The Homestead Act offered a free quarter section of land (160 acres) for improving the land and living on the land for five years. To claim land under the Homestead Act of 1862, one had to be a U.S. citizen, or have filed an intention to become on; at least 21 years old; single, or head of a household; never bore arms against the United States. To “prove up” on one’s claim or take ownership of the property they had to build a dwelling of at least 12 x 14 feet; cultivate at least 10 acres; live on the claim for five years. Mahlon S. Gore, a Vermillion printer, may have filed the first homestead claim in the U.S. He filed on land in Union County near the Big Sioux River, right after midnight on January 1, 1863, when the law took effect. Shown here, Mahlon Gore’s filing papers for the first homestead in Dakota Territory.
