCA, the Legislature waived state sovereign immunity, subject to the statute's provisions.

Plaintiff appeals from orders dated December 7, 2015 and January 19, 2016 entered on remand granting summary judgment to South Jersey Transportation Authority (SJTA) and the New Jersey State Police (NJSP) (collectively defendants). In support of their motions, defendants belatedly raised the affirmative defenses of N.J.S.A. 52:17C-10 (9-1-1 dispatcher immunity) and N.J.S.A. 59:5-4 (failure to provide police protection).

Plaintiff maintains that the judge exceeded the scope of detailed remand instructions from this court and the Supreme Court, and he otherwise erred as a matter of law.

In a TCA case, when a public entity substantially waits before raising the affirmative defenses of N.J.S.A. 52:17C-10 and N.J.S.A. 59:5-4, we hold that the judge must first determine whether defendants waived those defenses. That is so because waiver negates reliance on the defenses. If the judge concludes that a public entity timely raised, and has not waived these affirmative defenses, then the judge should address whether dispositive relief is appropriate.

Here, the judge granted summary judgment before resolving whether defendants waived the affirmative defenses, even though defendants raised them for the first time on remand, which occurred ten years after the accident; those ten years included three years of extensive pre-trial litigation, a lengthy and expensive trial, an appeal to us, and an appeal to the Supreme Court. We conclude that defendants waived the new affirmative defenses, reverse the orders, and re-remand for a liability trial on an expedited basis due to the age of this case.
