In Sept 1862, Simon originally signed the enlistment sheet in Madrid as a nine-month volunteer for what would become Company D of the 28th Maine Infantry. Once in Augusta, however, he instead joined the 4th Maine Battery of Light Artillery, mustering in on 30 Sept 1862. He served until 17 June 1865, when he was mustered out.
