I got this screenshot from here: www.brudirect.com/index.php/2010031417719/Second-Stories/...
No mail requesting the use of my photo. No link back to my Flickr account. Nothing.
My friends, if this thing happened to you? What would you feel or think?
What next? Any suggestions?
It was an image of Marina Bay taken with my Nikon D7100 and not a Leica camera which should be the case being a Leica workshop event. They did not claim responsibilities and just have the image taken down without a proper investigation and explanation. Unbecoming attitude from a corporate giant.

I use a service called Pixsy which tracks if any of your images have been used with-out consent and they have a tie up with Flickr. Have found this image on two commercial website and in both instances they have cropped out the copyright and used for their commercial purposes. Must admit saw RED with that and issued them both a take down notice thru the Pixsy service which can now chase these issues legally in New Zealand. Will see how it all pans out. Some comments i have had are for me to bill them a extremely aggressive fee...if you wonder about your own stuff give the Pixsy thing a try.
Another example of the 'jimi hendrix jewellery' available. This one's only 39,99€. Quite nice in fact. The photo doesn't do it justice as it was done without a flash to avoid spoiling the picture. I'm afraid I know nothing of the techniques of photography but am glad that digital technology exists.

very last update: american express behaved quite elegantly and i trust the error was sincere.
last update: it turns out american express used this image without notifying me in one of their banner ads, linking to their mylifemycard website. interesting that such a large company needs to go to flickr to steal images. the beauty of flickr is a number of people who had seen this image notified me. talk about the power of a community!
this needed luck and patience.
ok, due to unbearable pressure, i'll try to explain. it is really not that difficult, try this yourselves at home, preferrably first on borrowed children. just like k_rio_k says. synchronised rotation of the spinner, the spinnee and the photographer. the trick is to get both the focus and the right angle to the light. 1/15 of a sec exposure or slower.
I like when people see my models and incorporate some of my ideas into their own. It's cool. I also look at other people's models and they often inspire me. What's not cool is pretending that ideas you got elsewhere are your own. And what's even less cool is copying somebody else's models and selling them and, when confronted, playing stupid. Case in point: this guy. The comparison shows nine examples of models that I designed that he copied and is actually selling via facebook as designs "he created". Credit where credit is due, the reverse engineering can't have been easy. That said, the bits where his models are different are usually the ones where he failed.
For the record: he is the owner of his images, but I claim fair use of them here to illustrate what he is doing.

Pirated, poorly applied instances of my designs brought to you care of SCAmazon 1 of x (with x being a large number I'm afraid)
Some of these would be laughable if there weren't so many of them - and if they didn't mean so much work by me to issue take down notices - costing time & energy that could be better spent doing other things.

And here's yet another designer grappling with the same issue of Spoonflower theft on Amazon: karapeters.design/copyright/
The irony is that Spoonflower - my publisher - hosts its designs on AWS - yet has no business-to-business relationship that could protect its investment. I guess that's the free market for you! Meanwhile Jeff Bezos buys a $114m house! Nice one Jeff!

Laura McLaughlin of Ink Global wrote:
Dear Mr Cho
Thank you for your email. In order to resolve this matter as quickly and as amicably as possible, we agree to your request of S$750 (plus a credit in a future edition of the magazine). I apologise again for what was, I must assure you, an honest mistake by Ink.
I will contact Gus Low directly as per your suggestion, and payment will be made to you tomorrow.
Kind regards
Laura
My reply:
I am sorry Laura,
it's already too late. The media has already been fed and I can't stop it now. Besides me there are 8 other photographers with the same plight in line hoping to get this truth out to the public as a wake-up call to deter others.
Stealing images from not one but nine photographers in a single edition of the May 2011 Jetstar in-flight magazine is a SERIAL CRIME. It's no more an honest mistake. Ink Global is an international company. You should have known better as a legal counsel.
At this moment, it's no more about compensation. It's the principle to safeguard photographers from such issues in the near future.
We have given you enough time to make amends but you did not comply.
For this I have already wasted so much of my time communicating with my supportive groups which burns up my professional time.
Ink Global will have to face the music for this as you have shown disrespect to the nine photographers from various countries who are being ripped off their images from flickr without their knowledge. The photographers only came to know through Pat Brunet of EventPhotos who started investigating a complaint from a flickr friend of his.
As of now, I will let the officials of the Intellectual Property of Singapore decide how they will address this copyright infringement issue. Expect to see more exposure over the worldwide web. Nothing I can do to stop it now.
---------------------------------------------------------------------------------------------------------------------------------------
After contacting Ink Global, their Design Director, Peter Stephens hope to get away with just a $100 fee as compensation claiming it was an oversight on their part. Well if every publisher give us the same cheap excuses there will be no more food on the table for photographers eventually.
When I refused their offer they bump it up to $250 and again to $500 like a stock trading. My request was $1500 as penalty for the crime to settle the case in private and they consider that blackmail. Would the judge let you off with just a reprimand if you rob a bank and say sorry only when caught?
To my surprise after Pat from Event Photos investigated deeper into Jetstar in-flight magazine, 8 other photographers from flickr came forward with complaints about their stolen images appearing on the same May 2011 edition. This gets worse. It becomes a serial crime. This is no overlooking matter and definitely not an honest mistake anymore by Ink Global..
I guess they must have done this several times and got away with it. Obviously Ink Global tried to patch things up by paying in small doses. It may work on one or two weaklings but not all. So I was being threatened with legal action should this news leak to the media. What wrong have I done I ask myself. They committed a serial crime and I speak the truth with evidence in hand. Nothing can stop me from feeding honest information to the media.
Ink Global is unaware that Pat has done research and communicated with photographers involved and will be exposing the infringement issues over his blog. This action should create awareness that such stealing activities are coming from bigger corporations.
I am just a small fry who have no budget to engage a lawyer but hopefully the media exposure will hit the perpetrators hardest on their global image. I hope this incident will set an example to deter others from trying to steal images from the internet.
If you think your image appeared in Jetstar in-flight magazine (any edition) without permission, please report it to:
Pat Brunet of Event Photos email: pat@eventphotos.com.au
Please copy this to you friends if you can. Thank you.
Hope all is well.

Does this really need a description? Pretty self-explanatory, I think. Aside from saying that yes, Graysen is still nursing. For reals, not just on naked Barbie dolls....
Mickey seems to be getting a kick out of this.
This picture will be featured on a postcard in the UK and has appeared in the July/August issue of Mothering magazine, in Letters. :)
It has also been lifted without my knowledge or consent so many times that I have watermarked it. Following up on all the stolen instances online, which will take some time!

In 2008 I had this kooky idea to take my then 4yo son out to an abandoned road and throw him in the air. So I did, and honestly he hates it, so the real photo he is only maybe a couple inches off my hand. But with Photoshop, I created the final result with him many feet over me. And yeah, I got about 2000 views on that. This was back in my D200 days.
Then two nights ago, my friend on Facebook shared a funny meme that’s been circulating around the internets the last few days. I was shocked to find it was my photo, manipulated and annotated with the following phrases. And I’ll admit, it’s funny. (as long as Child Protective Services doesn't knock on my door)
I contacted one of the places I found this meme posted and asked them to take it down since it was theft. They laughed and told me to “tell that to everyone”; they found it on a few other spots. Oh great. So come to find out it’s been all over the internet. Front page of Redit. On joke pages on Facebook with 10s of millions of fans. Tumblr. Pinterest. Google+
Now when it comes down to it, no one is making money on this. No one is using my face on a naked body, or demonizing Dylan. No one is humiliated or harmed. It’s good fun, and it made me laugh too. But just amazing what a little theft and creativity can do.
And no, I’m still not going to watermark my images. I think they’re ugly. But not as ugly as the Star Trek font they used here.
Wellfleet, MA.
Here's a re-post of a shot I took back in 2009. I was recently asked by a (not for profit) organization, who had seen this pic on flickr, if they could use it, giving full credit to me. I was fine with that. I was pleased they asked and was happy to provide them with a bigger file - back in the day flickr had file size limits and they were quite small.
Like most people (I think) my pics have been 'borrowed' from flickr and re-used / blogged / etc without my permission. I don't care that much about it but it's interesting to see who the culprits are.
There is a very useful website that can scan the internet and see where your pictures have been used, if you don't already know about it.
Tin Eye (www.tineye.com) do a really great free reverse image search. So copy the URL of your flickr pic and just paste it in. See who is using that pic without your permission.

Maybe that's helpful to some folks - I'm not too fussed about it. I expect it these days.
I am heading off somewhere I have never been before. Back soon.

That's right, I trolled my Flickr contacts' photos for source images, using no image where downloading had been disabled. There are fourteen images in all, combined to make this one kaleidoscope. Most have been stretched or twisted in some way. The original is almost 8000 pixels/side, and I've attached a Creative Commons license to the half-size version here so you can check out the details. (Or borrow back from me, I guess.)
Not sure if this is ethical or not. (Actually, I checked - it's not.) If you spot your own work in there, feel free to bust me. It's too bad, this was a really fun way to gather a variety of textures. But, given the intense nature of copyright law, in the future this experiment will have to be limited to images with open copyrights. (So much for my mandala of artistic nudes.)
One of my pictures got "flicked" from Flickr and got published in a supplement of TOI's called, "what's hot", dated 18th July'08. I happened to take a look at this supplement very much by chance. I have no idea, how many such images are being used on a daily basis - they could be anyones.
On contacting the editor, I was told that it is common practice to "use" free images from the net! Plagiarism in its full glory. They actually went ahead and used an image with "all rights reserved" clearly mentioned on my page. Nowhere does it say that this image is free to use. Since the time I have asked for compensation I have not received any response from them.
UPDATE - I have heard from Ms. Poonam Singh, here is the update.
UPDATE 2 - After blogging about this issue and resisting any negotiation, I have finally received the compensation I had initially asked for as well as corrigendum. Hope they learnt a lesson for all times. This whole cycle took 3 months.
Khāqāni or Khāghāni (1121-1190 AD) who was born in Shirvan, under the Shirvanshah (a vassal of the Seljuk Empire) and died in Tabriz, was a great Persian poet. He was born in the family of a carpenter in Melgem, a village near Shamakhy. Khaghani lost his father at an early age and was brought up by his uncle, Kafi-eddin Umar Shirvani, a doctor and astronomer at the Shirvanshah’s court, who for seven years (till his death) acted "both as nurse and tutor" to Khaghani. Khaghani's mother who was originally of Nestorian faith, later accepted Islam. The poet himself had a remarkable knowledge of Christianity and his poetry is profuse with Christian imagery and symbols. His master in poetry was the famous Abul-Ala Ganjavi who introduced him to the court of Khaqan Manuchehr Shirvanshah and Khaqani got his title from this king. He also married daughter of Abul-Ala.
In his youth, Khaghani wrote under the pen-name Haqai'qi ("Seeker"). After he had been invited to the court of the Shirvanshah Abu'l Muzaffar Khaqan-i-Akbar Manuchiher the son of Faridun, he assumed the pen name of Khaghani ("regal").
The life of a court poet palled on him, and he "fled from the iron cage where he felt like a bird with a broken wing" and set off a journey about the Middle East.. His travels gave him material for his famous poem Tohfat-ul Iraqein (A Gift from the Two Iraqs), the two Iraqs being 'Persian Iraq' (western Iran) and 'Arabic Iraq' (Mesopotamia). This book supplies us with a good deal of material for his biography and in which he described his impressions of the Middle East. He also wrote his famous qasida The Arch of Madain beautifully painting his sorrow and impression of the remains of Sassanid's Palace near the Ctesiphon.
On return home, Khaghani broke off with the court of the Shirvanshah’s, and Shah Akhsitan gave order for his imprisonment. It was in prison that Khaghani wrote one of his most powerful anti-feudal poems called Habsiyye (Prison Poem). Upon release, he moved with his family to Tabriz where fate dealt with him one tragic blow after another: first his young son died, then his daughter and then his wife. Khagani was left all alone, and he soon too died in Tabriz. He was buried at the Poet’s Cemetery in Surkhab Neighborhood of Tabriz.
Khaghani left a remarkable Persian-language heritage, which includes some magnificent odes-distiches of as many as three hundred lines with the same rhyme, melodious ghazals, dramatic poems protesting against oppression and glorifying reason and toil, and elegies lamenting the death of his children, his wife, and his relatives.

Yes - we've all ordered that really good deal from amazon, and yes they are too good to be true.
1. The consumer (Amazon Customer) usually has no idea this is going on. They purchase a design they like on their chosen product at a cheap price without a second thought as to who the artist is and whether they are purchasing an authentic product.
2. The products are made using screen captures of low resolution art files found on artists websites, google image searches or from artist licensed partners like Fine Art America, Society6, and Zazzle.
3. The fake products are mostly made by Chinese sellers, but they have also been found globally being resold by many U.S and European sellers and discount warehouses. China does not enforce international copyright treaties and their courts generally do not acknowledge intellectual property rights.
4. These products are often not as described, made from inferior materials and from very low resolution images that make the artwork look fuzzy and/or off-color. These low quality products often still have artist watermarks still on them. They usually sell at incredibly cheap prices and more often than not they ship from China or outside of the USA.
Why does Amazon let this happen?
$$$$ greed. We can assume the only logical reason Amazon allows and supports the illegal copyright infringement so strongly is that they can make more money selling a larger volume of cheap counterfeits vs a smaller volume of more expensive artisan original products. Amazon makes money on every counterfeit item sold. From membership fees paid by counterfeit sellers as well as a fee for every item sold and from fulfillment fees distributing these items from their warehouses.

Doesn't a registered Copyright protect Artists? Why not sue them?
An artist in the USA has an immediate copyright at the point of creation. The copyright however, must be registered with the government in order to take legal action in court. There really is no law enforcement to help an artist. There is no assistance from the police, the FBI or the DOJ or the US government in enforcing copyright laws in online marketplaces. All of this is left up to the civil-suit court system. The U.S. copyright registration is much like a fancy extended warranty certificate from a company that went bankrupt.
The Chinese economy and the companies like Amazon, Ali Baba and Ebay that support these illegal activities count on this lack of enforcement. They know international lawsuits against anyone in China is a fruitless effort. These companies hide behind their "Safe Harbor" status that protects them from liability of what sellers do in their marketplaces. This then allows them to create a complex system to encourage the copyright infringements and profit from it directly without being held responsible for it.
Once you've taken away an artists income - they have no money to hire a lawyer. If somehow they do, companies like Amazon have a legal army that will tie up your case until you have not a penny left.

The Dept. of Information and Tourism has admitted that its contractor; E-Century Information and Technology, has infringed my copyright by using my Taipei 101 fireworks NY2008 to merge with other photo to post on the front page of "taipeitravel.net" and The Department of Information and Tourism has aksed the contractor to be responsible for the consequences.
The supervisor (a.k.a. Creative Director) Cecilia Chang from E-Century Information and Technology, was trying to appeal to understanding that their designer was young and inexperienced not knowing what he did was worng and that Taipei Travel Net was a non-profit (please do not forget E-Century company makes profits) website...
2010/3/3, The verdict from Taipei District Prosecutors Office judged: in this criminal (copyright) law case, it (E-CENTURY INFORMATION & TECHNOLOGY CO.; the profitable contractor of Taipei City Government) is legal (has legitimate reasons *) to use my work for public purpose despite my declaration of "All rights reserved" and without my permission...
*according to government procurator's report, the major legitimate reasons incl:
fireworks are only small part on this front page, my works (fireworks shot) are not "originality" and taipeitravel.net is a non-profit website.
2010/4/16, receive a notice from Taiwan High Prosecutors Office that they have asked Taipei District Prosecutors Office continue investigation about this copyright law case.

Did you know that Amazon.com is the largest distributor of counterfeit goods in the world? It's true. Amazon across all of their international domains distribute billions of dollars of counterfeit goods featuring big name brands and the intellectual property of thousands of independent designers, artists and entrepreneurs. These individuals make not one penny from the sale of these goods as they watch the earnings from their creations get funneled directly into China. Amazon hides safely behind a legal loophole called "Safe Harbor" that allows them to sell these goods on their site via marketplace sellers while profiting from them through fees and services. It's been so profitable for them, they keep building more tools and services to support the illegal product trade and often ignore intellectual property holders complaints. They get away with it again and again.

Do You Know What's Going in Your Amazon Shopping Cart? ~ The Wall Street Journal
The folks from 3M (the Post It Notes people) contacted me through Flickr more than a year after my 2006 Post It Notes car photos had become a phenomenon.
Michelle Gebbie, eMarketing Supervisor from 3M Office Supplies Division, was seeking permission from me to use the Post It Note Car photos in marketing materials for a contest that the photos had inspired.
I responded, asking her where the photos would be used and what their budget was. She responded saying that they would be used for 6 months on in-store displays, and that they would not pay more than it would cost for them to copy our car and take their own photos. I respectfully asked for a little more than that and she stopped returning emails.
They really did do a good job copying it, didn't they? Even Walt thought it was his own car. Now I am getting tons of comments and notes from people saying "I saw your photo at Staples" (or OfficeMax, Office Depot, etc.). Look at their YouTube video. Clearly they wanted people to see it in the store and think it was the same car they'd seen before on Flickr and YouTube.
Was written up here and picked up lots of places.

I was pleasantly surprised to see a new stall down at St Georges selling photographs. Recognising one of the photos from flickr i enquired and was told that the fella was indeed on flickr.
He told me that MOST were his and that a few were downloaded off the net.
This annoyed me and i told him it was copyrighted work and that he no right to do that. I asked him how he would feel about someone else downloading his work and selling it on without giving any money to him.
Smilingly he told me that it would be great to see it being sold. He also tried to justify it by saying thats why you only put up small images unto the net.
Now as someone who had a stall on Royal avenue for a good few years i admire the fellas get up and go to sell his work.
However by selling work that, by his own admission, isn't his and is downloaded from the net, he undermines any credibility he might have thought he was gaining.
This is wrong and essentially is theft .
Hamshahri newspaper published my photo on its first page. My image was copyrighted under Creative Commons License (by-nc-nd) meaning that:
Attribution. You must attribute the work in the manner specified by the author or licensor.
Noncommercial. You may not use this work for commercial purposes.
No Derivative Works. You may not alter, transform, or build upon this work.
Unfortunately, Hamshahri newspaper violated all of the above. There was no attribution, they used it on the first (cover) page of a highly commercial daily newspaper, and they somehow modified it. Interestingly, Hamshahri is the most profitable newspaper in Iran. However, it seems that they do not like to pay for photos; they just hire someone to surf the Internet, mostly Flickr, and choose some free photos for them. Hamshahri belongs to Municipality of Tehran and its editor in chief is Ali Asghar Mahaki.

American Airlines or whatever, my Image on Kawana Golf Resort (below) was used without permission on their web promoting Golf Travel. Image theft is a Crime and must be dealt with severely. It's a shame that corporate offices are setting such a bad example. What if we board AA without a ticket if that is the case? Fair warning has been given but they did not respond faithfully. What more can I say? Merely taking it off the web after notification does not make them come clean. Evidence is already on file and available to all news desk soon...
Beaton's Coaches of Cambuslang took delivery of NYS 257V a Volvo B58-61 with Duple Dominant II C53F coachwork in March 1980.
It is seen at Strathclyde Country Park when new and featured in a Duple Coachbuilders advert in a Coachmart magazine from 1980.
Please let me know if anyone is concerned with the copyright status of this 30 year old photograph as a Trathens Starider liveried Volvo B10M with Van Hool Alizee coachwork was removed from my Flickr photostream today after a complaint from someone who has alledgedly claimed copyright on it.
After reading through Flickr's copyright smallprint, the first action asks the complainer to ask the person displaying the 'offending' image to remove it first before lodging a copyright infringement complaint. Not in this case and I am now under threat of expulsion for trying to share some interesting images in the pursuit of a hobby.
