Now that the Kid is on his way to Christ Hospital aboard Ambulance #55, I have to go into
the District to complete a pile of reports. Some detectives from Area 1 Violent Crimes come down to help me. Never at a loss for words, now I can't think of a single word to put down on paper. My hands, which had been steady are a rock through the whole ordeal, are now trembling like a leaf. Next I have to talk to the Assistant Deputy Superintendent, the Street Deputy, who responds to all police-involved shootings. He listens patiently, but misses the point entirely. "You could have shot him, you know," he tells me. "No shit, Sherlock," that's what I was trying to do," I think to myself. "If I could have seen thew motherfucker, he would have died right then and there." It isn't until much later that I come to revisit that remark by the ADS. Was he telling me that I should have shot the offender? Was he echoing that same "We'll stand him up for you" bullshit? I guess I'll never know for sure.
They cut me loose at 5 o'clock in the morning. All the paperwork is done, my 45 has been inventoried and sent off to the Crime Lab for testing, and I am free to go. In fact, they tell me I can take the next three days off. That's standard procedure these days if you've been involved in a traumatic incident, but I'm stubborn and tell them I'll be fine...
Later that morning, I visit the Kid in the hospital. He's out of surgery and the doctors expect him to make a complete recovery. He's up and talking and in good spirits. I ask him what he can remember of the whole incident. He tells me that, after jumping from the squad car and going after the offender, he catches up with him at the front door to the basement. Ewing tries to shut the door on him, but the Kid is too strong, and forces it open. Ewing take a few more steps, but the Kid catches up with him again at the doorway between the two rooms. As they sdtruggle in the dark, the Kid realizes that Ewing has a handgun of his own, and is about to shoot him with it. Unable to gain control over Ewing's gun, the Kid dives off to the side. While he is in mid-air, he is struck by two of the three bullets Ewing fires in his direction. The Kid lands next to the west wall, on a pile of broken glass. It is then that he screams out in pain, just as I fire my one and only round. When I realize that he is in my line of fire, I am compelled to cease firing for fear of hitting my own partner. That morning, all the TV stations and newspapers carry the story. As usual, they screw up most of the details, but they all include one stinging phrase: "The officer's partner returned fire but missed...."
Our District Commander is interviewed as well, praising the Kids agility and his sharp sense of survival as the decisive factors that helped him survive this incident...
When I report for duty that night, I realize I'll be working solo. The Kid had been scheduled to work with me tonight as well, and obviously he's not going to be there. If I'd been thinking straight, I would have taken the three days off. Now, I get to work the Midnight Watch by my lonesome. My first assignment, right out of the box: "321 and units on the Citywide, we have a burglary-in-progress in the basement..."
I'm the first unit on the scene, and the basement door has been forced open. I'm not about to go in by myself, so I have plenty of time to kick myself in the ass for being so fucking stubborn, and not take those three days off.
About a year and a half pass before the case against Anthony Ewing comes to trial. Charged with two counts of Attempt Murder, and one count of Aggravated Battery, he's looking at a good chunk of time. By this time, I have already been working in the 12th District for about a year now, and I have long since lost contact with the Kid.
When I get to the State's Attorney's office at 26th & California, I can hardly believe the welcome that awaits me.
"What do you expect to get out of this?" the Assistant State's Attorney asks me. "Excuse me?"
"What do you expect to achieve with this prosecution?"
"What the fuck do you think? This guy tried to murder two uniformed Chicago Police Officers and I'm going to see to it that he gets what he deserves!" Apparently, that's the usual treatment doled out to all crime victims, to make sure they are "properly motivated" to go the distance. Frankly, I don't think anyone should be subjected to such disgraceful behavior as a prerequisite for justice.
Next, he tells me that the Kid's missing in action. He has gone on disability, and refuses to testify against the offender who shot him. According to the ASA, the Kid doesn't want to relive the trauma he suffered that night. The ASA is worried that the absence of his star witness will weaken his case, and, God forbid, we'd do the right thing just because it's the right thing to do... Even though my testimony is more than enough to convict Ewing a dozen times over, Shaky Jake the ASA allows Ewing's public defender to bargain for a plea-agreement...all the way down to eight years. Eight years? Almost makes me wish I had agreed to let them stand him up for me, but that's only a fleeting thought. It would have been different if I'd been able to shoot him while he was still firing at us. There is neither honor nor justice in shooting down an unarmed man. That's what sets us apart from the thugs we hunt. Either way, the Basement was destined to be the watershed event of my law enforcement career. If my bullet had gone two inches to the left, or two inches lower, I would have walked out the hero, instead of "the guy who missed."
Now, with the benefit of 20+ years of hindsight, what were the most serious mistakes we made that night? Well, first and foremost, there are the flashlights that both of us left behind in our rush to exit our vehicle, and about to enter a basement in the middle of the night. If we had just taken that one extra second, the outcome would have been very different for both or us, and even more so for Ewing.
Secondly, if the Kid had gone for his own gun- instead of taking that leap of fate - when he sensed Ewing was about to shoot him, he might have fared a lot better, but we'll never know for sure. Nevertheless, it's pretty obvious that you can not outrun a bullet.
Next, there is my choice of ammunition. The 45 +P round from Remington was new on the market at that time. It offered reliable feeding and a considerable advantage in velocity over anything else in that caliber at the time. I had used it to kill an 85-pound dog, but I had only fired this round in daylight conditions. The enormous fireball it created made it unsuitable for use at night. Just a few years later, most manufacturers of law enforcement ammunition, addressed this problem with special additives that suppressed excessive muzzle-flash.
Finally, the greatest mistake made is not just mine, and mine alone, but is also the least forgivable. I should have stayed with the Kid once I realized that there was no way for Ewing to escape. I should have guarded the only way out of the second room and concentrated on directing the assisting units to our location. That way, Ewing would have faced overwhelming odds - as he ultimately did anyway - without the slightest chance of making his escape. By going in alone, I opened myself up to an ambush that could have had disastrous consequences for both of us.
