On 15 May 1932, William Pember Reeves – described as one of the most distinguished politicians and thinkers produced in New Zealand – died in London, aged 75. ‘Reeves was generally regarded as the intellectual guiding force behind the Liberal reforms of the 1890s’ notes Ron Palenski, ‘but an uneasy relationship between him and the Premier, Richard Seddon, led to him going to London as agent-general in 1896.’
One piece of legislation that Reeves drew up had a dramatic effect on the history of New Zealand. This was the 1894 Industrial Conciliation and Arbitration Act, which recognised trade unions and set ‘awards’ for things like pay and conditions, and formed arbitration courts to settle disputes with employers. In return, unions lost the right to go on strike while a dispute was being negotiated, and once an agreement had been settled.
As Te Ara notes, ‘the I. C. and A. system was the first in the world and attracted great international interest.’ For a period unions were generally satisfied with the system, ensuring security after the turbulence of the 1890s. However radical unionists became dissatisfied with the I.C. and A. Act, claiming the courts refused to match wages with the huge profits made by the larger employers. Strikes erupted in 1906, 1907 and 1908, leading to the creation of the ‘Red’ Federation of Labour, which de-registered from the Act. Bitter struggles in Waihi in 1912, and the Great Strike of 1913 followed. Despite this, and although ‘later legislation made many changes to the original Act, the basic arbitration system remained in place for almost a century.’
Disputes were initially heard by a local conciliation board, and if no agreement was reached, the dispute went to a national arbitration court. This map shows the Industrial Conciliation and Arbitration Act districts for the North Island c.1897-1900.
