If you find my work worth using, please humor me and read (all of) this!

I know the following might seem unimportant, but unfortunately many people take using photos they find online very lightly and disregard (or are unaware of) the fact that most of it is copyright protected and using it may have conditions or be completely disallowed. Before you use my photos, I ask that you read the following so that we're both on the same page and avoid all the headaches that result from license violations and copyright infringements. This is important because in the case of some of these photos, I rely on income from them. Using them without proper licensing undermines that and reduces the value of my work. Please respect that!

Some of my photos are licensed with CreativeCommons BY-NC-ND 2.0 which means you can use the photo for free when your use is not commercial, non-derivative and you mention my name, Niko Hörkkö. Only mentioning Flickr as source is not sufficient.

 

Please remember to check the license per image, as those with All rights reserved are off limits to use outside of fair use.

 

Q: How do I know if my use is allowed?

A: Valid free use of my photos under the license means that you are not to make money as a direct result of using the photo. This means uses such as advertisements or product packaging or the like. In addition, you must let the viewer know the author of the photograph, no matter the medium. That can be done by including the name mentioned above and preferably also a link back to the photo page here on Flickr if possible. The use cannot be derivative. Derivative means a new work built based on my work.

 

Q: What can I do with the photo under this CreativeCommons license?

A: Here's a few valid use cases:

- Blog post

- News article

- Noncommercial projects

- Part of a Collective Work

 

Q: What can't I do with the photo under this CreativeCommons license?

A: Here's a few invalid use cases. These are just examples, not an exhaustive list. Apply common sense.

- Printing the photo and selling the prints.

- Using the photo in a promotion or advertisement.

- Showing the photo in a context where credit is not visible.

- Using the photo in creating a derivative work of it, e.g. changing the story or composition meaningfully.

- Re-licensing the original photo with a broader or narrower license form. The license gives only a right to use, not a right to re-license.

- Restricting the access to the photo in any technological manner, such as a paywall. It must be possible for me to be able to confirm that the usage is fair.

- Using the photo as a commodity, e.g. content in a wallpaper app or equivalent library, is forbidden. This is because such use usually involves some sort of monetization and has potential to result in commercial benefit.

 

Q: What are the license requirements?

A: The license is called CreativeCommons BY-NC-ND 2.0, and this is what it requires:

 

BY, Attribution: This means that you have to mention the author (that's me, Niko Hörkkö) and title of the photo.

A quote from Section 4, part C of the BY-NC-ND 2.0 license:

"If you distribute, publicly display, publicly perform, or publicly digitally perform the Work, You must keep intact all copyright notices for the Work and give the Original Author credit reasonable to the medium or means You are utilizing by conveying the name (or pseudonym if applicable) of the Original Author if supplied; the title of the Work if supplied...".

This part also encourages the inclusion of the address of the photo, in this case meaning the Flickr page where you found the photo.

 

NC, NonCommercial: Here's a quote from Section 4, part B of the BY-NC-ND 2.0 license: "You may not exercise any of the rights granted to You in [the license] in any manner that is primarily intended for or directed toward commercial advantage or private monetary compensation.".

 

ND, No Derivatives: "The [license rights] include the right to make such modifications as are technically necessary to exercise the rights in other media and formats, but otherwise you have no rights to make Derivative Works.".

The license defines Derivative Works as follows: ""Derivative Work" means a work based upon the Work or upon the Work and other pre-existing works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which the Work may be recast, transformed, or adapted, except that a work that constitutes a Collective Work will not be considered a Derivative Work for the purpose of this License."

I routinely monitor the use of my photos and all license violations will be investigated and violating use will be billed. Please respect copyright and the license terms.
