I am INDIRA DHAKAL. I am a citizen of Nepal, born on 17th of May 1982 in Nepal. I speak Nepali and English. I am Hindu by religion and ethnicity is Chhetri. I got married to Shailendra Dhakal in 21st November 2000 and have none children.

Since 1st Jan 2000 I started to work in Nepal Disabled Children Welfare Association(NDCWA). I used to write the articles on human right issues. One of my article raised the issue of human right and child right violation by Maoist. The entitled of the article is “ Victimized Children Right in between Maoist Violence.” The article published in a weekly newspaper. The name of news paper is Taja Khabar and the publication date is 05-10-2004. Just after this article, they were so mad at me and started threatening me. They will even call my phone and made a direct verbal threat They frequently asked me to join the young communist league. I denied their proposal. They kept on calling me and threatened me of my life. They also called the other members of NDCWA and threatened them too. They even asked the deaf children for army purpose with the members of NDCWA.

All these continue until June 4, 2009, the Maoist, a number of them came to our house while my husband was away, they beat me and my father in-law and my hair was pulled out.

This incident scared me to death. Hence, I have no choice than to run for my dear life. I went India, Ananda Niketan to issue visa from Embassy of Mexico. Of course, I applied for the visa in US embassy after getting the threat form Maoist in earlier days before writing the article but my visa didn't issue. With the help of my family members and help of some friends I left Nepal on July 18, 2009 for Mexico through India and Germany with Nepal issued passport. I stayed five days in Mexico, Mexico City in a hotel Drang and five days in Matamorus. I paid a sum of $14000 to a smugglers to bring me to the United States all the way from Nepal. I crossed the Renaissance river. When I was trying to cross the border line near or the Brownsville TX. on 7-28-2009, I got arrested and detained in Willacy processing center on 7-31-2009. I got transferred in South Texas Detention Complex. I arrived in this detention center on August 11, 2009. I again got transferred the detention named T. Don Hutto in 9-12-2009. I got released in 11-23-2009 after paying my bond of $ 3000 to US Immigration.

Having fear of the Maoist, they might give me mental torture, harm me or even plot to kill me. I responded to the immigration officer that I cannot go back to Nepal. Hence, my declaration of Asylum.

My case was last heard on September 10, 2009. While the next hearing is June 30, 2010. My master hearing is on September 8, 2010. My court date is changed on the date March 29, 2011. The court date is postponed again because of transformation of the my case from Huston to

llas court house. I am waiting my hearing on March 29, 2011 in Dallas court house.
