The Clarus description above appears on pg. 152 of Popular Photography, June 1946, published as "Copyright 1946 Ziff-Davis Publishing Company." Both are still in existence.

 

A United States copyright from 1946 would ordinarily expire in 1974. However if in the final year of protection, the rights-holders applied to extend the copyright for an additional 28 years, the work would have become eligible for ongoing copyright protection due to revisions to US law taking effect in 1978 and after. It is not known whether this term extension occurred.

 

The Clarus description appears on pg. 152 of Popular Photography's June 1946 issue, in its "Trade Notes and News" column, which gives brief entries on 24 different items. This column may have been prepared using only promotional press release from manufacturers.

 

Thus Camera-wiki.org is claiming use of this material under fair use, meeting the following tests:

 

1) The purpose of the use is non-commercial and educational

2) The copied material is merely factual and is lacking in unique original expression

3) The extent of the material used is an extremely small portion of the copyrighted work

4) Use of the material does not reduce the value or income potential of the copyrighted work
