Telecom phone card

I sometimes see pictures on Flickr where someone has taken a picture of some sculpture or similar and the comments praise the photographer when the photo is no more than a snapshot of an artist's work.

At what point does the work become that of the photographer's. If I had called this picture "Owl" people would have said "Great capture" and stuff. If I call it "Phone Card" as I have done I would expext people to say "Oh, what a rip-off!"

If i take a picture of anyone else's work would I have done any better?
