Time and time again, when for-profit corporations and politicians have tried to sell out the health and safety of the American people, our courts have stopped them in their tracks. In the last four years alone, out of the 83 times that Trump has already been sued for rolling back key environmental protections, he has lost or backed off 69 times. But now, the future of our courts—and the future of our planet—are in grave danger.
In 2007, after the Bush-era Environmental Protection Agency (EPA) chose not to regulate the effects of vehicular emissions, the Supreme Court kept them in check. Through a narrow 5-4 victory, the Court established that the EPA had both the authority and responsibility to regulate dangerous greenhouse gasses, chastising them to remember their mandate of “[p]rotecting the public’s ‘health’ and ‘welfare.’”
Since it was decided, Massachusetts v. EPA has been pivotal in shaping U.S. policy on climate action and is as much a bedrock to the environmental movement as Roe v. Wade is to the pro-choice movement. But with the vacant Supreme Court seat created by the death of Justice Ruth Bader Ginsburg, both face an uncertain and potentially grim future.
Eight months before the 2016 election, Senator Mitch McConnell (@mcconnellpress) refused to hold confirmation hearings for President Obama’s nominee to replace conservative Justice Antonin Scalia because, “[W]e believe that the American people should seize the opportunity to weigh in on whom they trust to nominate the next person for a lifetime appointment to the Supreme Court.” But even though voters across the country are already casting their ballots, he is now singing a different tune, unabashedly declaring that “President Trump’s nominee will receive a vote on the floor of the United States Senate.”
So… what is it then, Mitch? What is more important: hearing voters or ensuring that your anti-science agenda will be able to stifle environmental action for decades to come?

More than 1,200 California Nurses Association/National Nurses Organizing Committee registered nurses, environmental and healthcare activists, and students on Dec. 3 marched and rallied in Los Angeles to demand that the world’s leaders, now convening in Paris for the United Nations Conference on Climate Change, adopt a binding and enforceable climate treaty, commit resources to fund the transformation to clean, renewable energy including a just transition program for those who now work in the fossil fuel industry, and call on wealthy, developed countries to provide resources for the less-developed countries to act on climate, with funding coming from a carbon tax and the Robin Hood Tax.
