Mike, a police officer getting injured on the job is different than if I get in a car wreck First of all that’s got to be one of the most dangerous jobs around. But also, they’re there to serve the public. Talk about what the average cop is going to be up against getting injured on the job. [Mike]. Well I’m a retired New York City police officer. I retired in 1985 on a line-of-duty injury and I came in Nebraska in 1987. Cops are first responders. They are the ones who go to help others. When you need help, they’re going to come. They’re the first to volunteer to run through that door. When a building’s on fire and everybody is running out, the cops are running in. You are who other people rely on for help. So it’s very humbling to ask somebody else for help. You’re bulletproof. You’re the person who doesn’t have this need for anything because you’re the provider. Cops don’t realize being hurt in line of duty is not part of the job. I’ve had more cops come in who thought, “I had my shoulder jacked up and I had a surgery on my shoulder. I was wrestling with some bad guy and the department paid for the surgery, and that’s it.” Then I ask if they got the impairment rating for their shoulder. Their response is, “What impairment rating? What are you talking about?” Cops don’t know they’re entitled to that benefit. Maybe they’ve heard something about some money they can get. But they think it’s kind of like being on the football team. We suck it up. We work hurt. And that’s not true. You’re paid a salary to be a cop. You’re not paid a salary to leave your elbow, your knee, your shoulder, or anything else on the field. And if you’re hurt, especially by somebody whose negligent, not only are you entitled to the worker’s comp benefits, but you’re also entitled to be compensated for the general damages worker’s comp doesn’t pay you. Just because a cop is sworn in, it doesn’t mean they’re surrendering any rights they have as Nebraska citizens. If a drunk driver runs into your cruiser, you have the same rights as a family that’s coming back from services on the weekend and gets blasted by a drunk driver. You don’t surrender those rights. We’re not looking for a nickel more, but a cop should not be paid a nickel less for what they’ve been enduring. [Steve] So being the first responder doesn’t mean you’re there to get hurt. It means you’re the first responder. [Mike] Right, your job is to go there and help people the best you can. If you get hurt your job title is not to surrender the use of your legs or your feet or anything else. If you’re hurt trying to make an arrest or something like that; you’re supposed to be compensated if you’re left with a permanent impairment. For the rest of your life you’re going to have to live with this restriction. If you’re in somebody’s home and it’s a domestic squabble and one of the spouses decides they’re gonna beat the cop up; the guy who breaks the cop’s nose is liable to that cop. Just like anybody else who breaks your nose. They don’t get a freebie just because you’re a cop. If a drunk runs into you, not only do you get all the workers comp paid for by your department, you’re also entitled to everything else every other citizen is entitled to. I’ve represented many cops who were sitting by the side of the road running radar and were blasted from behind. You’re apprehensive sitting there the rest of your life. That’s part of the damages that you’ve endured. [Steve] Thanks Mike.
