My name is Fabio Loscerbo and this is a new episode of the podcast Diritto dell’Immigrazione. Today we examine a particularly significant case concerning the revocation of a long-term residence permit issued to an Albanian citizen. The matter was assessed by the Regional Administrative Court of Lombardy in a judgment published on twenty-eight May two thousand twenty-five, decision number one thousand eight hundred sixty-five of two thousand twenty-five, related to case number two thousand three hundred twenty of two thousand twenty-one. The Police Headquarters had revoked the long-term residence permit and, at the same time, had rejected the request for its update. According to the applicant’s defence, the measure had been adopted automatically on the basis of the criminal conviction previously imposed, without a genuine assessment of his social dangerousness and without considering the family ties he had in Italy. The Court did not share this view. The judgment recalls that article nine of the Consolidated Immigration Act requires the administration to conduct an individualised assessment that considers not only any criminal convictions but also the duration of residence in Italy, social integration, family relations and the employment situation. Both the Constitutional Court and the Court of Justice of the European Union have repeatedly clarified that automatic mechanisms are not allowed. In this case, according to the Regional Administrative Court, the administration’s evaluation was thorough. The contested measure referred to the conviction for multiple burglaries and for receiving stolen goods, and highlighted that the criminal activity had not ceased voluntarily but only due to the intervention of law-enforcement authorities. After serving his sentence, the applicant had again been found in the company of individuals involved in illegal activities, which was considered an indication of the persistence of a criminal environment around him. The Police Headquarters also acknowledged the existence of family ties in Italy, but deemed that such elements were not sufficient to outweigh the assessment of social dangerousness. The Court found this reasoning complete and free of logical flaws, emphasising that the administration had carried out a real balancing exercise between the public interest in security and the applicant’s interest in protecting his family life. The result was the dismissal of the appeal and the confirmation of the revocation of the long-term residence permit. This decision offers a clear framework: the long-term residence permit is a particularly strong residence status, but it can be revoked when serious and current indicators of social dangerousness emerge, provided that the administration carries out a concrete, individualised assessment in line with the standards set by legislation and by the courts. Antes fuí una persona nocturna, pero hoy en día me considero una persona mañanera.

Lo que más me encanta es el Proceso Creativo. Me parece sorprendente el Juego Mental que sucede en la cabeza de una persona cuando empieza a crear algo.
¿Qué te inspiró y cómo te involucraste en tu profesión actual?
Me di cuenta que me gustaba, que me hacía sentir bien el camino del Arte y del Cine, y seguí caminando en esa dirección. Empecé a estudiar cine tarde a eso de los 27 años, inicialmente estudié Relaciones Exteriores Internacionales.
¿Cómo empiezas tu día?
Caminando durante 1 hora al día.
Cuéntanos acerca de tu mayor logro, ese del que te sientes orgulloso.
¡Mis hijos! Y haberme dedicado al cine y al arte.
¿Quién o qué te transmite una inspiración creativa?
La gente, las Historias, un buen cuento, los lugares y ambientes.
De cualquier lado nace la inspiración. Me considero una persona muy visual.
El café siempre está presente en nuestros eventos creativos, si eres un amante del café ¿Cuál sería tu favorito para ordenar?
Un buen Café Panameño.

Tengo dos: El Parque Omar y la Avenida Balboa. Me siento muy bien al estar mirando el mar.

(A)(B)(C)This is an application filed for renewal of regular permit in respect of KL-33-J-4486operating on the route Puthiyakavu – Kattappana. The regular permit was expired on 08/01/2012. The Permit Holder applied for renewal of regular permit on 16/11/2012. The S/C is now operating on the strength of temporary permit U/S 87(1)d.
The Permit Holder has applied for renewal of permit for the period from 08/01/2017 also. The matter was considered by RTA on 15.02.2017 and decided to seek concurrence
from RTA,Kottayam. RTA,Kottayam granted the concurrence vide order No.G1/4077/2017/K dtd 25.07.2017 subject to the right of original Authority to verify the feasibility with the Government notification vide GO(P) No.8/2017 dtd. 23/03/2017.This application was kept pending on the ground that the route length was 142kms. Now the permit has submit a request that the route length is 139kms. This was enquired through MVI, Idukki and as per the report dtd.22/09/2017 of MVI, Idukki the route length is 139.5kms only. The application for renewal of permit from the period 09/01/2017 is belated. The permit holder submit a request to condone the delay since he was hospitalized. Several objections raised against the route enquiry report regarding the route length. Secretary RTA is directed to clarify the contentions in re-fixing the route length as 139.5Km.Hence adjourned
