GDPR (General Data Protection Regulation)

My images and captions/tags are protected under GDPR under the section of "Legitimate Interests".

The ICO say:

‘’Legitimate Interests is likely to be most appropriate where you use people’s data in ways they would reasonably expect and which have a minimal privacy impact, or where there is a compelling justification for the processing.’’

Legitimate Interests Assessment (LIA) 21st April 2020

1. Identification of Legitimate Interests:

1a. Personal Interests to me as the photographer, to be able to identify the public participants that I have photographed at the public sports events

1b. Societal Benefits to existing and new fans, family and friends of public participants, to identify public participants at public sports events

1c. Historical Record of the public sports event, which includes the name of the event, the date of the event, and the name of the public participants who participated in the event

2. Processing is necessary to achieve the Identified Legitimate Interests under the following conditions:

2a. It would be impossible to identify the public participant in the image without using the name of the public participant

2b. The public participant at the public sports event would be aware that their names would be required to identify them in the public sports event

2c. The public participant would reasonably expect that photographers would be present at the public sports event

2d. The public participant would reasonably expect that photographers could/would use their name as a caption/tag to identify them in the images taken and published at the public sports event

3. A balance against the individual’s interests, rights and freedoms is maintained through the following:

3a. Only the name of the public participant is used

3b. The name of the public participant is used only as a caption/tag to identify their images

3c. The name of the public participant does not fall under sensitive information as it contains no birth dates, home address, contact numbers, medical history, occupations, political views etc.

3d. The name of the public participant does not fall under private information as the public sports event results are published freely to the public

3e. The information collected and published, being the name of the public participant at the public sports event is neither intrusive nor could cause harm to the public participant

I have considered an opt out policy, but that would negate the Legitimate Interests as previously set out.

If circumstances change then The Legitimate Interests Assessment (LIA) will be reviewed.

If any changes to this statement are made based upon the LIA then this section will be updated to reflect the changes found in the LIA.
