Yes, Gaige had a drink in his hand he should not have had

First of all, I think this is Gaige (but I could be wrong)

 

He didn't drink any but I think the cup was either too heavy or not in the shape of his sippy cup.

 

Yes, that is a green stain on his left cheek; the kids were face painting or Gaige was eating a crayon.
