small island in Greece, we send solidarity to the Kurdish people.

No one said that the US should stay in the Middle East forever, all the Kurds wanted was to create peace in Northern Syria (Rojava) which they've achieved to create. The Kurds are one of the most trusted allies of the United States, they fought together, they died together, all these honorable men and women who gave up their lives to defend humanity from the hands of Isis, it's just incredible, but then to abandon them to allow Turkey to commit ethnic cleansing on the Kurdish people, with use of chemical weapons, is such a betrayal. The Kurds saved the world from Isis, now the world must save the Kurds from Turkey! the Kurdish freedom fighters deserve much better...

The kurds has declared the end of ISIS.

11,000 fighters died in the war against ISIS and 21,000 people were severely injured. Many more civilians were either displaced, tortured, captured, enslaved or killed. Many of them are women, almost all of them, except internationalist revolutionaries, are people from the Middle East, from different ethnicities and religions. The majority of them are people from working class backgrounds. Next time racist, xenophobic, sexist fascists try to fear-monger, remind them not only of who really defended humanity against ISIS, but also of how fascism can and will be defeated when people organize

- London, UK, 28 July 2025The Hind Rajab Foundation has today filed a formal criminal complaint with the UK Metropolitan Police War Crimes Unit regarding the Israeli military assault on the British-flagged humanitarian vessel Handala in international waters on the night of 26–27 July 2025

The complaint, lodged under the Geneva Conventions Act 1957 and the International Criminal Court Act 2001, urges UK authorities to open an immediate investigation into grave breaches of international law and war crimes committed by Israeli forces.

The assault was carried out by the Shayetet 13 naval commando unit, under the command structure of the Israeli Navy, whose Commander-in-Chief is Vice Admiral David Saar Salama (b. 1969). The complaint also targets officials within the Israeli military and government who may have authorized, planned, or facilitated the operation. The Hind Rajab Foundation is calling for these individuals to be identified, investigated, and—where evidence permits—prosecuted or arrested under UK jurisdiction.

At the time of the raid, the Handala was sailing approximately 49 nautical miles off the coast of Gaza, carrying 21 unarmed civilians, including:

* Chloé Fiona Ludden, a British humanitarian volunteer

* Emma Fourreau (b. 1999), Member of the European Parliament (France)

* Gabrielle Cathala (b. 1992), Member of the French National Assembly

* Jacob Berger, a Jewish-American activist

* Journalists, lawyers, and aid workers from 12 countries

All were detained without legal basis and forcibly taken to Israel.

The ship’s humanitarian cargo—baby formula, medical supplies, and food—was confiscated, and communications were cut immediately after Israeli forces boaed the vessel.

The Handala is a British-flagged vessel, and as such, constitutes an extension of UK sovereign jurisdiction. The seizure of the ship and arrest of its passengers in international waters constitutes an assault on British legal territory, a violation of the UN Convention on the Law of the Sea (UNCLOS), and a grave breach of the Fourth Geneva Convention. It also directly defies the binding orders of the International Court of Justice, issued in early 2024, which require the unimpeded delivery of humanitarian aid to Gaza.

The Hind Rajab Foundation is requesting the following from UK authorities:

1. Immediate opening of a criminal investigation into the operation;

2. Identification and questioning of all 21 passengers, especially UK nationals;

3. Legal action against Vice Admiral David Saar Salama (b. 1969), Shayetet 13 commanders, and any political or military officials responsible;

4. Placement of suspects on watchlists and preparation of arrest warrants for any who may enter the UK;

5. Coordination with Interpol, the International Criminal Court, and UN mechanisms to ensure international accountability.

This case follows the pattern of previous illegal interceptions, including the recent attack on the Madleen and the 2010 Mavi Marmara raid. The Handala incident is not isolated—it is part of a systematic campaign to criminalize humanitarian aid and suppress civilian solidarity with Gaza under the guise of military enforcement.

The Hind Rajab Foundation will not relent.

We are committed to exposing and confronting every act of illegality and brutality carried out under the cloak of state power. The attack on the Handala is an attack not only on aid workers and civilians—but on international law, human dignity, and the very principle of accountability.

Justice must be done. The perpetrators must face consequences.

- NICOSIA, Cyprus, 25 July 2025The Hind Rajab Foundation has filed a formal criminal complaint with the authorities of the Republic of Cyprus demanding the immediate arrest of Tameer Mulla, an Arab Druze Israeli soldier currently on Cypriot soil, for his direct involvement in war crimes, crimes against humanity, and acts potentially amounting to genocide during Israel’s onslaught in the Gaza Strip between 2023 and 2025.

Tameer Mulla served in the 101st Paratroopers Battalion of the 35th Paratroopers Brigade of the Israel Defense Forces (IDF), a frontline unit that played a central role in the destruction of Palestinian cities, hospitals, and refugee camps. Mulla entered Cyprus on 18 July 2025 and is believed to still be in the country. The complaint includes overwhelming documentation of Mulla’s personal participation in grave violations of international law. These include:

1. Deliberate Attacks on Civilian InfrastructureArticle 8(2)(b)(ii) of the Rome Statute.

2. Systematic Forced Evacuation of Protected Persons

On 26 February 2024, Mulla personally oversaw and documented the forced evacuation of civilians from Nasser Hospital in Khan Younis. The hospital, besieged for weeks, housed over 10,000 displaced persons, 450 patients, and 300 medical staff.

Under threat of snipers, shelling, and a complete communications blackout, civilians—including children, the elderly, and wounded patients—were removed in a coercive and humiliating operation. This constitutes the war crime of unlawful transfer of protected persons under Article 8(2)(a)(vii) of the Rome Statute.

3. Attacks on Educational Institutions

Mulla was present at and documented the destruction of the Jabalia Elementary Boys School in May 2024. Footage shows the school facility in ruins, likely destroyed during or immediately after an IDF operation in the area. His presence at the scene and glorification of the attack raises strong grounds to prosecute for attacks on buildings dedicated to education, in violation of Article 8(2)(b)(ix) of the Rome Statute.

4. Glorification and Incitement

Mulla posted numerous videos, stories, and reels mocking the destruction of Palestinian civilian infrastructure. These include:

* Sarcastic videos inside looted or destroyed homes, barbershops, and electronics stores;

* A montage likening his role in Gaza to a video game, including footage of live fire and explosives;

* A Netflix-style graphic listing the Palestinian cities he helped destroy: Al-Zeitoun, Gaza City, Rimal, Shuja’iyya, Khan Yunis, Deir al-Balah, Jabalia.

This public glorification of war crimes and devastation reflects clear intent, ideological motivation, and a lack of remorse, strengthening the case for prosecution under both Cypriot and international law.

Cyprus is bound under universal jurisdiction, its own Penal Code, and international treaties to prosecute individuals on its territory accused of crimes against humanity and war crimes—even when committed abroad.

The Hind Rajab Foundation demands that the Republic of Cyprus act immediately to:

* Arrest Tameer Mulla without delay;

* Prevent his departure from the country;

* Initiate a full criminal investigation and prosecution;

* Cooperate with international bodies to ensure justice is served.

The people of Gaza are not invisible. Those who destroy hospitals, homes, and lives with impunity must be held to account.

Boom, Belgium, 21 July 2025In what may become a turning point in the global pursuit of accountability, Belgian federal police have arrested and interrogated two Israeli soldiers credibly accused of war crimes in Gaza. The action came in response to an urgent legal complaint filed by the Hind Rajab Foundation and the Global Legal Action Network (GLAN) earlier this week.

The suspects were identified and arrested with a clear show of force at the Tomorrowland festival in Boom. After being taken into custody, they were formally interrogated and released. The Belgian Federal Prosecutor’s Office has confirmed that a criminal investigation is now underway.

This development is a significant step forward. It signals that Belgium has recognized its jurisdiction under international law and is treating the allegations with the seriousness they deserve. At a time when far too many governments remain silent, this action sends a clear message: credible evidence of international crimes must be met with legal response — not political indifference.

We do not claim that justice has been served — not yet. But we believe something important has begun. For the first time in Europe, Israeli suspects linked to crimes in Gaza have been subjected to formal arrest and questioning. This would not have been possible without the strength of the law and the will to apply it.

To the victims and survivors in Gaza: we see you, we hear you, and we carry your demands for justice forward.

To those who believed impunity was permanent: this moment shows that it is not.

And to states watching around the world: universal jurisdiction is not just a principle — it is an obligation.

The Hind Rajab Foundation and GLAN welcome this breakthrough with determination and humility. We will continue to support the ongoing proceedings and call on Belgian authorities to pursue the investigation fully and independently.

Justice must not stop here — and we are committed to seeing it through.

- Brussels, Boom, 19 July 2025 - Two individuals responsible for grave international crimes—including war crimes and genocide committed in the Gaza Strip—are currently on Belgian soil, attending the Tomorrowland music festival in Boom. The Hind Rajab Foundation, in association with GLAN, has submitted urgent legal complaints to the Federal Prosecutor, calling for their immediate arrest and prosecution under Belgium’s universal jurisdiction laws.

These individuals are not fringe actors or incidental participants. They are directly implicated in some of the most egregious crimes committed during Israel’s ongoing military campaign in Gaza, including:

* Indiscriminate attacks on civilian areas, homes, and hospitals;

* The use of torture and human shields;

* Mass arbitrary detention and forced displacement of civilians;

* And the deliberate infliction of conditions calculated to destroy the Palestinian population, consistent with genocide under Article 6 of the Rome Statute and the Genocide Convention.

Givati Brigade Flag Waved

A group of young Israeli men were yesterday seen at Tomorrowland while waving the flag of the Israeli Givati Brigade — a unit extensively documented for its role in the systematic destruction of civilian infrastructure in Gaza and for carrying out mass atrocities against the Palestinian population.

The Givati flag, publicly displayed in the heart of Belgium, is not just a military symbol. It has become, for millions, a symbol of impunity, destruction, and ethnic cleansing. Its appearance in Boom raises urgent political questions: Why are those involved in grave international crimes able to walk freely, celebrate in public, and glorify their actions without consequence?

The situation is not isolated. Just days ago, in Dirkputstraat in Boom, a Palestinian flag was forcibly torn down from a private residence by a group of young Israeli men of military age, in an act the resident described as deeply intimidating. The symbolism is stark: while war crimes suspects display their military insignia freely, the symbols of their victims are attacked.

This convergence—of impunity, intimidation, and silence—demands a clear response from Belgian society and its legal institutions.

A Legal Obligation, Not a Political Option

Belgium is bound by international law to investigate and prosecute individuals suspected of genocide and war crimes when they are present on its territory. These obligations arise from:

* The Genocide Convention (1948),

* The Rome Statute of the International Criminal Court (ratified by Belgium in 2000),

* And the Belgian Penal Code, which incorporates universal jurisdiction over war crimes, crimes against humanity, and genocide.

A State Party is legally required to prosecute or extradite genocide suspects the moment they are found on its soil—regardless of nationality or rank.

The evidence presented by the Hind Rajab Foundation is clear, credible, and legally sound. The individuals currently in Belgium are accused of acts that:

* Destroyed entire neighborhoods in Gaza under the guise of “security”;

* And deliberately targeted Gaza’s capacity to survive—its water systems, agriculture, housing, and medical infrastructure.

«These actions were not incidental. They were executed with intent—to destroy a people, to erase a future» said HRF's Chairman Dyab Abou Jahjah (b. 1971). «If Belgium allows these individuals to leave unchallenged, it will be complicit in granting impunity to the perpetrators of genocide» he added.

Belgium Must Act Now

Tomorrowland, a global stage of culture and celebration, must not become an unwitting sanctuary for war criminals. Belgium has long prided itself on supporting international justice. That legacy is on the line.

We therefore urge:

* The immediate arrest of the individuals named in the complaints;

* The opening of formal investigations and prosecutions;

* And measures to prevent any departure from Belgian territory, including the seizure of travel documents and devices.

There is still time to act. But that time is quickly running out.

- Source - Hind Rajab Foundation: War Criminals Walk Free at Tomorrowland: HRF Files Urgent Complaints (Publ. 19 July 2025)

- Lisbon / Brussels, 14 July 2025 - The Hind Rajab Foundation has filed a formal legal complaint in Portugal against Israeli sniper Dani Adonya Adega for his role in the Israeli genocidal campaign in Gaza, which involved grave violations of international law, including targeted killings of civilians during a ceasefire and the appropriation of civilian property for military use.

The complaint was submitted by Portuguese human rights lawyer Carmo Afonso, and is based on extensive documentation gathered by the Foundation’s legal and investigative teams over the past months. The Hind Rajab Foundation has verified Adega’s presence in Lisbon, Portugal, where he was photographed and geolocated in July 2025.

Adega, a sniper affiliated with the 8114th Battalion of the Israeli army, served in Gaza under the 252nd Division, commanded by Brigadier General Yehuda Vach. This division has been widely condemned for establishing the Netzarim Corridor "kill zone», a deadly passage through central Gaza where civilians—many of them children—were systematically shot on sight by sniper teams and armored patrols.

Adega himself publicly boasted about lethal sniper activity, posting an image on social media with the caption:

“4 rounds, 0 misses 🎯🔥”

The post was made during a declared ceasefire in early 2025, at a time when Palestinian armed groups had suspended operations. During that ceasefire alone, over 170 Palestinian civilians were killed, with sniper fire accounting for many of the documented deaths. Adega’s social media posts show him operating from inside civilian buildings in Gaza, smiling and posing in uniform while armed with a sniper rifle, often in destroyed residential areas.

«This is not only a matter of justice for Gaza—this is a test for Portugal,» said a spokesperson for the Hind Rajab Foundation. «Adega is not hiding. He is walking freely in a European capital after boasting about sniper kills committed during a ceasefire. Portugal must act.»

Under the principle of universal jurisdiction, Portugal has the legal authority—and obligation—to detain suspected war criminals found on its territory. The Hind Rajab Foundation is calling on Portuguese authorities to immediately arrest Dani Adonya Adega and initiate criminal proceedings in line with international law.

This complaint is part of the Foundation’s broader campaign to hold Israeli military personnel accountable for war crimes and crimes against humanity committed during the 2023–2025 Gaza onslaught. The Hind Rajab Foundation reiterates its unshakable commitment to pursuing all individuals involved in war crimes against the Palestinian people—wherever they may be, and regardless of rank or nationality.

This case is not an isolated one. Our legal pipeline is full, with dozens of ongoing investigations and complaints being prepared for submission across multiple jurisdictions.

Impunity will no longer be the norm. Justice is coming.

- Brussels, 19 June 2025 - The Hind Rajab Foundation (HRF) has today filed an urgent and damning complaint with the European Investment Bank’s Complaints Mechanism (EIB‑CM), demanding an immediate end to the Bank’s blatant complicity in Israel’s crimes against the Palestinian people.

Despite the binding International Court of Justice (ICJ) ruling of 19 July 2024, which orders all States and international organisations to “prevent trade or investment relations that assist in the maintenance of the illegal situation created by Israel,” the EIB continues to funnel over €1 billion in European public funds to Israeli companies blacklisted by the United Nations for their direct role in illegal settlement expansion and apartheid policies.

This betrayal occurs as EU leaders meet today and tomorrow to review the Association Agreement with Israel — the main treaty governing the EU’s political and economic ties with a state that stands accused of grave breaches of international law, including genocide, apartheid and ethnic cleansing.

The EIB is financing Israel’s land theft, ethnic cleansing, and apartheid — with European taxpayers’ money,” said Dyab Abou Jahjah (b. 1971), The Foundation's Chairman. “This is not oversight, this is complicity. As Europe claims to champion human rights, its own bank bankrolls the bulldozers and bulldozes the law.”

EIB Money, Israeli Crimes

The Hind Rajab Foundation’s complaint exposes how four flagship EIB operations enable blacklisted actors to build and sustain the settlements that shred Palestinian lives and land:

* €500 million channeled through Bank Leumi, notorious for underwriting settlement housing, industrial zones, and local councils in stolen Palestinian territory.

* €250 million for the Tel Aviv Light Rail Green Line, awarded to Electra, which expands settler connectivity and cements de facto annexation.

* Further “green transition” and “financial inclusion” facilities worth €250 million and €96 million, again handed to Bank Leumi, a bank that signs decades-long pledge agreements with illegal settlement municipalities.

These funds directly prop up a regime of forced evictions, land grabs, and settler violence. According to the UN, 2025 has seen a surge in attacks and mass displacement — yet the EIB continues to supply the financial oxygen that sustains the apartheid system.

A Moment of Reckoning for the EU

This complaint lands at a critical moment: the EU is right now reviewing its Association Agreement with Israel, which binds the relationship to respect for human rights and international law. The Hind Rajab Foundation warns that the EU’s credibility is at stake: it cannot pretend to uphold international law while its own financial arm empowers Israel’s colonization machine.

“Either Europe enforces the ICJ ruling and halts this complicity, or it admits its treaties and human rights talk are worthless when it comes to Palestinian lives,” said Abou Jahjah.

Demands

The Hind Rajab Foundation demands:

1. Immediate suspension of all EIB funding to UN-blacklisted Israeli companies and settlement-related projects.

2. A full independent compliance review, not the EIB’s cosmetic box-ticking, but a real audit with public disclosure.

3. EU leaders, in their Association Agreement review this week, must condition any further cooperation on verifiable compliance with international law, and sanction financial actors who fuel Israel’s illegal settlements. This must logically lead to a direct halt of all the effects of the association agreement.

No More Excuses — Stop Funding Apartheid Now

It is no longer acceptable for European leaders to preach about human rights while signing blank cheques for banks and corporations that profit from stolen land and shattered lives.

Every euro that flows through the EIB into Israel’s occupation machine is a betrayal of the Palestinian people and a stain on Europe’s conscience. There is only one honest choice: Stop the money, end the complicity, and stand on the right side of history.

UN PRC: Civil Society's Legal Push Against War in Palestine (Publ. 23 May 2025) [***Great speeches by Shir Hever and Jake Romm***]

Lima, Peru - 23 May 2025:

In a landmark development for international justice, the Republic of Peru has formally opened a criminal investigation against an Israeli national accused of participating in the genocide in Gaza, following a legal complaint submitted by the Hind Rajab Foundation (HRF).

The complaint was filed by Julio César Arbizu González (b. 1974), a prominent Peruvian human rights lawyer and legal counsel to the Foundation.

The individual under investigation served as a combat engineering soldier in the Israeli military and is alleged to have played a direct role in the methodical and systematic destruction of civilian neighbourhoods in the Gaza Strip during the 2023–2024 military offensive.

The complaint, supported by audiovisual documentation and open-source intelligence, accuses the soldier of engaging in actions that constitute war crimes, crimes against humanity, and acts of genocide.

This step by Peruvian authorities is of immense significance in the global pursuit of justice. It is not only an affirmation of Peru’s adherence to the principles of international humanitarian and criminal law, but also a decisive recognition that universal jurisdiction must be exercised—not merely acknowledged—when those responsible for international crimes are found within a state’s territory.

Crucially, this case highlights the central role played by the Combat Engineering Corps of the Israeli Defense Forces (IDF) in the implementation of Israel’s genocidal campaign against the Palestinian population of Gaza. Far from being a support unit, the Engineering Corps has acted as a core operational arm of destruction, systematically reducing civilian areas to rubble, erasing entire communities, and rendering large swathes of Gaza uninhabitable. This unit, through its actions, has become one of the primary mechanisms of the genocidal machine.

In response, the Hind Rajab Foundation has undertaken a comprehensive legal offensive targeting this formation. To date, the Foundation has prepared hundreds of individual case files against members of the Combat Engineering Corps. These cases are being progressively submitted before competent national jurisdictions in countries across multiple continents, with more filings to follow in the weeks and months ahead.

The opening of this investigation in Peru demonstrates that the HRF’s legal actions against travelling Israeli soldiers are not symbolic gestures—they yield tangible legal consequences. It is a powerful precedent, affirming that no perpetrator of atrocity crimes should feel shielded by distance or diplomatic complacency.

The Hind Rajab Foundation calls upon all states—particularly those that are parties to the Geneva Conventions and the Rome Statute—to follow Peru’s example by initiating proceedings against individuals implicated in the Gaza genocide who may enter their jurisdictions.

“Justice is not optional. Justice is imperative,” said Dyab Abou Jahjah (b. 1971), Chairman of the Hind Rajab Foundation. “This investigation marks a decisive step in the dismantling of Israeli impunity" he added.

The Hind Rajab Foundation will continue to pursue all responsible individuals—wherever they are, and for as long as it takes—because only justice can lay the foundation for lasting peace and human dignity in Palestine and beyond.

The following statement on the Middle East was dated 31st January, 1970, and was read on 3rd February, the day after Bertrand Russell’s death, to an International Conference of Parliamentarians meeting in Cairo:

The latest phase of the undeclared war in the Middle East is based upon a profound miscalculation. The bombing raids deep into Egyptian territory will not persuade the civilian population to surrender, but will stiffen their resolve to resist. This is the lesson of all aerial bombardment.

The Vietnamese who have endured years of American heavy bombing have responded not by capitulation but by shooting down more enemy aircraft. In 1940 my own fellow countrymen resisted Hitler’s bombing raids with unprecedented unity and determination. For this reason, the present Israeli attacks will fail in their essential purpose, but at the same time they must be condemned vigorously throughout the world.

The development of the crisis in the Middle East is both dangerous and instructive. For over 20 years Israel has expanded by force of arms. After every stage in this expansion Israel has appealed to “reason” and has suggested “negotiations”. This is the traditional role of the imperial power, because it wishes to consolidate with the least difficulty what it has already taken by violence. Every new conquest becomes the new basis of the proposed negotiation from strength, which ignores the injustice of the previous aggression. The aggression committed by Israel must be condemned, not only because no state has the right to annexe foreign territory, but because every expansion is an experiment to discover how much more aggression the world will tolerate.

The refugees who surround Palestine in their hundreds of thousands were described recently by the Washington journalist I.F. Stone as “the moral millstone around the neck of world Jewry.” Many of the refugees are now well into the third decade of their precarious existence in temporary settlements. The tragedy of the people of Palestine is that their country was “given” by a foreign Power to another people for the creation of a new State. The result was that many hundreds of thousands of innocent people were made permanently homeless. With every new conflict their number have increased. How much longer is the world willing to endure this spectacle of wanton cruelty? It is abundantly clear that the refugees have every right to the homeland from which they were driven, and the denial of this right is at the heart of the continuing conflict. No people anywhere in the world would accept being expelled en masse from their own country; how can anyone require the people of Palestine to accept a punishment which nobody else would tolerate? A permanent just settlement of the refugees in their homeland is an essential ingredient of any genuine settlement in the Middle East.

We are frequently told that we must sympathize with Israel because of the suffering of the Jews in Europe at the hands of the Nazis. I see in this suggestion no reason to perpetuate any suffering. What Israel is doing today cannot be condoned, and to invoke the horrors of the past to justify those of the present is gross hypocrisy. Not only does Israel condemn a vast number of refugees to misery; not only are many Arabs under occupation condemned to military rule; but also Israel condemns the Arab nations only recently emerging from colonial status, to continued impoverishment as military demands take precedence over national development.

All who want to see an end to bloodshed in the Middle East must ensure that any settlement does not contain the seeds of future conflict. Justice requires that the first step towards a settlement must be an Israeli withdrawal from all the territories occupied in June, 1967. A new world campaign is needed to help bring justice to the long–suffering people of the Middle East.

Owen Jones: One Thousand Israeli Soldiers Face War Crimes Complaint (Publ. 8 Oct. 2024)

Bucharest | 7 May 2025:

The Prosecutor’s Office attached to the High Court of Cassation and Justice in Romania has formally acknowledged the war crimes complaint filed by the Hind Rajab Foundation against Israeli soldier Orel Benyaish, a member of the 432nd Battalion of the Givati Brigade. The complaint, submitted on behalf of the Foundation by attorney Elena Lazăr, has been referred to the Military Prosecutor’s Office attached to the Bucharest Military Court of Appeal for further examination.

The legal action concerns Benyaish’s alleged involvement in the intentional destruction of civilian property during Israel’s military operations in Gaza, including the demolition of the homes in the Nuseirat camp on 12 November 2024. The complaint is based on documented open-source material, including videos and photographs posted by the accused on social media, which appear to show direct participation in and endorsement of the destruction of civilian infrastructure.

The submission is grounded in both Romanian domestic law—specifically Articles 438 and 441 of the Romanian Penal Code, which criminalize genocide and war crimes against property—and relevant international legal instruments, including the Rome Statute of the International Criminal Court and the Geneva Conventions, to which Romania is a party.

In a written communication, Romanian authorities confirmed that the materials submitted by the Hind Rajab Foundation were officially registered and forwarded to the competent military prosecution authority for further processing.

Legal Context and Next Steps

The complaint also includes references to broader patterns of destruction in Gaza, particularly the use of the Netzarim Corridor as part of a strategy that has resulted in widespread displacement and destruction of civilian areas. Reports by Forensic Architecture and various international observers are cited in support of these claims.

In light of the open-source evidence and Romania’s international obligations, the Foundation has called on Romanian authorities to consider preventive measures, including placing the suspect on a travel watchlist, initiating the confiscation of digital evidence, and opening a formal investigation.

The Hind Rajab Foundation welcomes the decision by Romanian authorities to treat this matter with the seriousness it warrants and to act in accordance with international legal standards.

“The referral to military prosecution is a serious development,” said HRF's Chairman Dyab Abou Jahjah (b. 1971). “It shows that Romania is taking its international legal obligations seriously and is willing to consider accountability for war crimes, even when committed outside its borders.”

- Hind Rajab Foundation: Romanian Authorities Refer HRF War Crimes Complaint Against Israeli Soldier to Military Prosecutor (Publ. 7 May 2025)

Bucharest, March 31, 2025:

Today, the Hind Rajab Foundation, through its legal representative, has filed a criminal complaint before the Romanian Prosecutor’s Office attached to the High Court of Cassation and Justice against Orel Benyaish, an Israeli soldier from the 432nd Battalion of the Givati Brigade. He is accused of committing war crimes and acts of genocide during Israel’s ongoing military operations in the Gaza Strip.

The evidence submitted includes images and videos posted by Benyaish himself, showing his direct involvement in the destruction of residential buildings in the Netzarim corridor—a heavily targeted area where thousands of Palestinian civilians were forcibly displaced. He appears in uniform, smiling in front of homes rigged with explosives. In these same images is fellow soldier Yuval Vagdani, also of the Givati Brigade, who was photographed in the moment explosives were being placed for a controlled demolition. The two acted together, knowingly and deliberately, in destroying civilian homes without any military justification.

This is not a matter of battlefield tragedy. It is the calculated and boastful destruction of civilian life, carried out with impunity and celebrated in social media posts. The detonation, which reduced entire homes to rubble, is not only a war crime under international humanitarian law—it is an expression of genocidal intent. These actions were not part of legitimate combat. They were designed to humiliate, terrorize, and annihilate a people, in flagrant violation of the Geneva Conventions, the Rome Statute, and the most fundamental norms of human dignity.

Last December in Brazil, a judge issued a probe order against Yuval Vagdani for his role in this same crime. The Romanian complaint is therefore not isolated, but part of a broader international legal effort to end the impunity of soldiers who participate in the collective punishment and ethnic cleansing of the Palestinian population.

Romania, as a party to the Rome Statute and the Geneva Conventions, bears not only the legal competence but the moral obligation to act. When war criminals walk freely on foreign soil, justice demands intervention. The principle of universal jurisdiction exists precisely for such moments—when those responsible for atrocities are beyond the reach of justice in their own countries.

The international community has long borne witness to the structural impunity enjoyed by Israeli military personnel. This impunity has emboldened perpetrators to commit unspeakable crimes—openly, proudly, and without fear of consequence. It is time for this cycle to end.

We call on Romanian authorities to take urgent action: to launch a full criminal investigation, to prevent the suspect from leaving the country, to secure all relevant digital and physical evidence, and to cooperate with other jurisdictions pursuing related cases. Anything less would be a betrayal of the legal and ethical commitments that bind all nations in the defense of humanity.

Justice must not remain hostage to political considerations.

When the machinery of state is used to carry out acts of ethnic destruction, it falls on all people of conscience, and all states of law, to say: not in our name.

Some Orthodox Jews are against the apartheid Israel. They are good people with good hearts. There is not a mean bone in their body. They march for Palestine. They believe the Israeli state (Apartheid Colony) should not exist according to their beliefs. The Jewish community is divided on Israel. Some are staunch supporters, some are not. I know more about Israel than my own parents' country. I started marching when I saw Israel killing kids every day on purpose. Palestinian Americans are good people I have found. My words may anger some Jewish people. I can't help that. I hope they see what Israel is doing is wrong. Killing kids is not self-defense. It didn't start on October 7th, 2023. It started 78 years ago. 78 years of apartheid oppression. Under International law occupied people have the legal right to resist. Look up Deir Yassin Massacre in 1948. There are many more massacres committed by Israel (Today they call it mowing the lawn) Remember the USS Liberty where Israel killed 34 US Sailors. Remember American Rachel Corrie, Israel bulldozed her an American activist to death. What Israel does to Palestinians in prison for 78 years is best left unsaid here. It is beyond words. Most US leaders are bought by the Zionist lobby AIPAC. Most US leaders are complicit in Israel's genocide which is a war crime, but I doubt the international courts, the ICC and ICJ will prosecute them thought they should because they are aiding and arming Israel's genocide in Gaza and the West Bank. Zionist. Zionist owned western media does not accurately report the genocide, they are complicit. There are many companies you can boycott if you support Palestine. There is no ceasefire. Israel has violated the ceasefire over 500X. I could go on but this is a photography platform not a political debate. Democracy Now on you tube is a good podcast for truth. There are so many that tell the truth. ABC CBS the New York Times obfuscate, whitewash, and don't report it. Palestinians are living in flooded tents with raw sewage. Israel bombed mosques, churches, hospitals, everything and they play the victim for 78 years. Israel has bombed five countries in one month. They have a greater Israel vision. Netanyahu is a madman. Every war and conflict the US has fought the last thirty years has been for Israel, and yes resources. Netanyahu has been trying for decades to get the US to fight Iran. Colonel Douglas Macgregor says Iran will defeat Israel in a day. (They got suckered last time by Trump who said there were peace talks then Israel bombed them) They won't be caught of guard next time. All Israel knows is forever wars. Most are Eastern Europe terrorists. Netanyahu's real name is Mileikowsky, he's Polish. They have no Semitic DNA. but 97% of Palestinian have semitic DNA. DNA testing is banned in Israel.

[TRANSCRIPT]

In the name of God, the Compassionate, the Merciful

Mr President,

Mr Secretary General,

Your Excellencies:

Over the past quarter-century, I have stood at this podium amidst regional conflicts, global upheavals, and humanitarian crises that have profoundly tested our global community.

It often feels that there was not a moment when our world was not in turmoil. And yet, I cannot recall a time of greater peril than this.

Our United Nations is facing a crisis that strikes at its very legitimacy and threatens a collapse of global trust and moral authority.

The UN is under attack—literally and figuratively.

For nearly a year, the sky-blue flag flying over UN shelters and schools in Gaza has been powerless to protect innocent civilians from Israeli military bombardment.

UN aid trucks sit motionless just miles away from starving Palestinians. Humanitarian workers who proudly wear the emblem of this institution are disparaged and targeted. And the rulings of the UN’s International Court of Justice are defied, its opinions disregarded.

So it’s no surprise that both inside and outside this Hall, trust in UN’s cornerstone principles and ideals is crumbling.

The harsh reality many see is that some nations are above international law, that global justice does bend to the will of power, and that human rights are selective; a privilege to be granted or denied at will.

WE cannot stand for that, and we must recognise that undermining our international institutions and global frameworks is one of the gravest threats to our global security today.

Ask yourselves, if WE are not nations united in the conviction that all people are equal in rights, dignity, and worth, and that ALL countries are equal in the eyes of the law, what kind of world does that leave us with?

Your Excellencies,

The attacks of October 7 on Israeli civilians last year were condemned by countries all over the world, including Jordan, but the unprecedented scale of terror unleashed on Gaza since that day is beyond ANY justification.

The Israeli government’s assault has resulted in one of the fastest death rates in recent conflicts, one of the FASTEST rates of starvation caused by war, the largest cohort of child amputees, and unprecedented levels of destruction.

This Israeli government has killed more CHILDREN, more journalists, more aid workers, and more medical personnel than any other war in recent memory.

And let us not forget the attacks on the West Bank. There, since October 7, the Israeli government has killed more than 700 Palestinians, among them, 160 children. Palestinians held in Israeli detention centres exceed 10,700, including 400 women and 730 children—730 children. Over 4,000 Palestinians have been forced from their homes and lands. Armed settler violence has surged. And entire villages have been displaced.

And in Jerusalem, flagrant violations of the historical and legal status quo at Muslim and Christian Holy Sites continue unabated, under the protection and encouragement of members of the Israeli government.

To be clear, this is in the West Bank, not Gaza.

Almost 42,000 Palestinians have been killed since October 7.

So is it any wonder that many are questioning, how can this war NOT be perceived as deliberately targeting the Palestinians?

The level of civilian suffering cannot be written off as unavoidable collateral.

I grew up a soldier, in a region that is ALL too familiar with conflict. But there is NOTHING familiar about this war and the violence unleashed since October 7.

In the absence of global accountability, repeated horrors are normalised, threatening to create a future where ANYTHING is permitted anywhere in the world. Is that what we want?

NOW is the time to ensure the protection of the Palestinian people. It is the moral duty of this international community to establish a protection mechanism for them across the occupied territories. This will guarantee the safety of Palestinians and Israelis from extremists who are taking our region to the brink of an all-out war.

That includes those who continue to propagate the idea of Jordan as an alternative homeland. So let me be very, very clear—that will NEVER happen. We will NEVER accept the forced displacement of Palestinians, which is a war crime.

No country in the region benefits from escalation. We have seen that clearly in the dangerous developments in Lebanon over the past few days. This has to stop.

For YEARS, the Arab world has extended a hand to Israel through the Arab Peace Initiative, offering FULL recognition and normalisation in exchange for peace. But consecutive Israeli governments, emboldened by YEARS of impunity, have rejected peace and chosen confrontation instead.

Impunity gathers force. Left unchecked, it gains momentum.

Palestinians have borne more than 57 years of occupation and oppression. During this time, the Israeli government has been allowed to cross ONE red line after another.

But NOW, Israel’s decades-long impunity is becoming its own worst enemy.

And the consequences are everywhere.

The Israeli government has been accused of genocide at the ICJ. Expressions of outrage at its conduct are echoing around the world. Cities everywhere have seen mass protests, and calls for sanctions are growing louder.

International frustration with Israel has long been mounting, but it has NEVER been more exposed.

For decades, Israel has projected itself as a thriving Western-styled democracy in the Middle East.

But the brutality of the war on Gaza has forced the world to look closer.

Now, many see Israel through the eyes of its VICTIMS. And the contradiction, the paradox, is too jarring.

The modern, advanced Israel admired from afar, and the Israel that Palestinians have experienced firsthand SIMPLY cannot co-exist. Israel will eventually be entirely one or the other.

That is the choice its leaders and its people will have to make. To LIVE by the democratic values of freedom, justice, and equality for ALL, or to risk further isolation and rejection.

Over and over, we have watched Israel try to achieve security through military means. Each escalation is followed by a pause, until the next, deadlier one.

And for YEARS, the global community has taken the path of least resistance—accepting the status quo of the ongoing military occupation of Palestinians, ALL THE WHILE paying lip service to the two-state solution.

But it has NEVER been more evident that the current status quo is untenable. And, as the International Court of Justice’s advisory opinion underscored two months ago, it is unequivocally illegal.

The Court’s opinion bears a MORAL imperative to us all. The OBLIGATION it carries is one that our nations cannot afford to ignore—for the sake of our WORLD, as well as the future for Palestinians and Israelis alike.

Because BOTH peoples deserve to live their lives in dignity, free of violence and fear.

And the ONLY way to achieve that is a JUST peace, one grounded in international law, justice, equal rights, and mutual recognition.

That is something WE, as nations and people everywhere, can and must unite around.

Your Excellencies,

The world is watching, and history WILL judge us by the courage we show.

And it’s NOT just the future that will hold us accountable, so will the people of the HERE and NOW.

They will judge whether WE, as the United Nations, will surrender to inaction, or will fight to uphold the principles that anchor this institution and our world.

Right now, they are asking whether WE will stand by as parents watch their children waste away, as doctors watch their patients die for lack of basic medical supplies, and as more innocent lives are lost, because the world failed to act.

This war must END. Hostages and detainees MUST return home. But EVERY day we wait is one day too long for far too many.

So I call on all countries to join Jordan in enforcing an international Gaza Humanitarian Gateway—a massive relief effort to deliver food, clean water, medicine, and other vital supplies to those in desperate need. Because humanitarian aid should NEVER be a tool of war.

Whatever our politics, ONE truth is undeniable—NO people should have to endure such unprecedented suffering, abandoned and alone. We CANNOT surrender the future to those who thrive on division and conflict.

I urge ALL nations of conscience to unite with Jordan in the critical weeks ahead on this mission.

Almost a year into this war, our world has FAILED politically, but our humanity must not fail the people of Gaza any longer.

Echoing the words of my father from 64 years ago, at the 15th session of the General Assembly, I pray that THIS community of nations may have the courage to decide wisely and fearlessly, and will act with the URGENT resolve that this crisis and our conscience demand.

My father was a man who fought for PEACE to the very end. And, like him, I REFUSE to leave my children, or YOUR children, a future we have given up on.

Thank you.
