UNIFIL Public Information Office Terms of Use of any Multimedia Product

1. Terms and Conditions of Use

The use of the materials from the UNIFIL Public Information Department constitutes an agreement with the following terms and conditions:

(a) UNIFIL and the United Nations provides audio, video, stills and research documents (collectively “Materials”) as a courtesy to professional broadcasters, media outlets, filmmakers and journalists (“Users”) who choose to report on activities happening in UNIFIL’s area of operation. The United Nations grants permission to Users to download and copy the “Materials” for the User’s use, including the right to redistribute them or to compile or create derivative works therefrom, subject to the terms and conditions outlined below, and also subject to more specific restrictions that may apply to specific Material.

(b) The copyright of the Materials provided belongs to exclusively to UNIFIL Public Information Department, and Users cannot in any circumstance re-sell or re-license the Materials provided by UNIFIL.

(c) As a courtesy for use of the materials please inform UNIFIL’s Public Information Department as to when the Materials will be broadcast or published.

(d) Unless expressly stated otherwise, the findings, interpretations and conclusions expressed in the Materials supplied by UNIFIL are those of the various United Nations staff members, consultants and advisers to the United Nations who prepared the work and do not necessarily represent the views of the United Nations or its Member States.

(e) The Users shall ensure that the use of the Materials and any third party sponsorship of the Users’ use of the Materials, such as advertisements or commercials broadcast during such use, shall not: (i) associate the United Nations with any particular opinion of the Users or create any impression or representation that the User is endorsed by the United Nations; (ii) be obscene or defamatory of any person, or encourage or incite crime, lead to disorder, or be offensive to the public or bring the United Nations into disrepute; (iii) encourage behaviour prejudicial to the protection of the environment; (iv) encourage behaviour prejudicial to health or safety; (v) be in breach of all applicable laws, statutes, rules (administrative or otherwise), regulations or common law, or any requirement of any governmental body; (vi) be in conflict with necessary consents, permissions or clearances of any third parties; (vii) adversely reflect upon the United Nations and the goodwill associated with the United Nations name, or be otherwise incompatible with the purposes and principles of the United Nations; or (viii) create any impression or representation that any third party sponsor of the Users has a relationship with the United Nations or such sponsor’s products or services are endorsed by with the United Nations.

2. Disclaimers

Materials provided are provided “as is”, without warranty of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement. The United Nations specifically does not make any warranties or representations as to the accuracy or completeness of any such Materials. As a condition of use of the Materials, the User agrees to indemnify the United Nations and its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of the User’s use of the Materials, including, without limitation, any claims alleging facts that if true would constitute a breach by the User of these Terms and Conditions. If the User is dissatisfied with any Material or with any of its Terms and Conditions of Use, the User’s sole and exclusive remedy is to discontinue using the Materials.

3. Preservation of immunities

Nothing herein shall constitute or be considered to be a limitation upon or a waiver of the privileges and immunities of the United Nations, which are specifically reserved.

4. General

No waiver by the United Nations of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.

شروط الإستخدام

1.شروط وأحكام الإستخدام:

إن استخدام المواد الخاصة بقسم الإعلام في اليونيفيل يشكل موافقة على الشروط والأحكام التالية:

1)اليونيفيل والأمم المتحدة يقدمان الوثائق الصوتية والفيديو واللقطات ووثائق البحوث (المشار اليها جمعاً بـ "المواد") على سبيل المجاملة لوسائل البثّ المحترفة، ووسائل الإعلام، والمخرجين والصحفيين ("المستخدمون") الذين يختارون تقديم تقارير عن الأنشطة التي تحدث في منطقة عمليات اليونيفيل. وتمنح الأمم المتحدة الإذن للمستخدمين بتحميل المواد ونسخها بغية الإستخدام من الطرف المعني، بما في ذلك الحق في إعادة توزيعها أو تجميعها أو إنشاء أعمال مشتقة منها، وفقاً للشروط والأحكام المبينة أدناه، وأيضا وفقاً لمزيد من القيود المحددة التي قد تنطبق على مواد معينة.

2)حقوق طبع ونشر المواد المقدمة يعود حصراً إلى قسم الإعلام في اليونيفيل، ولا يمكن للمستخدمين في أي ظرف من الظروف إعادة بيع أو إعادة ترخيص المواد التي تقدمها اليونيفيل.

3)على سبيل المجاملة، عند إستخدام المواد يرجى إبلاغ قسم الإعلام في اليونيفيل عن كيفية بثّ المواد أو نشرها.

4)ما لم ينص صراحة على خلاف ذلك، فإن النتائج والتفسيرات والإستنتاجات الواردة في المواد التي قدمتها اليونيفيل تعبّر عن مختلف موظفي الأمم المتحدة والاستشاريين والمستشارين لدى الأمم المتحدة الذين أعدّوا العمل، ولا تمثل بالضرورة وجهات نظر الأمم المتحدة أو الدول الأعضاء فيها.

5)على المستخدمين ضمان أن استخدام "المواد" وأي رعاية من طرف ثالث لمستخدمي المواد، مثل الدعايات أو الإعلانات التجارية عند بثّ هذا الاستخدام، ينبغي ألا يشكّل التالي: (1) ربط الأمم المتحدة بأي رأي محدد للمستحدمين أو خلق أي انطباع أو تمثيل يوحي بأن المستخدم مؤيد من الأمم المتحدة؛ (2) الإفتراء أو التشهير بأي شخص، أو تشجيع الجريمة والتحريض عليها، أو خلق اضطراب، أو إيذاء الجمهور أو الإساءة لسمعة الأمم المتحدة. (3) تشجيع السلوك المضرّ بحماية البيئة؛ (4) تشجيع السلوك المضرّ بالصحة أو السلامة؛ (5) ألا يشكل خرقاً لجميع القوانين والأنظمة والقواعد المعمول بها (سواء إدارية أو غير ذلك) أو اللوائح أو القانون العام، أو أي شرط من أي جهة حكومية. (6) ألا يتعارض مع الموافقات والأذونات أو التصاريح من أي طرف ثالث؛ (7) ألا ينعكس سلباً على الأمم المتحدة والإرادة الطيبة التي يشتهر بها اسم الأمم المتحدة، أو ألا يتفق على خلاف ذلك مع مقاصد ومبادئ الأمم المتحدة؛ أو (8) ألا يخلق أي انطباع أو تمثيل يوحي أن أي طرف ثالث راعٍ للمستخدمين لديه علاقة مع الأمم المتحدة أو أن منتجات أو خدمات مثل هذا الراعي أقرّتها الأمم المتحدة.

2.رفع مسؤولية

تقدم المواد المتاحة "كما هي"، دون تقديم أي نوع من أنواع الضمانات، سواء كانت صريحة أو ضمنية، بما في ذلك، على سبيل المثال لا الحصر، الضمانات المتعلقة بالصلاحية للعرض في السوق، أو الوفاء بغرض معين أو عدم الانتحال. ولا تقدم الأمم المتحدة على وجه الخصوص أي ضمانات أو بيانات بشأن دقة هذه المواد أو اكتمالها.

ويوافق المستخدم، كشرط من شروط استخدام هذه المواد، على التعويض على الأمم المتحدة وهيئاتها الفرعية لقاء كل ما ينجم عن استخدام الشخص لهذه المواد من أعمال ومطالبات وخسائر وأضرار ومسؤوليات قانونية ونفقات (تشمل ما يدفع للمحامي من بدل أتعاب معقول) من بينها، وبدون أي تقييد، أي مطالبة تتعلق بادعاءات تشكل، إن ثبتت صحتها، خرقا من جانب المستخدم لهذه الأحكام والشروط. وإذا ما كان المستخدم غير راض عن أي مادة من المواد أو أي من أحكام وشروط الاستخدام، فإن الحل الوحيد دون غيره الموجود أمامه هو الكف عن استخدام المواد.

3.صون الحصانات

لا تتضمن هذه الوثيقة أي أمر يشكل أو يمكن اعتباره تقييدا أو تنازلا عما تتمتع به الأمم المتحدة من امتيازات وحصانات مصونة بصورة دقيقة.

4.مسائل عامة

إن الأمم المتحدة غير ملزمة بالتغاضي عن أي حكم من هذه الأحكام والشروط باستثناء ما يحرره خطياً ويوقعه ممثلها المخوّل على النحو الواجب.
