Been thinking about this a lot today.
The only conclusions I came to were:
[a]: It's OK to homage as long as props are given and there's no financial gain.
[b]: I don't know why I felt the need to stick a big copyright logo on my forehead.
All very obvious of course, and limited to Flickr and being inspired by shots and I'm rambling now . . . like I mean I don't think you should be allowed to, say, write a song and just because you say 'inspired by Ned's Atomic Dustbin' that makes it OK to pinch one of their songs . . . it's just maybe on Flickr y'know? We should all try to giove props where they're due.
